ABOUT
THE LICENSING TERMS OF THE TRADE IN THE FREE TRADE AREA AND THE SABANG FREE PORT

WITH THE GRACE OF THE ALMIGHTY GOD

TRADE MINISTER OF THE REPUBLIC OF INDONESIA,

Weighing: that in order to carry out the provisions of Article 8 paragraph (1) Government Regulation No. 83 of 2010 on the Devolution Of Government Authority To The Sabang District Council, need to establish a Trade Minister Regulation on The provisions of the issuer of Trade in the Free Trade Area and the Sabang-Free Port;

21. The Regulation of Trade Minister Number 60/M-DAG/PER/12/2010 on the issuance of the issuer of Origin Letter (Certificate Of Origin) For Indonesian Export Goods as amended by the Regulation of Trade Minister Number 21/M-DAG/PER/4/2012;
22. Policy of Trade Minister Number 27/M-DAG/PER/5/2012 on the Terms of Importer Identifier (API) Terms as amended by the Trade Minister Regulation Number 59/M-DAG/PER/9/2012;

DECIDED:

Set: A Trade Minister ' s Regulation On The Terms Of Licensing The Publishing Of Commerce In The Free Trade Area And The Free Port Of Sabang.

Article 1
In this Minister ' s Rule, which is referred to:
1. Free Trade Area and Sabang Free Port, which is next called Sabang Region, is the Region that includes Sabang City (Weh Island, Klah Island, Rubiah Island, Seulako Island, and Rondo Island), and parts of Aceh Besar (Island). Breuh, Rice Island, and Teunom Island) as well as the surrounding small islands located within the boundaries of the coordinates as attached in Law Number 37 of the Year 2000 on Establishing Government Regulation Replacement Rule Number 2 Year 2000 on the Free Trade Area and the Sabang Free Port to Act.
2. Licensing in the field of trade that is next called Perizinan is the granting of legality to the applicant in the form of permits, registration, approval or captions in the field of commerce in the Sabang Region.
3. The Foreign Trade Company Representative ' s License is a license to carry out the activities of the Foreign Trade Company Representative.
4. Registration Sign Letter is a sign of proof that the company in question has been registered as an Agent, a Single Agent, Sub Agent, Distributor, a Single Distributor or a Sub Distributor of goods and/or services.
5. Direct Sales Business License is a license to be able to carry out trading venture activities with a direct sales system.
6. The IBM International Business Partner Agreement for Business and/or IBM Business Partner Agreement-International Business Partner Agreement-International Business Services
7. The Alcoholic Beverage Trade Permit is a permit to be able to carry out the activities of special trading efforts of the alcoholic beverage group B and/or group C.
8. The Dangerous Materials Trade Permit is a license to be able to carry out the activities of the Special Materials trading business.
9. Importer Identifier is an importer as an importer.
10.Mail of Origin (Certificate of Origin) is a document included on the time the Indonesian export goods that have met the provisions of the origin of the goods (Rules of Origin) entering a specific country region that proves that The goods are from Indonesia.
11. The Sabang Region Council, which is next abbreviated to DKS, is the Council of Free Trade Areas and the Sabang Free Port.
Twelve. The Free Trade Area Company and the Sabang Free Port, which is next called the Sabang Area Board of Enterprise or BPKS, is the Board of Managed Services and Development of the Free Trade Area and the Sabang Free Port.
13.Chairperson DKS is the Chairman of the Board of Free Trade Area and Sabang Free Port.
14. The Head of BPKS is the Head of the Board of Management and Development of the Free Trade Area and the Sabang Free Port.
15.Ministers is the minister who organizes government affairs in the field of commerce.

