GENERAL REPRESENTATIVE OF THE PEOPLE ' S REPRESENTATIVE COUNCIL, REPRESENTATIVE COUNCIL

CHAIRMAN OF THE GENERAL ELECTION COMMISSION,

Weigh:    that to implement the governing provisions of the Election Results, the Acquisition of Seat and Selected Candidates, the Notice of Selected Candidates and the Elected Candidate's Reimbursion as mandated in Act Number 8 of the Year 2012 about the People's Representative Council Elections, the Regional Representative Council and the Regional People's Representative Council and the provisions of Article 8 of the paragraph (1) the letter c, the letter k and the letter l, Section 9 of the paragraph (1) the letter i and the letter j and Section 10 of the paragraph (1) and the letter k Act No. 15 Year 2011 on Election Organizers of the General Election, need establish the General Election Commission Regulation on the Penetration Of The General Election Results, The Acquisition Of Seats, Elected Candidates And The Replacement Of Elected Candidates In The General Election Of The Members Of The People's Representative Council, The Regional Representative Council, The People's Representative Council. Provincial District, and the District/Kota; Regional People's Representative Council.

Remembering: 1.  Act No. 15 Year 2011 on Organizing General Elections (Sheets Of State Republic Of Indonesia In 2011 Number 101, Additional Sheet Of State Republic Of Indonesia Number 5246);
2. Act Number 8 of the Year 2012 concerning the General Election of the Members of the People's Representative Council, the Regional Representative Council, and the Regional People's Representative Council (Global Gazette 2012) Number 117, Additional Gazette of the Republic of Indonesia Number 5316);
3. General Election Commission Regulation No. 05 Year 2008 on the Working Governance Commission, the Provincial Electoral Commission, and the District/City Elections Commission as it has been several times amended, last with the Election Commission Regulation General Number 01 Year 2013;
4. Election Commission Regulation No. 06 of 2008 on the Structure of the Organization Secretariat General Election Commission, Secretariat of the Provincial Election Commission, and the Secretariat of the Election Commission of the District/City as amended with the Regulation of the General Election Commission No. 22 of 2008;
5. General Election Commission Regulation Number 07 of 2012 on Tahapan, Program, and Jadual of the General Elections of the Members of the People's Representative Council, the Regional Representative Council, and the Regional People's Representative Council of 2014, as it has been several times modified, lastly with the Regulation of the General Election Commission Number 21 Year 2013;
6. General Election Commission Regulation No. 07 of 2013 on the Candidacy Of The Members Of The People's Representative Council, the Provincial Regional Representative Council, and the District/City Regional Chamber of Representatives/City as amended by the Rules of the Commission General Election Number 13 Year 2013;
7. Election Commission Regulation No. 08 of 2013 on the Candidacy For Individual Persons Election Participant of the Member of the Regional Representative Council as amended last several times with the Regulation of the General Election Commission No. 22 of 2013;
8. Regulation of the General Election Commission Number 26 Year 2013 on the Vote and the Counting of votes in the Place of the Vote in the General Election of the Members of the People's Representative Council, the Regional Representative Council, the Provincial Regional People's Representative Council and the Council. DECIDED:

SET: REGULATION OF THE GENERAL ELECTION COMMISSION ON THE DESIGNATION OF GENERAL ELECTION RESULTS, THE ACQUISITION OF SEATS, ELECTED CANDIDATES AND THE REPLACEMENT OF THE ELECTED CANDIDATE IN THE GENERAL ELECTION OF THE PEOPLE 'S REPRESENTATIVE COUNCIL, THE REGIONAL REPRESENTATIVE COUNCIL, THE PEOPLE' S REPRESENTATIVE COUNCIL THE PROVINCIAL AREA, AND THE KABUPATEN/CITY PEOPLE ' S REPRESENTATIVE COUNCIL.

