REGULATION OF THE TRADE MINISTER OF THE REPUBLIC OF INDONESIA
NUMBER 23/M-DAG/PER/5/2013
ABOUT
THE SOY PRICE STABILIZATION PROGRAM

WITH THE GRACE OF THE ALMIGHTY GOD

TRADE MINISTER OF THE REPUBLIC OF INDONESIA,

Weigh: a.   that in order to stabilise the price of soybeans at the farmers ' level and the stabilization of the soybean prices at the craftsmen's level of tofu/tempe, need to set up a soybean price stabilization program;
B.  that based on the consideration as intended on the letter a, it needs to establish the Trade Minister ' s Regulation on the Soybean Price Stabilization Program;

Given: 1. Bedrijfsreglementerings Ordonnantie 1934 (Staatsblad Of 1938 Number 86);
2. Law No. 7 Year 1994 on Enactment Of The Agreement Establishing The World Trade Organization (The Agreement For The Establishment Of The World Trade Organization), (sheet Of State Of The Republic Of Indonesia In 1994 Number 57, Additional Gazette Of The Republic Of State Indonesia Number 3564);
3. Act No. 19 of 2003 on the State Governing Body (Indonesian Republic of Indonesia Year 2003 Number 70, Additional Gazette of the Republic of Indonesia Number 4286);

11. 2013 Presidential Decree No. 32 of 2013 on Assignment To The Public Company BULOG for the Secure and Soybean Distribution;
Twelve. Regulation of Trade Minister Number 31/M-M-DAG/PER/7/2010 on the Organization and Workforce of the Ministry of Commerce as amended with the Regulation of Trade Minister Number 57/M-DAG/PER/8/2012;

DECIDED:

Set: A TRADE MINISTER ' S REGULATION ON SOY PRICE STABILIZATION PROGRAMS.

Article 1
In Regulation of this Minister referred to:
1. Soy is the result of a soybean crop (Glycine max. The Merr) is a yellow dried seed that has been removed from the skin of the pods and cleared that is included in the Tarif/HS Post classification of 1201.90.00.00.
2. The next soybean price stabilization program called the SHK Program is a purchase arrangement of soybeans from farmers, soybean imports, and the sale of Soy to know/tempe craftsmen.
3. The diligent know/tempe is a group of people who do the activities of the processing of soybeans to know/tempe that is wadahi in an organization.
4. The subsequent purchase price of the Farmer soybeans called HBP Soybeans is the price of reference of the purchase of Soybeans at the farmers ' level in the SHK Programme.
5. The sale price of soybeans at the know/tempe Level next called HJP Soybeans is the price of reference of the sale of Soybeans to the know/tempe in the SHK Program.
6. The next soybean Price Stabilization team called Team SHK is a team formed by the Minister and tasked with providing recommendations for national soybean needs and the designation of HBP and HJP magnituses.
7. The next General Corporate Logistics Agency called Public Enterprise BULOG is the State-owned Business Agency, in which the entire capital is a State of Wealth which is separated and is not divided into stocks.
8. The Minister is the minister who organizes government affairs in the field of commerce.

Article 2

(1) Soybean price stabilization is done by regulating:
a. Soybean purchase from a farm group, a joint farm group or cooperative farmer with a certain amount of price, amount, and time as well as in the territory specified;
B. Soybean imports; and
c. The sale of Soybeans to artisans knows/tempe at a given price, amount, and time as well as at the designated location.
(2) Execution Of Soy price stabilization as referred to in paragraph (1) can only be done by the General Enterprise BULOG, the cooperative and/or private sector that is involved in the SHK Program.
(3) General Enterprise BULOG, cooperatives and/or private companies that participate in the SHK Program must sign a waiver to participate in the SHK Program in a format as set forth in this Minister's Regulation appendix.

Article 3

(1) Soy Purchases are obtained from domestic production or via import.
(2) General Enterprise BULOG, cooperatives and/or private companies are purchasing the domestic production soybeans from the farm group, a joint agricultural group or cooperative of farmers per region especially during the harvest of the soybeans.
(3) The harvest period of the soybean as referred to in paragraph (2) is set by the Minister of Agriculture.
(4) Soybeans purchased from domestic production as referred to in paragraph (2) must meet the quality of the consumption of soybean consumption according to SNI 01-3922-1995, as follows:
a. water level is at most 14% (fourteen percent);
B. items most share at most 3% (three percent);
c. the broken items are at most 3% (three percent);
D. other color items at most 5% (five percent);
e. The muck is at most 2% (two percent); and
f. The wrinkles are at most 3% (three percent).

