Article 1
National Standard Social Welfare Institute is

BAB I
INTRODUCTION
A. Background
Social welfare development as an integral part of
national development on the nature of its nature to handle
various social problems, meeting basic needs, and

leverage the potential and social welfare resources that exist in
society.

Rising number, LKS distribution in Indonesia as a form
and the means of community participation in the implementation of welfare
social. Data and Information Center (PUSDATIN) Social Welfare of the year
2011, notes that the number of LKS in the entire Indonesian region
as much as 25.406 LKS. The existence and role of the LKS is very relevant to
the community needs.

the quality of social welfare is likely to decrease. By

has triggered a societal social paradigm shift,
an example of a rights-based social welfare service problem.
This paradigm shift needs to be cyclical wisely, in order for its impact
not to be threat, but instead the opportunity and strength
for the staging Social welfare. For that it is necessary
an adjustment and/or regulatory update, so it can be made
a clear reference to the LKS in the bid efforts
social welfare.
For that it needs to draw up the National Standards of the Institution Welfare
Social, as a step to respond and answer the needs
against the various problems and paradigm changes that occur
in society.
B. THE INTENT AND PURPOSE OF CREATING LKS NATIONAL STANDARD
1. Intent
As one attempt to realize the LKS meets
the technical standard/specification as the perpetrator of the welfare of
social.
2. Goal
a. The availability of LKS standards is capable of meeting the needs and
of all parties ' interests.

C. NATIONAL STANDARD USER LKS
The national standard LKS is used by:
1. The LKS administrator, as the standard user of the LKS, in order to have a reference in
meets the established standard completeness.
2. Government and local governments (provinces, counties/cities), as
policy makers, in order to have a reference in the effort to support
increase the institutional quality and service of the LKS.
3. The Legislative Institute, as a law-maker, for
has a reference in the drafting of the laws.
4. The World's perpetrators, as partners and supporters of LKS activities, for
have a reference in the improvement of quality and quantity
social welfare hosting.
5. Other stakeholders who are interested in LKS.
D. NATIONAL STANDARD CONTENT COVERAGE LKS
This standard consists of 4 (four) chapters consisting of:
Chapter I: Preliminary, which includes the background, intent and purpose
standard, standard user, standard coverage, legal foundation
used in standard, and understanding used
in standards.
Chapter II: Social Welfare Institute, which includes the general provisions
LKS, norms, standards, procedures, and LKS criteria, mechanism
registration and LKS reporting, and determination mechanism
typology and LKS classification.
Chapter III: Social Welfare Coordinating Institutions (LKKS), Institutions
Foreign Social Welfare, and Foreign Labor, which
includes the general provisions and institutional provisions of the LKKS,
general provisions, permits and sanctions LKS Foreign, as well as
the general provisions, employers, and foreign labor.

E. THE UNDERSTANDING IS USED IN THE NATIONAL STANDARD LKS

Social Welfare).
6. Competency standards are the level of capabilities that include knowledge,
practical experience/skills, and value in social work practices.
7. The next Social Welfare Institute is abbreviated as LKS,
is a social organization or social organization that performs

the people to be able to meet the basic needs of his life (Article 1
figure 11 of Law Number 11 of the Year 2009 on Welfare

19. Social Welfare is a person who is educated and trained
professionally to carry out service tasks and
the handling of social problems and/or someone who works, whether in
government agencies and/or private whose scope of activities in
the social welfare field (Article 1 of 3 Invite-Invite Number 11
Year 2009 on Social Welfare).
20. Professional Social Workers are a person who works, both in institutions
governments and private ones who have job competencies and professions

BAB II
THE SOCIAL WELFARE INSTITUTION
PART OF THE
PROVISIONS OF THE SOCIAL WELFARE INSTITUTION
A. UNDERSTANDING OF LKS
1. LKS is a social organization or social society that performs
a social welfare organization created by the public, whether or not a legal entity or a legal entity.

2011 on the Social Welfare Society.

