RULES MINISTER OF THE REPUBLIC OF INDONESIA RELATIONS
No. 57 YEAR 2013
ABOUT
HOSTING OF GENERAL SERVICE OBLIGATIONS FIELD
TRANSPORT OF THE SEA FOR ECONOMY CLASS PASSENGERS
THE 2013 BUDGET YEAR

WITH THE GRACE OF THE ALMIGHTY GOD

MINISTER OF RELIGION, REPUBLIC OF INDONESIA,

Weigh: a.  That in order to guarantee the continuity of the service of the passenger-class transport of the economy to the whole of the waterways at the rate prescribed by the Government, then there needs to be an assignment to the transport services provider. organizes a public service obligation/Public Service Obligation (PSO);
B. that in accordance with Act No. 19 of 2003 on the State-Owed Business Agency, the Government may provide special assignment to the State-Owed Business Agency to organize a general benefit function;
c. that under the consideration of such matters above, it needs to establish the Regulation of the Minister of Transportation on the Governing Obligations of the General Services of the Marine Transport for Economic Class of the Year of the Budget 2013;

DECIDED:

Setting: REGULATION OF THE MINISTER OF RELATIONS ON THE HOLDING OF THE GENERAL SERVICE OBLIGATIONS OF THE FIELD OF SEA TRANSPORT FOR ECONOMIC CLASS PASSENGERS OF THE 2013 BUDGET YEAR.

Article 1
In this Regulation referred to:
1. The general service obligations of the marine transport field for economic class passengers is a general service obligation of the field of sea transport for economic class passengers as arranged by the Minister of Transportation in accordance with the provisions of the regulations (The laws of the United States), whose management is assigned to Indonesian National Voyage (Persero) is now a Perseroan Company (Persero) The PT. Indonesian National Voyage as executor of the public service/Public Service Obligation (PSO).
2. Marine Transport Organiser is a Perseroan Company (Persero) The PT. The Indonesian National Voyage, which is commissioned by the Minister to organize a general service obligation of the passenger field of the economy class and has met certain specified requirements.
3. Compensation is the Government's obligation to finance the hosting of public service obligations/Public Service Obligation (PSO) The large field of passenger sea transport is the difference between the cost of the public service. the production and tariffs specified by the Government and/or the Local Government as a public service obligation.
4. The principal cost of public service liability sales/Public Service Obligation (PSO) passenger transport of the domestic overseas transport economy is all costs that are supposed to be charged for the holding of public services Passenger transport economy class in the country plus profit and income tax for each trip/voyage.
5. The Minister is the Minister of Transportation.
6. Director General is Director General of Marine Relations.

Article 2
(1) General service (s) Public Service Obligation (PSO) the field of sea transport for economic class passengers is organised by the Government whose implementation is assigned to the Organizing Sea Transport.
(2) The public service obligation/Public Service Obligation (PSO) of the field of transport of the economy class as referred to in paragraph (1), is required to meet the principles.
(3) Safety and security as follows:
a. Carry out an economic-class transport cruise to the entire country of water based on the tariffs set by the Minister and subject to the subject specified by the Director General;
B. providing the treatment and service for all service users according to the standards of service set by the Director General;
c. keep the passengers.

Article 3
(1) The execution of the assignment by the Host of the Sea Transport as referred to in Section 2 of the paragraph (1), given the compensation by the Government;
(2) Compensation as referred to in paragraph (1), given for the implementation of the general services obligations of the passenger field of the economy class/ Public Service Obligation (PSO) throughout the Year of Budget 2012, accounting for date January 1, 2013 to December 31, 2013;
(3) Compensation as referred to in paragraph (1) is allocated to the State Budget Office of the Year of Budget 2013 including its changes.