BAB I
UMUM CONDITIONS
Section 1
In this Regulation, which is referred to:
1. The General Election, subsequently called Election, is the means of the exercise of the sovereignty of the people exercised directly, general, free, secret, honest, and fair in the State of the Republic of Indonesia based on Pancasila and the Basic Invite Republic of Indonesia in 1945.
2. Election Members of the People's Representative Council, Regional Representative Council, and the Regional People's Representative Council are the elections to elect members of the House of Representatives, the Regional Representative Council, the Provincial Regional Representative Council and the House of Representatives. People of the Republic of Indonesia/City in the Union of the Republic of Indonesia based on Pancasila and the Basic Law of the Republic of Indonesia in 1945.
3. The House of Representatives, subsequently called the House, is the People's Representative Council as referred to in the Basic Law of the Republic of Indonesia in 1945.
4. The Regional Representative Council, subsequently called the DPD, is the Regional Representative Council as referred to in the Basic Law of the Republic of Indonesia in 1945.
5. Provincial Regional People's Representative Council and the District/City Council of People's Representative Council, subsequently called DPRD Province and DPRD District/City, is the Provincial Regional Representative Council and the District/City Regional People's Representative Council. As it is in the Constitution of the Republic of Indonesia in 1945.
6. The Papuan People's Representative Council and the People's Representative Council of West Papua, further abbreviated to the DPRP and the DPRPB, are the Regional People's Representative Council of the Province of Papua and the Regional People's Representative Council of West Papua Province as referred to in the Law No. 21 of 2001 on Special Autonomy for Papua, as amended by Law No. 35 of 2008.
7. Council of Representatives of Aceh, subsequently abbreviated to DPRA, is the Regional People's Representative Council of Aceh Province as referred to in Law No. 11 of 2006 on the Government of Aceh.
8. Council of Representatives of the Regency/City in the region of Aceh Province, next abbreviated DPRK, is the Council of Representatives of the District of District/City in the region of Aceh Province as referred to in Act No. 11 of the Year 2006 on Government of Aceh.
9. The Electoral Commission, further abbreviated to the KPU, is a national, permanent, and self-organizing electoral organization responsible for implementing the elections.
10. Provincial Election Commission/Independent Commission of Aceh Elections, further abbreviated as KPU Provinsi/KIP Aceh, is an Election Organizer in charge of conducting elections in the province.
11. District/City Elections/Urban Elections Commission/City, further abbreviated as KPU/KIP Regency/City, are Election Organizers in charge of conducting elections in districts/cities.
12. Election Supervising Board, further abbreviated as Bawaslu, is an electoral organization that is responsible for overseeing elections in all areas of the Republic of Indonesia.
13. The Provincial Election Supervising Board, subsequently called Bawaslu Province, is a body formed by Bawaslu which is responsible for overseeing the elections in the province.
14. The Municipal/City Election Supervising Committee, next called Panwaslu Regency/City, is a Panitia formed by the Bawaslu Province which is in charge of overseeing the elections in the District/City.
15. Political Party, subsequently called the Political Party, is the participant of the House of Representatives, the Provincial Council, and the District Council/City Council of 2014 as referred to in the Decree of the General Election Commission Number: 05 /Kpts/KPU/2013 on Redemption Political Party of Representatives, DPRD Provincial, and DPRD Regency/City of 2014, and Local Political Party Aceh for Elections of the Members of the DPRA and DPRK in the region of Aceh province as referred to in Aceh KIP Decree No. 02 of 2013 on Redemption The Local Political Party As An Election Participant Of The DPRA Member And The DPRDK 2014.
16. List of Permanent Candidates of Representatives, List of candidates for Permanent Representative of the Provincial Council and the Remaining Candidate Lists of DPRD County/City, subsequently called DCT Members of the House, DCT Members of the Provincial Council and DCT Members of the District/City Council, is the list of candidates The number of political parties, political parties, signs of political parties, number of candidates, fit photo candidates, full name for candidate, gender and district/City or district where candidate lives.
17. List of candidates for DPD Members, henceforth DCT Members DPD, is a list of DPD candidates for each province/constituency containing the number of order indicating the individual voting numbers of the Election participants and starting after the Party numbers of the Political Party of the Election, as well as the most recent self-portrait and the full name of the candidate composed based on the order of the

List of Permanent Candidates Member of the Provincial Council and District Council/City, subsequently called DCT Members of the Provincial Council and DCT Members of the District/City Council, is a list of names of the provincial members of the Provincial Council and Member of the Council of Representatives/City. based on the order number and is equipped with the latest self-photo fitting for each constituency Member of the Provincial Assembly and the District/City DPRD, which is set by KPU Province and KPU District/City.

20. The official voice of the Political Party nationally is the overall number of Authorized votes earned throughout the Political Party and the candidate of the House of Representatives, throughout the constituency of the Member of the House.
21. Election Numbers for House seats, further abbreviated BPP DPR, are the numbers obtained from the division of the number of Authorized votes throughout the Political Party of Elections which meet the specific threshold of the National Authorized Voice in one election area with the number of seats in an election area to determine the number of seats for the Political Party of the Election Participant.
22. Election Numbers for the Assembly Chair, further abbreviated as BPP DPRD, is the number obtained from the division of the number of Authorized votes with the number of seats in an electoral region to determine the number of seats of the Party's Political Parties. Elections and elected members of the Provincial Council and District Council/City Council.
23. Day is a calendar day.