B. THE POSITION AND PURPOSE OF THE FOUNDING LKS
1. LKS is based in the State of the Republic of Indonesia which
is determined in its Budget.
2. The purpose of establishing LKS is to support the success
hosting of social welfare, in terms of:
a. Increased participation and community empowerment in the field
social welfare;
b. provide social services to the community;
c. preserve natural resources and environmental environments;

d. developing awareness, social integrity, royalty-carrying,
hassles, and tolerance in community life;
e. keep, maintain, and strengthen unity and unity
nation; and
f. embody the country ' s goals in the field of social welfare.
C. THE ROLE AND FUNCTION OF LKS
1. The role of LKS in the host of social welfare:
a. Prevent social problems from happening;
b. provide social services to the problem

D. LEGAL STATUS AND LKS POSITION
1. LKS legal status

E. REGION SCOPE AND TYPOLOGY OF LKS
1. Scope of LKS activities

districts/cities.

F. RIGHTS AND OBLIGATIONS OF LKS
1. LKS reserves the right:
a. set and take care of the organization ' s household autonyously and
open;
b. obtaining the intellectual property rights to the name and emblem
LKS in accordance with the provisions of the laws of the law;
c. fight for the ideals and purpose of the organization;
d. carrying out activities to achieve the organization ' s objectives;
e. obtaining legal protection against the presence and activities of
organization; and

f. doing cooperation with the Government, local, private,
LKS governments, and other parties in the framework of development and
organizational sustainability.
2. LKS is obligated:

2. Criteria and Requirements
a. LKS criteria
1) Organizations/social societies, in the sense of not aiming
looking for profit;
2) Executing the hosting of social welfare
directionally, integrated, and sustainable;
3) Target the service is those who have one or
over 7 (seven) social problem criteria;
4) The execution of his ministry includes social rehabilitation; assurance
social; social empowerment; and/or social protection.
5) Be formed by the public;
6) Be legal or non-legal.
b. LKS requirements
1) The LKS registration general requirement is to have:
(1) Basic Budget and Household Budget;

4) Licensing Requirements for Foreign LKS
(1) Foreign LKS must barform the legal entity and come from or
be located or registered in the country which has
diplomatic relations with Indonesia.
(2) The Foreign LKS that will host Welfare

3. LKS Rights and Liability
a. LKS reserves the right to:
1) obtain information about LKS registration via online
(online) and/or socialization activities;
2) got the LKS registration form from the Information Systems site
LKS (SILKS) and/or socializing activities; and

d. The LKS registration is only performed one time. In the event of a change
relating to the LKS institutional data listed in
the registration form, then the LKS Registry is required to notify
to local agencies/social services in order to be performed
changes/updates of data that include:
1) change the name LKS;
2) domicile changes LKS; and
3) changes to the LKS business.
e. The listed LKS, required to deliver the annual report
to the county/city social services/social services. If for 3 (3)
the consecutive year LKS does not deliver its report, then LKS
it will be declared inactive.
f. Any LKS that has registered will obtain registration number
national LKS. Therefore, all LKS has now
registered required resigning to obtain the number
national registration LKS.
g. The LKS list mark is published by the local agency/social service
in accordance with the scope of its authority. If the government

D. LKS REGISTRATION SANCTIONS
1. LKS that organizes Social Welfare that does not perform
registration, is sanctioned as a written warning or termination
while from activities.
2. Foreign LKS that do not have operational clearance, or do not have
technical permissions will be subjected to administrative sanction:
a. written warning;
b. temporary termination of activities;
c. revocation of permissions; and/or
d. Administration fines, with the maximum fine quantity of Rp
50,000.000.00 (fifty million rupiah).
3. Foreign LKS that do not report its activities regularly will
imposed administrative sanction:
a. written warning;
b. a temporary termination of activities;
c. administrative fines, with the quantity of the most fines of Rp
100.000.00 (one hundred million rupiah); and/or
d. Permission revocation.
4. Administration fines are levied by officials who are authorized by
Ministers, governors, or bupati/mayors in accordance with the authority and
scope of its activities as well as disseminated to the state treasury.
E. THE LKS REPORTING MECHANISM
PROVISIONS IN LAWS
According to Article 39 of the Social Ministers ' Regulation No. 184 of 2011 on