Section 4

(1) Soybean purchase plan of a farm group, a joint agricultural group or cooperative farmer per region by the General Enterprise BULOG, cooperative and/or private especially in the time of the harvest as referred to in Article 3 of the paragraph (2) is based on the soybean availability data proposed by the Minister of Agriculture.
(2) The proposal as referred to in paragraph (1) is delivered in writing to the Minister through the Chairman of Team SHK at least 30 (thirty) working days prior to the beginning of the procurement period especially on the next soybean harvest for It's on the SHK team.
(3) The results of the discussion of the proposal as referred to in paragraph (2) are arranged in the form of a recommendation and delivered to the Minister.

Section 5

(1) Soybeans imported by the Public Company BULOG, cooperative and/or private in SHK Program are set by the Minister with regard to the national soybean needs recommended by the SHK Team and have been decided in the Meeting Limited coordination of the level of Minister of Economic Affairs.
(2) General Enterprise BULOG, cooperative and/or private in conducting soybean imports as referred to paragraph (1) is required to meet the provisions of Soybean Imports.
(3) The provisions of the import of Soybeans are regulated in their own terms with the Minister's

Section 6

(1) The soybean sales plan by the General Enterprise BULOG, cooperative and/or private to the know/tempe is based on the needs of the soybeans proposed by the Minister The industry is on the recommendation of Minister Koperative and UKM.
(2) The proposal as referred to in paragraph (1) is delivered in writing to the Minister through the Chairman of Team SHK the slowest 10 (ten) business days prior to the expiration date of HJP Soybeans to be discussed in the SHK Team.
(3) The results of the discussion of the proposal as referred to in paragraph (2) are arranged in the form of a recommendation and delivered to the Minister.

Section 7

Common enterprises BULOG, cooperative and/or private sector can undertake partnerships in the implementation of the domestic production of soybean purchase activities of the farm group, joint farm group or cooperative of farmers and the sale of Soybeans to the diligent know /tempe.

Section 8

(1) The Minister with regard to Team SHK ' s recommendation, setting out:
a. Soybeans purchased from a farm group, a combined farm group or a farmer ' s cooperative by the Public Company BULOG, cooperative and/or private in SHK Programme;
B. Soybeans sold to the know/tempe by the Public Company BULOG, cooperative and/or private in SHK Programme; and
C. HBP and HJP Soybeans periodically.
(2) The Minister delegates the authoring authority as referred to paragraph (1) to the Director General of the Home Trade.

Section 9

Common enterprises BULOG, cooperative, and/or private companies that participate in the SHK Program are required to purchase the domestic production soybeans from the farm group, joint farm group or cooperative farmers and the sale of Soya to the know/tempe as referred to in Section 2 of the paragraph (1) the letter a and the letter c.

Article 10

HBP Soybean as referred to in Article 8 of paragraph (1) the letter c is specified by considering the magnitude of the cost of the soybean farm, the inflation rate in the country, and the benefit of the farmer.

Section 11

HJP Soybean as referred to in Article 8 of paragraph (1) the letter c is specified by considering HBP Soybeans, and the average international daily price of Soybeans during a particular period of the world's main exchange.

Article 12
To guarantee the execution of the SHK Program on a precise, precise amount and timely, the SHK team performs regularly monitoring and evaluation every 3 (three) months.

Section 13
(1) General Enterprise BULOG, cooperative and/or private sector that is participating in the mandatory SHK Program deliver:
a. Soybean purchase monthly report; and
B. Soy sales monthly report.
(2) The report as referred to in paragraph (1), delivered to the Minister by busan to the Chairman of the SHK Team at the latest of the following 10 months.

Section 14
(1) General Enterprise BULOG, cooperative and/or private sector which violates the provisions as referred to in Article 5 of the paragraph (2) and Section 9 are subject to administrative sanction of the SHK Program.
(2) General Enterprise BULOG, cooperative and/or private sector which violates the provisions as referred to in Section 13 is imposed on administrative sanction:
a. Three (3) consecutive written alerts with two (two) weeks from the date of the warning letter; and
B. Public companies BULOG, cooperative and/or private companies that do not comply with the written warning provision as referred to in the letter a, are sanctioned by the termination of the SHK Program.
(3) administrative sanction as referred to in paragraph (1) and paragraph (2) is set by the Director General of the Internal Trade for and on behalf of the Minister.

Section 15

Exception of the provisions set out in the Regulation of this Minister must with the approval of the Minister by considering the proposal of the related technical minister.
Article 16

The rules of this Minister begin to apply on the date of promulgations. In order for everyone to know, ordered the invitational of the Minister's Ordinance with its placement in the News of the Republic of Indonesia.