Section 2

Section 3
(1) The elections to elect members of the House, Provincial DPRD, and DPRD County/City are implemented with an open proportional system.
(2) The elections to elect a DPD Member are exercised with a representative district system.

BAB II
THE DESIGNATION OF THE VOTE AND THE ANNOUNCEMENT OF THE ELECTION RESULTS
Section 4
(1) Approval Fulfillment of the Electoral Party Member of the DPR Members of the DPR, the acquisition of the Authorized Voice of the Member of the DPR and the Acquisition of the Remaining Votes of the DPD for each election area, executed by the KPU in an open plenary meeting attended by the Party of Representatives. Witnesses and Bawaslu, as well as announced at least 30 (thirty) days after the day and date of the vote.
(2) Penetration Acquisition of the Political Party Elections Member of the Provincial Council and the Acquisition of the Provincial Member of the Provincial Council for each constituency, conducted by the Provincial Commission in an open plenary meeting attended by the Witnesses and the State of the Province of the Province of Parliament. Section 5
(1) The Authorized Voice of the Political Party and the acquisition of the Authorized Voice of the Member of the House, as well as the acquisition of the Authorized Voice of the Member of the DPD referred to in Article 4 of the paragraph (1) are specified by the Decree of the Law
(2) The Legal Acquisition of the Political Party Member Party of the Province and the Acquisition of the Provincial Council of the Member States as referred to in Article 4 of the paragraph (2) are defined by the Provincial Decree of the Province.
(3) The Political Party's Authorized Voice Acquisition of the Regency/City Member States and the acquisition of the Member of the Council for the Member of the Assembly/City as referred to in Article 4 of the paragraph (3) is defined by the Decree of the District/City Council.

Section 6
The KPU establishes and announces nationally the results of the Election Members of the DPR, DPD, DPRD Province, and DPRD Regency/City as referred to in Article 5, with the Decree of the KPU the slowest 30 (thirty) days after the day and date of the polling vote.

Section 7
The decision of the KPU on the designation of the Election of Representatives, the DPD, the Provincial Council, and the DPRD County/City nationwide as referred to in Article 6, is based upon:
a.   The decision of the District/City Election Commission on the designation of the Political Party's Authorized Voice and the acquisition of the Legal Board of the Member States Council/City, the news of the show recapitulation results of the results of the electoral votes of the Parliament Members of the District/City, the certificate recapitulation results of the calculation of the Political Party's votes and the details of the Legal Acquisition of the City/City Council Member States as well as the invalid voice (Model DB DPRD Regency/City, Model DB-1 DPRD County/City and Appendix DB-1 DPRD Model Attachment District/City);
B.   The decision of the Provincial Commission on the designation of the Political Party's Authorized Voice and the acquisition of the Authorized Voice of the Member of the Provincial Council, the news of the show recapitulation results of the electoral votes of the Provincial Council Members of the Province, the certificate of recapitulation results of the counting The vote for the Political Party, and the details of the Legal Acquisition of the Provincial Council Member States as well as the invalid vote (Model DC DPRD Province, Model DC-1 DPRD Province and Attachment Model DC-1 DPRD Province);
C.   The decision of the KPU on the establishment of the Political Party's Authorized Voice and the acquisition of the Authorized Voice of the Member of the House, the news of the recapitulation of the electoral votes of the House of Representatives, the certificate of recapitulation of the results of the vote tally Politics, and the details of the Republican Party of Representatives ' s Authorized Voice acquisition as well as unauthorised votes (Model DD DPR, Model DD-1 DPR and Attachment Model DD-1 DPR);
D.   The decision of the KPU on the designation of the Authorized Voice and the Rating Rating of the DPD, as well as the news of the event of the recapitulation of the results of the DPD Member Election vote, the certificate of recapitulation of the results of the vote tally and the The DPD member's voice acquisition rating as well as non-legal votes (DPD Model DD, DD Model 1 DPD, and DD-1 DPD Model Attachment).

BAB III
VALID VOICE ACQUISITION THRESHOLD DESIGNATION
Section 8
(1) The political party must meet the threshold of 3.5% of the vote (three five percent) of the number of national Authorized votes for the House of Representatives elections, to be included in the decision of the DPR seats.
(2) The determination of the percentage of the political party votes which meets the threshold as referred to in paragraph (1) is conducted by dividing the Authorized Voice of each Political Party nationwide with the overall total number of Authorized votes. Political parties are nationally multiplied by 100% (one hundred percent).
(3) The provisions as referred to in paragraph (1) and paragraph (2), are not enforced in determining the acquisition of the Provincial Council seats and the District/City DPRD.

