ABOUT
ASSIGNMENT (MEDEBEWIN) PART OF THE 2013 FORESTRY FIELD GOVERNMENT AFFAIRS TO THE BERAU BUPATI, BUPATI MALINAU, AND BUPATI KAPUAS HULU IN ORDER DEMONSTRATION ACTIVITIES REDD

MINISTER OF FORESTRY REPUBLIC OF INDONESIA,


Weigh: a.  that in order to increase the effectiveness of the implementation of government affairs in the field of forestry, there are several governance matters in the field of forestry assigned to the Regent;
B.  that as a follow up of Article 39 paragraph (5) of the Government Regulation No. 7 of 2008, the assignment of part of government affairs of the Government to the Regent is set with the Regulation of the Minister;
c. that in regard to the above, the Assignment of the partial affairs of the Government in the Field of Forestry to 3 (three) of the Bupati needs to be established with the Ordinance of the Minister of Forestry.

SET: THE FORESTRY MINISTER ' S REGULATION ON ASSIGNMENT (MEDEBEWIN) PART OF THE 2013 FORESTRY GOVERNMENT AFFAIRS TO THE BERAU BUPATI, BUPATI MALINAU, AND BUPATI KAPUAS HULU IN ORDER DEMONSTRATION ACTIVITIES REDD.

BAB I
UNDERSTANDING

Section 1

In Regulation of this Minister, referred to by:
1. Government (Centre) later called Government, is the President of the Republic of Indonesia which holds the power of government of the Republic of Indonesia as referred to in the Basic Law of the Republic of Indonesia in 1945.
2. The Regional Device Working Unit, subsequently called the SKPD, is the organization/institution on the local government responsible for the execution of government duties in certain areas of provincial, county, or city areas.
3. Host duty is the assignment of the Government to the area and/or village, from the provincial government to the district, or the city and/or village, as well as from the county government, or the city to the village to carry out specific tasks with The obligation is to be made available to the Cloud Service, and to be responsible for the service.
4. The Host Task Fund is a fund derived from the APBN executed by the area and the village that includes all the receipts and expenses in order to perform the duties of the host.
5. Forest is an ecosystem union of land expanses containing a predominantly tree-dominated natural resource in its environmental alliance, the one with the other inseparable.
6. State forests are forests that are on unburdened land rights to the land.
7. Minister is the responsible minister in the field of forestry.

BAB II
INTENT AND PURPOSE

Section 2

(1) The intent of hosting duties is to increase the efficiency and effectiveness of governance, development management, and the general service of the governance affairs of the forestry field.
(2) The purpose of hosting duties is to streamline the execution of tasks and resolve issues, and to assist with the administration, and development of the development of government affairs in the field of forestry for the County.

HOSTING TASK OF THE EVENT
The First Part
The Host Task Type

Section 3

(1) The Minister assigned a portion of government affairs in the field of forestry to the Regent Berau, the Regent Malinau and the Regent of the Upper Kapuas.
(2) The details of government affairs in the field of forestry assigned to all three buches as referred to in verse (1), are listed in the Annex of this Minister's Ordinance.
(3) The affairs of government in the field of forestry assigned to the Bupati in verse (1) should not be devolve to the chief of the village.

Second Part
Execution of the Host Task

Section 4

(1) The Regent defines the working unit of the county area device that handles the affairs of the governing body of forestry as the executor of the devolve field government affairs as referred to in Article 3.

(5) The implementation of government affairs assigned to the Bupati as referred to in Article 3, financed from the budget section of the Ministry of Forestry in 2013.

BAB IV
REPORTING OF THE MASTER ' S TASK

Section 5

(4) The accountability aspect consists of the budget realization report, the balance sheet, the notes on the financial statements, and the goods report.

BAB V
COACHING AND SUPERVISION

Section 6

(1) Technical coaching on the implementation of the administrative affairs of the field of forestry assigned as referred to in section 3 is exercised by the Secretary General of the Ministry of Forestry.
(2) Coaching as referred to in paragraph (1) includes guideline, facilitation, training, technical guidance, monitoring, and evaluation.
(3) Functional supervision over the implementation of the field of forestry affairs assigned as referred to in section 3 and review of the financial statements of the duties of the master's duties, is exercised by the Inspectorate General of the Ministry of Forestry.
(4) The Minister may withdraw the assigned forestry field governance affairs, if:
a. The Minister changed the policy; and/or
B. The regent for the governance of the field of forestry assigned as referred to in Article 3 does not conform to the norms, standards, procedures and criteria established by the Minister.
(5) Rewithdrawal of the affairs of the governing field of forestry as referred to in paragraph (4), is set with the Regulation of the Minister.

BAB VI
THE SANCTION

Section 7

(1) a county-area device working unit as referred to in Section 4 of the paragraph (1) of the Licensee's purposefully or negligently not to present the account of the responsibility of the conduct of the funds referred to to the Minister of the Union. (3) The delay of the thawing and/or termination of the funding allocation as referred to in Article 7 of the paragraph (1) is set forth by the Minister after consulting with the Minister of Finance.
(4) The introduction of the delay of the thawing of the thawing does not free the county area device's work unit from the obligation to submit a report of the duties of the host.
(5) The payment outage in the running year can be done if:
a. The area of the field device does not deliver the three monthly financial statements to the Minister in a row 2 (two) times in the year of the running budget; and/or
b. Found irregularities from the results of the examination of the Financial Examiner Agency, the Financial Supervising Board and the Development, Inspectorate General of the Ministry of Forestry, Inspectorate General of the Ministry of the Interior or Regional Inspectorate.
(6) The Minister assigns the termination decision of the payment as referred to in paragraph (4), after coordinating with the Minister of Finance.

BAB VII
CLOSING PROVISIONS

Section 8

The rules of this Minister begin to apply on the date of promulgations.
