REGISTRATION TREATMENT
ELECTRONIC FIDAGE GUARANTEE
WITH THE GRACE OF THE ALMIGHTY GOD
MINISTER FOR LAW AND HUMAN RIGHTS REPUBLIC OF INDONESIA,
Weigh: a. that in order to improve the service of the service hokum service registration fidusia to the public easily, fast, cheap, and comfortable then the application of fidusia guarantee registration is done electronically;
B. that based on the consideration as referred to in the letter a, it needs to establish the Regulation of the Minister of Law and Human Rights on the Electronic Warranty Registration Treatment;
Given: 1. Law No. 42 Year 1999 on Warranties of Fidusia (State Sheet of the Republic of Indonesia Year 1999 Number 168, Additional Gazette of the Republic of Indonesia Number 3889);
2. Act No. 39 of 2008 concerning the Ministry of State (State Sheet of the Republic of Indonesia 2008 No. 166, Additional leaf of the Republic of Indonesia Indonesia Number 4916);
3. Government Regulation No. 86 of the Year 2000 on the Tata Cara Registry Guarantee and Cost of Making Deed Warranty Of Fidusia (sheet Of State Of The Republic Of Indonesia In 2000 Number 170, Extra State Of The Republic Of Indonesia Number 4005);
4. Presidential Regulation No. 47 of 2009 on the Establishment and Organization of the Ministry of State as amended last by the Presidential Regulation Number 91 of 2011 on the Third Amendment to the Presidential Regulation No. 47 Year 2009 on the Establishment and Organization of the Ministry of State (State of the Republic of Indonesia in 2011 Number 141);
5. Presidential Regulation No. 24 Year 2010 on Occupation, Duty, and Functions of the Ministry of State as well as Susunan Organization, Duty, and Functions of Eselon I Ministry of State as it has been several times amended last with the Presidential Regulation Number 92 2011 on the Second Amendment to the Presidential Regulation No. 24 of 2010 on Occupation, Duty, and Functions of the Ministry of State as well as the Organizational Functions, Duty, and Functions of the Ministry of State (of the State of the Republic of Indonesia in 2011) Number 142);
6. Regulation of the Minister of Law and Human Rights Number M-01.PR.07.10 Year 2005 on the Organization and the Work order Office of the Department of Law and Human Rights of the Republic of Indonesia;
7. Regulation of the Minister of Law and Human Rights Number M. HH-05.OT.01.01 Year 2010 on the Organization and the Working Governance of the Republic of the Republic of Law and Human Rights;
DECIDED:
establish: Law of the Minister of Law and Human Rights on the electronic registration of FidAGE Guarantate.
Article 1
In Regulation of this Minister referred to:
1. The applicant is the recipient of the fidusia, the power or his deputy.
2. The Electronic Warranty Registration is an electronic registration of a fidage guarantee that is performed by the applicant by charging an application electronically.
Article 2
(1) The Electronic Fidage Guarantee Registration includes:
a. register of fiduciary guarantee;
B. register of fiduciary guarantee changes; and
c. deletion of fiduciary guarantee.
(2) The Electronic Warranty Registry is electronically as referred to in paragraph (1) charges in accordance with the provisions of the laws.
Article 3
Fidusia Guarantee Registration Electronically As Intended in Section 2 can be performed through the Fidusia Guarantee Registration service kiosk throughout the fidusia registration office.
Section 4
The provisions regarding the manner of the Electronic Warranty Registration System as electronically as referred to in Article 2 are set forth in the Ministerial Regulation.
Section 5
The Regulation of the Minister is beginning to apply at the designated date.