Section 9
(1) The KPU establishes a Political Party that meets or does not meet the provisions as referred to in Article 8 of the paragraph (2) with the Decree of the KPU.
(2) The Decree of the KPU as referred to in paragraph (1), is delivered to the Central Leadership Council of the Political Party and Bawaslu.

Section 10
(1) The Political Party which meets the threshold of the Authorized Voice acquisition as referred to in Article 9 of the paragraph (1), is entitled to be included in the counting of the acquisition of the House seats in the entire constituency of the Member of the House.
(2) The political party that does not meet the threshold of the Authorized Voice acquisition as referred to as Article 9 paragraph (1), is not included in the counting of the acquisition of the House seats in the entire voting area of the House of Representatives.
(3) Political Party which does not meet the threshold of the Authorized Voice acquisition as referred to as Article 9 paragraph (1), remains included in the calculation of the Acquisition of the Provincial Assembly seats and the District/City DPRD seats in the entire constituency of the Member of Parliament Province and District Council/City.

BAB III
SEAT ACQUISITION
The First Part
The People's Representative Council
Section 11
(1) The fulfillment of the respective seats of the Political Party in each constituency is carried out by setting the BPP of the DPR.
(2) The acquisition of the House seat in each election area as referred to in paragraph (1), based on the News Event Recapitulation Results of the Election Results of the DPR Member, Certificate of Recapitulation The results of the calculation of the Voice Acquisition Political Parties, and Details of the Legitimate Sound Acquisition of Representatives and Non-Legal Votes in the KPU (Model DD DPR, Model DD-1 DPR and Attachment Model DD-1 DPR).
(3) The BPP of the House as referred to in paragraph (1), calculated in the way that the total number of Political Parties votes in each constituency is reduced by the acquisition of the Political Party's Authorized Voice which does not meet the threshold divided by the the number of seats in the constituency.
(4) If the DPR BPP is obtained from the result for the entire number of Political Parties Authorized votes with the number of seats in each of the respective constituting regions as referred to in paragraph (2) resulting in the fraction figures, then the fraction of 0.5 or more Rounded up to the top and the split figure below 0.5 is abolished.
(5) The acquisition of Political Party seats as referred to in verse (3), is poured in the news of the event signed by the Chairman and Member of the KPU as well as the Witnesses present (Model E DPR).

Section 12
Once established by the DPR BPP as referred to in Article 11, the KPU conducts a calculation of the Political Party seats in each constituency.

Section 13
The calculation of the Political Party seats in each electoral district as referred to in Article 12, is conducted in 2 (two) stages:
1. The First Stage Count is conducted by means of dividing the number of Authorized Voices obtained each Political Party with the BPP, provided:
a.   if the Authorized Voice of a Political Party is equal or more with the BPP then the Political Party gains a seat;
B.   if in the calculation as intended on the letter a still the remainder of the vote, then the remainder of the vote will be counted in the Second Stage count;
c. if the Legal Voice of a Political Party does not reach the BPP, then the Political Party does not acquire a seat in the First Stage count, next the number of Political Parties ' Authorized Voice becomes the remainder of the vote in the Stage seat tally. Second.
2. The Second Stage Count is performed if there are still remaining seats in the First Stage Count, distributing the remaining undivided seats to the Political Party based on the rest of the votes.

Section 14
(1) If a Political Party has an Authorized Voice or the rest of the vote is the same as referred to in Article 13 of the 2nd, then the Political Party that has the remaining votes in the constituency in question is entitled to the above. Last seat left.
(2) The Party of Politics is expressed as having a greater share of the votes, as it is referred to in verse (1), if the remainder of the vote is spread on the number of more territories in one (one) level below.

Section 15
(1) The count of votes and the establishment of the acquisition of the Political Party seats each constituency Member of the House as referred to in Article 13 is poured in the Official Event News Form and the Nomination Candidate's Nomination Members of the People's Representative Council in 2014 (Model E DPR).
(2) The acquisition of the Political Party seat of each constituency Member of the House as referred to in paragraph (1) as well as its light, poured in the Form of Governing Political Party Seats in Elections Member of the People's Representative of the Year 2014 (Model E-1 DPR, Annex I Model E-1 DPR and Annex II Model E-1 DPR).