Social Welfare Society:
1) Each LKS is required to make a written Iaporan on the execution of activities
at the end of the year regarding the host activities, finance, source
human power, assets, as well as LKS facilities and infrastructure.
2) The regent/mayor is required to present the report of the LKS in
the area to the Governor.
3) The governor is required to deliver the Iaporan staging of the LKS in his area
to the Minister of Social Affairs and the Minister of the Interior.
4) Implementation reporting as referred to in paragraph (2) and paragraph (3)
is performed each year.
The LKS reporting mechanism is intended to provide clarity about
stages, conditions, and pertination of the manner with the mechanism
reporting LKS. The reporting mechanism was conducted as follows:
1. The LKS administrator makes the annual report in writing according to
the format of the report has been determined;
2. Reports of activities, finance, source
human power, assets, as well as the LKS means and infrastructure;
3. Reports are delivered to the local agencies/social services/local cities
along with the file with the capes;
4. The county/city social service is making a recapitulation of the receipts

e. provide approval or rejection of a permit
operation submitted by the Foreign LKS, after first

THE SOCIAL WELFARE INSTITUTION
A. DETERMINATION OF LKS TYPOLOGY
1. General Terms
a. The LKS assessment in this case is intended to set
LKS classification.
b. The LKS classification uses 7 (seven) assessment indicators, namely:
1) the status of the LKS legal entity (legal or non-governing body
law);
2) the LKS position (single, center, or branch) position;
3) the scope of the LKS workspace (national, province, district /city,
desa/kelurah/other name);
4) service objectives (kemiskin; nakedness; disability;
remoteness; social tunings and behavioral irregularities;
disaster victims; and/or victims violence, exploitation,
and discrimination);
5) the type of service (social rehabilitation, social security,
social empowerment, and/or social protection);
6) service programs (planned, guided, integrated, and
continuous); and
7) LKS Tipology (Type A/Mandiri, Type B/XX_ENCODE_CASE_CAPS_LOCK_On fireworks, etc.) Type
C/Grow, or Type D/Embrio).
2. LKS Legal Body Status provisions
a. LKS Berbadan Law, if LKS has had an established notary acte
passed by the Minister of Law and Human Rights as
the legal entity.
b. LKS Is Not Legal, if LKS has not been declared as a body
law, it must have a founding memorandum legalized by the head
desa/lurah/other name, camat, or bupati/mayor.

3. LKS Position Terms
a. LKS Single, if LKS is located and operates at an

organization parent, and operates in a specific region.
4. The scope of the LKS workspace
a. LKS national level of its work region covers national, in
the meaning of hosting social welfare activities more than 1 (one)
provinces, with requirements:
1) hosting social welfare activities or have
branches of more than 1 (one) province and partners work with
LKS or any other institution that is at least 25% (two
up five percent) of the number of provinces; or
2) has a working partner with LKS or other institutions that are
at at least 50% (fifty percent) of the amount province.
3) the cooperation of cooperation or partnership with LKS or any other institution
is declared or can be proven by written document.
b. LKS provincial level Iingkup of its work region covers the province, in
the meaning of hosting social welfare activities of more than 1 (one)
county/city, with requirements:
1) hosting welfare activities social or have

Executing service programs in the social welfare field

8. LKS Tipology provisions
a. The LKS category according to its typology is as follows:
1) LKS type D/Embrio; with criteria:
1) has not met the institutional completeness standards and
services;
2) the acquisition of values is below 40% (forty percent) from the total
standard value of LKS management; and

3) LKS type B/TWS; with the criteria
1) have met most of the standards of completeness
institutional and service;
2) The acquisition of between 60% (sixty percent)-80%
(eighty percent) of the total value of the management standard
LKS; and
3) has the potential to improve.
4) LKS type A/Mandiri; with criteria:
1) has met the standards of institutional completeness and
ministry;
2) gains above 80% (eighty percent) of the total
value of LKS management standards;
3) is not dependent on Government assistance; and
4) can be made an example.
b. Standard LKS management assessments include:
1) Institutional Aspects, with weighted values = 15% (fifteen
percent);
2) Aspects of Resources and Governance, with weighted values = 25%
(twenty-five percent);
3) Aspects Program Development, with a rating of = 35% (three
20 percent);
4) Aspects of Cooperation and Partnership, with a weighted value = 15%
(fifteen percent); and
5) Continuity And Independence Aspects, with weightscoring =
10% (ten percent).
B. DETERMINATION OF LKS CLASSIFICATION
1. The LKS classification is intended to classify LKS based on
LKS capabilities in meeting LKS standard requirements.
2. The purpose of this classification is as the basis for planning the LKS coaching effort.
3. This classification will be included in the LKS registration letter.
4. The LKS classification consists of:

