REGULATION of the MINISTER of TRADE of the REPUBLIC of INDONESIA NUMBER 23/M-DAG/PER/5/2013 SOYBEAN PRICE STABILIZATION PROGRAM with the GRACE of GOD ALMIGHTY the SECRETARY of COMMERCE of the REPUBLIC of INDONESIA, Considering: a. that price stabilization in order to buy soybeans at the level of farmers and soybean price stabilization at the level of craftsman know/tempe simultaneously, the need to draw up a program of the soy price stabilization;
b. that based on considerations as referred to in letter a, the need to set a regulation of the Minister of trade of Soybean Price Stabilization Program;

Decide: define: TRADE MINISTER REGULATION ABOUT SOY PRICE STABILIZATION PROGRAM.
Article 1 In this ministerial regulation is: 1. Soybeans are crops of soybeans (Glycine max. Merr) is the dried yellow beans have been released from the skin and cleaned pods that are included in the tariff classification Heading/HS 1201.90.00.00.
2. Soya Price Stabilization Program hereinafter SHK is setting Program purchases of soybeans from farmers, imports of soybeans, and Soybean sales to craftsmen know/tempe.
3. Craftsmen know/tempe is a group of people who conduct business activity processing of Soybeans into tofu/tempeh in an organization undertakes.
4. The purchase price of Soy Farmers are hereinafter referred to as underlying price HBP soy is the purchase of Soybeans at the level of farmers in SHK.
5. Sales prices at the level of Craftsman know Soy/tempeh Soy HJP is hereinafter referred to as underlying sales price of soybeans to Craftsmen know/tempe in SHK.
6. Price Stabilization Team soy hereafter SHK Team is a team that is formed by the Minister and give you the national Soybean needs recommendations and the determination of the magnitude of HBP and HJP.
7. Public Enterprise the State Logistics Company BULOG General hereinafter referred to is the State-owned enterprises, where the entire State-owned capital in the form of the wealth of the country that are separated and are not divided into shares.
8. the Minister is the Minister of the organizing Affairs of the Government in the field of trade.
Article 2 (1) of the soy price Stabilization is done by setting the: a. the purchase of Soybeans from farmers group, a combined group of farmers or farmers ' cooperatives with the price, quantity, and time as well as in specific areas designated; b. import Soybeans; and c. the sale of Soybeans to craftsmen know/tempe with the price, quantity, and the specific time and location set.
(2) the implementation of the stabilization of the price of Soybeans as referred to in paragraph (1) may only be carried out by the Public Company BULOG, cooperatives and/or private that participated in the Program of SHK.
(3) Public Company BULOG, cooperatives and/or private sector took part in the Program must sign an affidavit of SHK participated in the Program with SHK format as contained in the annex to this regulation of the Minister.
Article 3 (1) the purchase of Soybeans available from domestic production or by imports.
(2) Public Company BULOG, cooperatives and/or private purchase of domestic production of Soybeans from farmers group, a combined group of farmers or cooperatives of farmers per region especially during harvest of Kingdom of soy.
(3) the soy harvest Kingdom as mentioned on paragraph (2) is designated by the Minister of agriculture.
(4) the soy is purchased from domestic production as referred to in subsection (2) must meet the quality standards appropriate consumption of Soy SNI 01-3922-1995, as follows: a. water levels at most 14% (Fourteen percent);

b. side the grain at most 3% (three percent);

c. broken grains at most 3% (three percent);

d. grain other colors at most 5% (five per cent);

