§ 1 Legal form of the Foundation

Under the name "Chancellor-Helmut-Schmidt-Stiftung", a legal foundation under public law will be established with its headquarters in Hamburg. The Foundation shall be established with the entry into force of this Act. Unofficial table of contents

§ 2 Purpose of the Foundation

(1) The purpose of the Foundation is to preserve the memory of the political work of Helmut Schmidt for the freedom and unity of the German people, for the peace and unification of Europe, and for understanding and reconciliation among the peoples, and thus in his sense of
1.
a contribution to the understanding of the history of time and the further development of the Federal Republic of Germany, and
2.
for the work-up, presentation and further development of Germany's responsibility in foreign, security and economic policy in the European and global environment;
3.
Knowledge of the geopolitical and economic challenges of the 21st To deepen and broaden the century in Europe and the world.
(2) The fulfilment of this purpose shall, in particular, serve as follows:
1.
Establishment and operation of a Helmut Schmidt Centre as a public remembrance site in Hamburg, which, within the scope of the Foundation's purpose, establishes and maintains a permanent exhibition of historical history, special exhibitions and events , as well as providing scientific work opportunities,
2.
Maintenance, operation and use of the estate of the Eheleute Schmidt in Hamburg-Langenhorn as an authentic historical site as well as for adequate public use within the meaning of the Foundation's purpose,
3.
regular activities such as the organisation and organisation of events in the capital Berlin and in places other than the foundation's seat,
4.
Research and promotion of scientific work as well as publications within the meaning of the Foundation's purpose, in particular taking into account future-oriented issues,
5.
Promotion of cooperation with other national and international bodies, insofar as it serves the purpose of the foundation.
(3) The fulfilment of the purpose of the foundation is also the maintenance and evaluation of the existing archive Helmut Schmidt at the Haus der Eheleute Schmidt in Hamburg-Langenhorn as well as the creation of the prerequisites for its public use. § 3 Foundation assets

(1) The Foundation's assets form those immovable and movable property acquired by the Federal Republic of Germany for the purpose of the Foundation. (2) The Foundation shall be entitled to accept grants from third parties. (3) To fulfil The Foundation receives an annual grant from the Federal Government in accordance with the respective Federal Budget Act. (4) The Foundation's assets and other income are to be used only in the spirit of the Foundation's purpose. Unofficial table of contents

§ 4 Statute

The Foundation has a statute that is decided by the Board of Trustees by a majority of two-thirds of its members and requires the approval of the top federal authority responsible for culture and media. The same applies to the amendment of the Articles of Association. Unofficial table of contents

Section 5 Institutions of the Foundation

§ 6 Kuratorium

(1) The Board of Trustees consists of six members who are appointed by the Federal President or by the Federal President for a period of five years. (2) Binding proposal rights for one member of the Board of Trustees have the Federal President or the Federal President, the top federal authority responsible for culture and the media, the Friedrich-Ebert-Stiftung e. V. as well as the ZEIT-Stiftung Ebelin and Gerd Bucerius. The Board of Trustees of the Helmut and Loki Schmidt Foundation has binding proposals for two members of the Board of Trustees. § 7 Executive Board

(2) The Board of Trustees elects the Chairman or Chairman of the Board. (3) Two members of the Board of Management are members of the Board of Directors. § 8 International Advisory Council

(1) An International Advisory Board may be appointed to advise the Board of Trustees and the Board of Management in the fulfilment of the Foundation's purpose. The members of the Advisory Board are voluntary. (2) The Advisory Board consists of no more than 15 members, who are appointed by the Board of Trustees for a period of five years, taking into account the Foundation's purpose. Revocation shall be admissible. (3) The members of the Advisory Board shall elect from among their members a Chairperson or Chairperson. The Chairman shall convene the meetings of the Advisory Board in agreement with the Chairman or Chairman of the Board of Trustees and shall direct them. Unofficial table of contents

§ 9 Next to and honorary activity

§ 10 Supervision, budget, legal examination

(1) The foundation is subject to the legal supervision of the top federal authority responsible for culture and media. In carrying out its tasks, the Foundation is supported by the Federal Archives; the nature and scope of the Federal Archives responsible for culture and the media are regulated in consultation with the Board of Trustees and the Helmut-Schmidt-Archiv in the Archives of the Social Democracy of the Friedrich-Ebert-Stiftung e. V.. (2) The provisions applicable to the Federal Administration shall be applicable to the budget, treasury and accounting system as well as to the accounts of the Foundation.

§ 11 Employees

(1) The activities of the Foundation are usually carried out by employees. (2) The employees of the Foundation shall be subject to collective agreements and other provisions applicable to employees of the Federal Government. (3) The Foundation may the right to have civil servants, by means of a system of statutes. Unofficial table of contents

§ 12 Fees

The Foundation may charge fees and expenses for the use of foundation facilities in order to meet the administrative burden following the detailed definition of the articles of association. Unofficial table of contents

Section 14 Entry into force

This law shall enter into force on 1 January 2017.
