THE ADDITION OF THE INCLUSION OF THE REPUBLIC OF INDONESIA CAPITAL
INTO THE COMPANY ' S SHARE CAPITAL PERSEROAN (PERSERO)
PT ASDP INDONESIA FERRY
BY THE GRACE OF THE ALMIGHTY GOD
PRESIDENT OF THE REPUBLIC OF INDONESIA,
Building :a.that to improve the structure of the Perseroan Company (Persero) PT ASDP Indonesia Ferry, it needs to make an increase in the inclusion of capital of the Republic of Indonesia into the stock capital of Perseroan Company (Persero) PT ASDP Indonesia Ferry originating from the transfer of State-owned Goods to the Ministry of Transportation, which is based on the Budget and Shopping Budget of the State of the Year 2005, 2006, 2007, 2008, 2009, 2010, and 2011;
b.that under consideration as intended in the letter a and to carry out the provisions of Article 4 paragraph (4) of the Law No. 19 Year 2003 on the State-Owed Business Agency, it needs to establish the Government Regulation on the Addition of the Inclusion State Capital of the Republic of Indonesia into the Modal Stock Company Perseroan (Persero) PT ASDP Indonesia Ferry;
Reminded :1.Article 5 of the paragraph (2) of the Basic Law of the Republic of Indonesia Year of 1945;
2.Law No. 19 of 2003 on the State Governing Body (Indonesian Republic of Indonesia Year 2003 Number 70, Additional Gazette of the Republic of Indonesia 4297);
3.Acts No. 1 of 2004 on the State Treasury (Indonesian Republic Gazette 2004 No. 5, Additional Gazette of the Republic of Indonesia Number 4355);
4.Act No. 19 of 2012 on Budget and State Shopping of the Year of the 2013 Budget (State Sheet of the Republic of Indonesia Year 2012 Number 228, Additional Gazette of the Republic of Indonesia Number 5361) as amended by Law No. 15 Year 2013 on Changes to the Law No. 19 of 2012 on Budget and State Shopping 2013 Budget Year 2013 (State Gazette of the Republic of Indonesia 2013 No. 108, Additional Gazette of the Republic of Indonesia) Indonesia No. 5426);
5.2007 Government Regulation No. 44 of 2005 on the System of Inclusion And Entrepreneurship of the State on the State-owned Enterprises and Limited Perseroan (State Sheet of the Republic of Indonesia 2005 No. 116, Additional Gazette of the Republic of Indonesia) Indonesia Number 4555);
DECIDED:
SET: GOVERNMENT REGULATION ON THE ADDITION OF THE INCLUSION OF CAPITAL OF THE REPUBLIC OF INDONESIA INTO THE STOCK CAPITAL OF THE COMPANY PERSEROAN (PERSERO) PT ASDP INDONESIA FERRY.
Section 1
The State of the Republic of Indonesia did the addition of a capital inclusion into the stock capital of the Company Perseroan (Persero) PT ASDP Indonesia Ferry whose status as a Perseroan Company (Persero) is set under Government Regulation No. 15 Year 1992 on Diversion Of The General Enterprise (perum) River Transport, Lake, and The Crossing into Perseroan Company (Persero).
Section 2
(1) The added value of the inclusion of the State capital as referred to in Article 1 of Rp308.571.680.909.00 (three hundred and eight billion five hundred and seventy one million six hundred and eighty thousand nine hundred nine rupiah).
(2) The addition of the State Capital Inclusion as referred to in paragraph (1) is derived from the transfer of State-owned Goods to the Ministry of Transportation whose lack thereof is from the State Budget and Shopping Budget Year 2005, 2006, 2007, 2008, 2009, 2010, and 2011 with details as set forth in the Attachment that are an inseparable part of this Government Regulation.
Section 3
This Government Regulation shall begin in effect on the date of the promulctest.
In order for everyone to know it, order the invitational of this Government Regulation with its placement in the State Sheet of the Republic of Indonesia.