e. dirt at most 2% (two percent); and f. wrinkled grains at most 3% (three percent).
Article 4 (1) of the plan the purchase of Soybeans from farmers group, a combined group of farmers or cooperatives of farmers per region by Public Company BULOG, cooperatives and/or private sector especially in the time of harvest of Kingdom referred to in article 3 paragraph (2) is based on data the availability of Soybeans that are proposed by the Minister of agriculture.
(2) the proposal referred to in subsection (1) is communicated in writing to the Minister through the Chairman of SHK Team no later than thirty (30) working days before the beginning of the procurement period mainly on mast next to soybeans discussed in SHK Team.
(3) the results of the discussions of the proposals referred to in paragraph (2) was compiled in the form of recommendations and submitted to the Minister.
Article 5 (1) of soybeans imported by BULOG public companies, cooperatives and/or private in SHK Program established by the Minister of national Soybean needs by observing recommended by SHK and Teams have been decided in the meeting of Coordinating Limited Ministerial economics.
(2) Public Company BULOG, cooperatives and/or private conduct soybean imports as referred to in subsection (1) is obligated to comply with the import of soybeans.
(3) Provisions regarding the import of soybeans are set individually with the regulation of the Minister.
Article 6 (1) plans for the sale of soybeans by Public Company BULOG, cooperatives and/or private to Craftsmen know/tempe based on Soy needs proposed by industry Minister on the recommendation of the Minister of cooperatives and SMEs.
(2) the proposal referred to in subsection (1) is communicated in writing to the Minister through the Chairman of SHK Team no later than 10 (ten) working days before the date of expiry of validity period of soy to HJP discussed in SHK Team.
(3) the results of the discussions of the proposals referred to in paragraph (2) was compiled in the form of recommendations and submitted to the Minister.
Article 7 Public Company BULOG, cooperatives and/or private enterprise can do a partnership in the implementation of the activities of the purchase of domestic production of soybeans from farmers group, a combined group of farmers or cooperatives of farmers and Soybean sales to Craftsmen know/tempe.

Article 8 (1) the Minister having regard to the recommendation of the team of SHK, assigning: a. Soy is purchased from the farmers group, the combined group of farmers or farmers ' cooperatives by Public Company BULOG, cooperatives and/or private in SHK Program;
b. Soybeans sold to Craftsmen know/tempe by Public Company BULOG, cooperatives and/or private in SHK Program; and c. the HBP and HJP Soy periodically.
(2) the Minister's delegate authority determination referred to in subsection (1) to the Director General of domestic trade.
Article 9 Public Company BULOG, cooperative, private and/or participated in a Program of compulsory purchase SHK Soy production in the country of the farmers group, the combined group of farmers or cooperatives of farmers and Soybean sales to Craftsmen know/tempe referred to in article 2 paragraph (1) letter a and the letter c.

Soy HBP article 10 referred to in article 8 paragraph (2) Letter c is defined by considering the magnitude of the cost of Soybean farmer, the inflation rate in the country, and the benefit of the farmers.

Article 11 HJP Soy as stipulated in article 8 paragraph (2) Letter c is defined by considering the HBP soy, and the average daily international prices of soybeans during a certain period of the world's major exchanges.

Article 12 to ensure the implementation of the programme of SHK appropriately targeted, precise amounts and on time, the team of SHK do monitoring and evaluation on a regular basis every three (3) months.

Article 13 (1) Public Company BULOG, cooperatives and/or private, who participated in the Program mandatory SHK delivered the monthly report: a. purchase of Soybeans; and b. a monthly report of sales of soy.

(2) the report referred to in subsection (1), submitted to the Minister with a copy to the head of the team of SHK least every 10th of the next month.
Article 14 (1) Public Company BULOG, cooperatives and/or private in violation of the provisions referred to in article 5 paragraph (2) and article 9 administrative penalties in the form of dismissal of the SHK.
(2) Public Company BULOG, cooperatives and/or private in violation of the provisions referred to in Article 13 of the administrative penalties in the form of: a. a written warning at most three (3) consecutive times with grace period 2 (two) weeks from the date a warning letter; and b. Public Company BULOG, cooperatives and/or private entities that do not meet the provisions of a written warning as referred to in letter a, penalized in the form of dismissal of the SHK.
(3) administrative Sanctions as referred to in paragraph (1) and paragraph (2) are defined by the Director General of domestic trade for and on behalf of the Minister.
Article 15 exclusion of provisions set forth in the regulations of the Minister must be in agreement with the Minister taking into account the proposal of the Minister of technical related.
Article 16 this Ministerial Regulation comes into force on the date of promulgation. In order to make everyone aware of it, ordered the enactment of this Ministerial Regulation with its placement in the news of the Republic of Indonesia.