Article 2
The authorization to publish a devolve Perizinan to the DKS includes the authority to publish:
a. Foreign Trade Company Representative Permission Letter (SIUP3A);
b. The Agent Registration Letter or the Distributor of the Goods and/or services of any domestic or overseas production;
c. Direct Sales Business Permit (SIUPL);
d. Survey Services Business License (SIUJS);
e. License of the Alcoholic Beverage Trade Permit (SIUPMB) for Importers;
f. An Alcoholic Beverage Trade Business Permit (SIUPMB) for Distributor;
(g) The Alcoholic Beverage Trade Business Permit (SIUPMB) for Sub Distributor;
h. Hazardous Materials Trade Permit (SIUPB2) For Distributor Listed Hazardous Materials (DT-B2);
I, the International Trade Fair, Convention, and Trade Seminar Agreement; and
j. A Single External User Registration Letter Letter of the Production of Foreign Production;
k. The Import Identical Number (API); and
I. Letter of Origin (SKA).

Article 3
BPKS carries out the authority to publish Perizinan as referred to in Article 2 with guidelines on the Policy, Norma, Standards, and Procedures prescribed by the Minister as set forth in this Minister's Regulation Attachment.

Section 4
Perizinan as referred to in Article 2 is given to the established and domiciled company in the Sabang Region.

Section 5
Companies that have the Licensing as referred to in Article 2 of the letters a up to the letter j can only run venture activities in the Sabang Region.

Section 6
(1) To obtain Perizinan as referred to in Section 2, the Company must submit a new application, the extension and replacement of Perizinan in writing to the Chief of BPKS.
(2) BPKS chief publishes the slowest Perizinan 5 (five) days of work since the acceptance of the application is complete and correct.
(3) Further provisions regarding the requirements and grammar of the Licensing issuer are set forth by the Chairman of the DKS after coordinating with the Minister of Commerce in this case the Director General of the Internal Trade and the Director General Foreign Trade.

Section 7
(1) Unless the implementation of SKA publishing, the implementation of the issuer ' s issuer in DKS as referred to in Section 2 is not subject to any cost in any form.
(2) The implementation of the SKA publishing as referred to in Article 2 of the letter l is charged with Rp. 5,000,-(five thousand Rupiah) and is tuned into the treasury of the state into the State Revenue Not Tax of the Ministry of Commerce.

Section 8
(1) the Minister does coaching to:
a. BPKS in order to support the ability in the implementation of the Perizinan issuer; and
B. The provincial government of Aceh, Sabang City, and Aceh Besar Regency and DKS in order to hold government affairs in the trade area.
(2) Coaching as referred to in paragraph (1) is performed in the form of coordination, mentoring, consulting, monitoring and evaluation.

Section 9
(1) The supervision of the implementation of the Regulation of the Minister is conducted by the Inspectorate General of the Ministry of Commerce.
(2) Surveillance as referred to in paragraph (1) includes execution:
a. publishing of Perizinan;
B. transparency about the requirements and grammar of Perizinan;
c. Licensing time of Perizinan; and
D. Perizinan publishing reporting.
(3) The results of the supervision as referred to in paragraph (2) are reported by the Inspector General to the Minister for use as an evaluation material for the implementation of this Minister Regulation.

Article 10
(1) Head of BPKS through Chairman of the DKS must deliver the issuing report of Perizinan to the Minister with a gust of Director General of the Interior Trade, Director General of Foreign Trade, Inspector General of the Ministry Trade, and the Head of the Service who were trading in the Aceh Province trade.
(2) The report as referred to in paragraph (1), is delivered every 1 (one) year at the most slow date of 31 January of the following year.

Section 11
(1) Licensing which has been given to the company domiciled in the Sabang Region before the enactment of the Regulation of this Minister, is stated to remain in effect until the expiring term is expired.
(2) Licensing as referred to in paragraph (1) that has expired may be extended or re-listed by referring to the provisions in this Minister's Regulation.

Article 12
A licensing request filed by the established and domiciled company in the Sabang Region and is in the process of a settlement must follow the provisions in this Minister ' s Regulation.

Section 13
The rules of this Minister come into force after 60 (sixty) days from the date set.