Section 4
(1) The Director General makes the Work Agreement with the Principal Director of the Perseroan Company (Persero) The PT. Indonesian National Voyage based on DIPA which has been authorized by the Director General of the Treasury.
(2) The Job Agreement as referred to in paragraph (1) is signed by the Director General with the Principal Director of Perseroan (Persero) The PT. Indonesian National Voyage.
(3) The Job Agreement as referred to in paragraph (2), contains at least:
a. The parties to the agreement;
B. The job principal is promised with a clear description;
c. The rights and obligations of the parties associated in the agreement;
D. value or contract agreement, as well as payment terms;
e. Clear and detailed technical requirements and specifications;
f.   the provisions of the injury of promise and sanctions in terms of the parties do not fulfill its obligations; and
G. Dispute resolution.

Section 5
A designated Marine Transport organizer ' s obligation to carry out the general service/Public Service Obligation (PSO) the field of marine transport for economy class passengers is obligated to meet the requirements as follows:
a. Has a regular, fixed-scheduled, fixed-schedule Marine Indoor Sea Freight Network (liner);
B. meets standards in the delivery of services to passengers; and
c. provide ticket service at all branch offices.

Section 6
In carrying out a public service obligation/Public Service Obligation (PSO) the area of the passenger marine transport economy the Director General is entitled to:
a.   set the traject network;
B.   set the range, cruise frequency and service standard;
c. perform monitoring, analysis and evaluation, and verification of the implementation of the general service obligations of the marine transport field for economic class passengers on a regular basis and at any time required;
D. get a monthly report on the hosting of public service obligations of the marine transport field for economic class passengers;
e.   providing sanctions in the event of hosting does not meet the provisions of the agreement.
Section 7
In carrying out a general service obligation/Public Service Obligation (PSO) the area of passenger marine transport of the Sea Transport Organizing economy is obliged:
a.   receive an assignment through the Work Agreement signed by the Marine Transport Organizer and Director General;
B.   comply with the Work Agreement;
c. create and deliver the report of the implementation of the general service obligations of the field of marine transport every month and at any time required to the Director General.

Section 8
Surveillance and control in the implementation of public service obligations/Public Service Obligation (PSO), the field of passenger marine transport of the economy class was carried out by the Director General and reported to the Minister.

Section 9
(1) In order for the budgeting of the budget of the holding of public services of the passenger marine transport field of the economy class, the Director General conducts verification of the hosting of public service obligations/Public Service Obiligation (PSO) field of passenger marine transport of the economy class.
(2) Verification as referred to in paragraph (1), executed by the Team formed by the Director General.

(5) The results of the verification as referred to in paragraph (1), signed by the Verified Team as a verified and delivered marine transport organizer, are presented to the Committer Commitment Officer.
(6) The results of the verification as referred to in paragraph (1) are poured in the News of the Verification Event and signed by the Commitment Officer as the party who verifies and the Principal Director of the sea transport as a The verified one.
(7) The news of the Verification Event as referred to in paragraph (5) is only administrative and does not release sea transport organizers to be audited by the authorities in accordance with regulatory provisions. It's

Article 10

Section 11

Article 12
(1) Naval Host Board of Directors delivers a report on the responsibility of the use of the public service duties of the public service/Public Service Obligation (PSO) of the passenger marine transport field of the economy class to the Director General in accordance with the provisions of the laws.
(2) The Director General as referred to in paragraph (1), organizes accounting and reporting in accordance with the provisions of the laws.
(3) Based on the report as referred to in paragraph (1), the Director General delivers a report on the responsibility of the use of funds to the Minister of Finance c.q. Director General of the Budget through the Secretary General of the Ministry Relationships in accordance with the provisions of the laws.

Section 13
(1) The use of the funds as referred to in Article 11, in audits by an auditor authorized in accordance with the provisions of the laws.
(2) The results of the audit results as referred to in paragraph (1) are delivered to the Budget User Power and the Director General of the Budget.
(3) The Auditor as referred to in paragraph (1) is the instance that authorities conduct audits in accordance with the provisions of the laws.

Section 14
(1) In the event there is less difference between the amount of funds holding the public service obligation/Public Service Obligation (PSO) the area of the passenger sea transport of the economy that has been paid to the organizers Sea transport with audit results as referred to in Article 13 paragraph (2) at one budget year, the lack of such payment cannot be charged to the country.