THE FOREIGN SOCIAL WELFARE AGENCY
A. THE GENERAL PROVISIONS OF THE FOREIGN SOCIAL WELFARE AGENCY
1. Foreign LKS is:

the legal provisions of a country in which a social organization or

b. have received permission from the Government of the Republic of Indonesia to

B. FOREIGN LKS AND SANCTIONS
PROVISIONS IN THE LAWS
1. PERIZ0s
Foreign LKS Licensing according to the Regulations of Social Ministers Number 184 of 2011
about the Social Welfare Society-Chapter V Second Part:
a. Article 21:
The LKS Licensing is intended for the Foreign LKS that will host
Social Welfare in Indonesia.
b. Article 22:
(1) The Foreign LKS as referred to in Article 21, must be barform
the legal entity and derived or located or registered in
the country that has diplomatic relations with Indonesia.
(2) the Foreign LKS will host Social Welfare in
Indonesia must first obtain a principle permit from the Minister

The extension of the Foreign LKS operational permit is granted by the Minister after

the governor or local/local mayor.

Sanctions
Redemption of sanctions according to Government Regulation No. 39 of 2012
on the Social Welfare Alignment:
a. Article 65:

2. Sanctions
a. Foreign LKS has no operational clearance or not
has a technical permit imposed by an adminisirative sanction:
1) a written warning;
2) a temporary outage of the activities; and/or
3) an administrative fine.
b. Foreign LKS that does not report its activities periodically,
imposed administrative sanction:
1) a written warning;
(1) The written warning is conducted by 3 (three) times with
quarter time 14 (fourteenth) day of work between
first warning and subsequent warning.
(2) In terms of a written warning of 3 (three) times not
are adhered, the temporary termination of the activity.

THIRD PART
FOREIGN WORKFORCE
A. FOREIGN LABOR GENERAL PROVISIONS
a. The foreign workforce is a citizen
foreign visa holder with intent to work in the region of Indonesia.

expertise.
c. The next Foreign Workforce is called Workforce

B. EMPLOYERS
a. TKA employers include:
1) government agencies, representatives of foreign countries, bodies

and foreign news agencies conducting activities in Indonesia;
3) foreign private companies attempting to use in Indonesia;
4) Legal entities established under Indonesian law or
foreign entities registered in authority;
5) social, religious, educational, and cultural institutions; and
6) the efforts of the impresariates.
b. Any TKA Service Provider is required to maintain the use of the workforce
Indonesia on all available types of posts. In terms of office that
has not been able to be occupied by Indonesian labour, the post can be
occupied by TKA.
c. Any TKA Workforce must have an RPTKA authorized by the Minister
or a designated official before hiring a TKA. The provisions
regarding the obligations of having an RPTKA do not apply to government agencies,
representatives of foreign countries, and international bodies.
d. RPTKA may be given for a term of at least 5 (five) years and
may be extended for the same time as paying attention
in the domestic working market conditions.
e. Every TKA Workforce must have an IMTA published by the Minister
or a designated official. The obligation to have an IMTA does not apply to the
representatives of foreign countries that use TKA as diplomatic servants
and consuler.
f. The IMTA is given for the most prolonged period of 1 (one) year and can be
extended. The IMTA extension is given the longest of 1 (one) year
with the provision not exceeding the expiring RPTKA term.

4. THE LKS REPORTING MECHANISM WITH THE ONLINE SYSTEM (ONLINE)
a. The LKS reporting is mandatory by the LKS Switcher every year once, or
when there is a change in the business of LKS.
b. If the LKS does not deliver a report for 3 (three) years in a row-
it is, then the LKS is declared inactive, and its registration number
cannot be used. To obtain a new registration number, the administrator
LKS must repeat the entire LKS registration process.
c. The online/online LKS report delivery mechanism is the same as
LKS registration mechanism, only differentiated on the type of borang/instrument
as well as its supporting documents.
d. The LKS report is printed and transmitted to the local office/local office