The Second Part
Provincial Regional People's Representative Council
Section 16
(1) The fulfillment of the respective seats of the Political Party in each constituency is carried out by setting the BPP DPRD.
(2) The acquisition of the Provincial Assembly seat in each constituency as referred to in paragraph (1), is based on the News of the Event Rekapitulation Results of the Election Vote Member of the Provincial Council, the Certificate of Recapitulation of the Results Calculation of Political Parties vote, and Details of the Acquisition of the Legitimate Sound Candidate of the Provincial Assembly and Unauthorised Voice in the Provincial KPU (Model DC DPRD Province, Model DC-1 DPRD Province and Appendix Model DC-1 DPRD Province).
(3) The BPP DPRD as referred to in paragraph (1), calculated by the way the total number of Political Parties ' Authorized Voice in each constituency of the Provincial Council of Representatives is divided by the number of seats in the constituency.
(4) If the BPP DPRD is obtained from the result for the number of entire Political Parties Authorized votes with the number of seats in each constituency in question as referred to by paragraph (2) to produce a floating number, then the fraction of 0.5 or More rounded up and floating figure below 0.5 is removed.
(5) The fulfillment of the acquisition of the Political Party seats as referred to in verse (3), is poured in the news of the event signed by the Chairman and Member of the Provincial KPU as well as the Witnesses present (Model EA DPRD Province).

Section 17
After specified BPP DPRD as referred to in Article 16, the Provincial KPU conducts a calculation of the acquisition of the Political Party seats in each constituency.

Section 18
The calculation of the Political Party seats in each electoral district as referred to in Article 17, is conducted in 2 (two) stages:
1. The First Stage Count is conducted by means of dividing the number of Authorized Voices obtained each Political Party with the BPP DPRD, provided:
a.   if the Authorized Voice of a Political Party is equal or more with the BPP DPRD then the Political Party acquires a seat;
B.   if in the calculation as intended on the letter a still the remainder of the vote, then the remainder of the vote will be counted in the Second Stage count;
c. if the Legal Voice of a Political Party does not reach the BPP of the DPRD, then the Political Party does not acquire a seat in the First Stage count, further the number of the Political Party's Authorized Voice becomes the rest of the votes to be counted in. Second Stage seat counting.
2. The Second Stage Count is performed if there are still remaining seats in the First Stage Count, distributing the remaining undivided seats to the Political Party based on the rest of the votes.

Section 19
(1) If there is a Political Party that has a valid Voice or the rest of the vote as referred to in Article 18 of the 2nd, then the Political Party that has the remainder of the vote in which the voting area is in question is entitled to the right of the vote. Last seat left.
(2) The Party of Politics is expressed as having a greater share of the votes, as it is referred to in verse (1), if the remainder of the vote is spread on the number of more territories in one (one) level below.

Section 20
(1) The count of votes and the designation of the acquisition of Political Parties to each constituency Member of the Provincial Assembly as referred to in Article 18 is poured in the Event News Form Acquisition of the Chair of the Political Party and the Prospective Fulfillment Elected Member of the Regional Representative Council of the Province of the Year 2014 (Model EA DPRD Province).
(2) The acquisition of the Political Party seat of each constituency Member of the Provincial Assembly as referred to in paragraph (1) as well as its appends, is poured in the Form of the Acquisition of the Political Parties seats in the People's Representative Council Elections. In 2014 (Model EA-1 DPRD Province, Appendix I Model EA-1 DPRD Province and Appendix II Model EA-1 DPRD Province).

The Third Part
District Regional People's Representative Council/City
Section 21
(1) The fulfillment of the respective seats of the Political Party in each constituency is carried out by setting the BPP DPRD.
(2) The acquisition of District/City Council seats in each election area as referred to in paragraph (1), is based on the News of the Event Rekapitulation Results of the Election Voice of the District/City Council, the Certificate of Recapitulation Results of the Political Party's Voice Acquisition Act, and Details of the Authorized Voice Acquisition of the Provincial Assembly Member and the Unauthorised Voice in the District/City Commission (Model DB DPRD, Model DB-1 DPR and Appendix DB-1 DPR model).
(3) BPP DPRD as referred to in paragraph (1), calculated in the way the total number of Political Parties ' Authorized Voice in each constituency of the Regency/City Member Elections is divided by the number of seats in the constituency.
(4) If the BPP DPRD is obtained from the result for the number of entire Political Parties Authorized votes with the number of seats in each constituency in question as referred to by paragraph (2) to produce a floating number, then the fraction of 0.5 or More rounded up and floating figure below 0.5 is removed.
(5) The fulfillment of the acquisition of the Political Party seats as referred to in verse (3), is poured in the news of the event signed by the Chairman and Member of the Regency/City and the Witnesses present (Model EB DPRD Regency/City).

Section 22
Upon set of the BPP DPRD as referred to in Article 21, the District/City Council conducts a calculation of the acquisition of the Political Party seats in each constituency.

Section 23

Section 57

Section 61

CLOSING PROVISIONS
Section 69
