REGULATION OF THE REPUBLIC OF INDONESIA ' S OIL AND GAS DOWNSTREAM REGULATORY AGENCY

ABOUT
EARTH GAS TRANSPORT TARIFF VIA THE SIMPANG Y TRANSMISSION PIPELINE OF Y – ELEVATED ISLAND AND ELEVATED ISLAND – PUSRI (PIPA EKSISTING AND LOOPING)
WITH THE GRACE OF THE ALMIGHTY GOD
CHIEF GOVERNING BODY OF DOWNSTREAM OIL AND GAS EARTH REPUBLIC OF INDONESIA,
Weigh: a. that under the provisions of Article 5 of the Order of Government Regulation No. 67 of 2002 and Article 9 of the Government Regulation Number 36 of 2004, the Board of Governing Body Has The Authority To Establish The Tarif Of The Gas Transport Through The Pipe;
B. that in the presence of new investment and/or investment value changes in the PT. PT pertamina gas ruas transmission simpang y – Elevated Island and Layang Island – PUSRI, then it needs to change Earth's gas transport tariff through transmission field pipelines. Simpang Y – Layang Island and Layang Island – PUSRI on the Pipe of PT Pertamina Gas;
c. that PT Pertamina Gas through the Letter of Lead Director Number 128/PG0000/2012-S1 dated March 12, 2012 subject to the application of the Earth-gas transport tariff looping of the simpang transmission of y – the Elevated Island and Layang Island – PUSRI;
D. that it had been implemented on the Committee Session on Thursday April 4, 2013, agreeing to establish the Earth's gas transport tariff through the simpang transmission pipeline of y – the Elevated Island and Layang Island – PUSRI (Pipe Eksisting and Looping) Property of PT Pertamina;
e. that based on consideration as intended in the letter a, the letter b, the letter c, and the letter d, need to specify the Regulation of the Earth's Oil and Gas Lower Governing Body on the Designation Tariff of Earth Gas Through the Simpang Y Transmission Pipeline – Layang Island and Layang Island – PUSRI (Pipe Eksisting and Looping);
Given: 1. Law Number 22 Year 2001 on Oil and Earth Gas (State Of The Republic Of Indonesia In 2001 Number 136, Additional Sheet Of State Republic Indonesia Number 4152);
2. Government Regulation No. 67 of 2002 on the Agency for the Provisioning Governing Body and the distribution of Petroleum Fuel and Petroleum Transportation Activities Through Pipes (sheet Of State Of The Republic Of Indonesia In 2002 Number 141, Additional Sheet Of State Republic of Indonesia No. 4253) as amended by Government Regulation No. 49 Year 2012 (State Gazette 2012 2012 Number 95, Additional Gazette of the Republic of Indonesia Number 5308);
3. Government Regulation No. 36 Year 2004 on the Activities of the Low Oil and Earth Gas (State of the Republic of Indonesia Year 2004 Number 124, Additional Gazette Republic of Indonesia Number 4436) as amended by Regulation Government Number 30 Year 2009 (sheet Of State Of The Republic Of Indonesia In 2009 Number 59, Additional Sheet Of State Of Indonesia Republic Number 4996);
4. Government Regulation No. 1 2006 on Besaran and Use of Iuran Body in the Activities of Supplies and Distributed Fuel Oil and Transport of the Earth Gas Via Pipe (State Sheet of the Republic of Indonesia in 2006 Number 2, Addition Of Sheet Country Indonesia Number 4596);

8. Regulation Body Regulation Number 21 /P/BPH MIGAS/III/2011 about Account Account Settings (Regulatory Accounts) Earth Gas Transporting Efforts Through Transmission Pipelines;
9. Decision of the Minister of Energy and Mineral Resources Number 0023 K/10/MEM/2009 on the Permit Efforts Of The Petroleum Transport Through Pipes to PT Pertamina Gas (Pertagas);
10. Decision Head of the Lower Board of Petroleum and Earth Gas No. 166 /KT/BPH MIGAS/Kom/II/2009 about the Special Rights Transportation of Earth Gas Via Pipe On the Ruas Simpang Y – Layang Island and Layang Island – PUSRI To PT. Gas First;
DECIDED:
SET: REGULATION OF THE PETROLEUM AND GAS DOWNSTREAM REGULATORY BODY ON THE DESIGNATION OF PETROLEUM TRANSPORT FARES THROUGH THE SIMPANG Y TRANSMISSION PIPELINE OF Y – ELEVATED ISLAND AND ELEVATED ISLAND – PUSRI (PIPA EKSISTING AND LOOPING).
Article 1
In this Regulatory Body Regulation, referred to:
1. Tarif Transport of Earth Gas Through Pipe, which is then called Tarif is the Transporter of the Shipper of the services of the Earth Gas Transport Via Pipe per one MSCF that is transported Transporter.
2. Pipe Ruas Transmission is Pipe Ruas Transmissions Simpang Y to Layang Island and Layang Island to PUSRI.
3. PT Pertamina Gas is the Entity ID which has the Attempted Gas Transport Effort of the Earth Through the Pipe and has the Special Right to be called Transporter.
4. Shipper is the Entity ID that uses the Transporter Facility to transport the Earth Gas it owns.
5. The next Petroleum and Gas Lower Governing Body called the Board of Governing Body is a Body formed to conduct the arrangements and supervision of the provision and distribution of Earth Gas and Gas Fuel and the Earth Gas Transport. Through Pipe in Lower Business Activities.
Article 2
Fare of Earth Gas Transport Via Pipe
(postage Stamp tariff) operated by
Transporter On The Simpang Y Transmission Field – Tair Island amounted to USD0.05/
MSCF (Zero Koma Zero Five Dollar per Thousand Cubic Feet Standard) and on the Elevated Island Transmission – PUSRI for USD0.05/
MSCF(Zero Koma Zero Five Dollar per Thousand Cubic Feet Standard).
Article 3
In carrying out the Earth Gas Transport Operations Through Pipe,
Transporter is required to apply the specified Tarif as referred to in Section 1.
Section 4
Shipper that uses the Transmission Ruas Pipe as referred to in Article 1 of the figure 2, is required to adjust the specified Tarif as referred to in Article 1.
Section 5
Transporter is required to deliver an Account Settings Account Report to the Governing Body as set up in the Regulation Body Regulation No. 21 /P/BPH MIGAS/III/2011 about the Set Up Account Report (
Regulatory Accounts) Effort Earth Gas Transport Through Transmission Pipes.
Section 6
Transporter and
Shipper in performing the Earth Gas Transport Through Transmission Ruas pipeline is required to comply with all laws and conditions as set out in the guidelines issued by the Governing Body.
Section 7
By definition of this Decision, then the Decree of the Head of the Lower Board of Petroleum and Earth Gas Number: 167 /Tarif/BPH Migas/Kom/II/2009 on the Determination Of The Transport Tariff Of The Earth Through The Pipe At 32 (thirty-two) The Transmission Of The Transmission To The PT. The pertamina Gas (Pertagas) set about the Tarif of the Earth Gas Transport Via Pipe on the Simpang Y Transmissions Ruas Y – Layang Island and Layang Island – PUSRI, revoked and declared not applicable.
Section 8
The regulation of the governing body comes into effect on the promulgated date.
