§ 1 Definitions

For the purposes of this Regulation:
1.
Inland waterways: the Rhine, Moselle and Danube waterways, as well as the federal waterways on which the inland waterways order is valid,
2.
Transport Regulations:
a)
Inland waterways-Ordnunginland waterways-Order (Annex to § 1 (1) of the Regulation on the introduction of the inland waterways order of 16 December 2011 (BGBl. 2012 I p. 2)), in the version applicable and applicable,
b)
RheinschifffahrtspolizeiverordnungRheinschifffahrtspolizeiverordnung (Annex to Article 1 (1) of the Ordinance on the Introduction of the Rhine Navigation Tspolizeiverordnung of 19 December 1994 (BGBl. 3816)), as last amended by a decision of 27 May 2011 (BGBl. 1300), has been amended, as amended, in the current and applicable version,

§ 2 Other applicable provisions

Unless otherwise provided for in this Regulation, driving with water-powered motorcycles shall apply:
1.
the traffic regulations (§ 1 no. 2),
2.
The sports bootlicence regulation-Binnen vom 22. März 1989 (BGBl. 536, 1102), as amended by Section 4 (5) of the Law of 25 September 1990 (BGBl I). 2106),
3.
The Regulation on the identification of small vehicles travelling on inland waterway roads of 21 February 1995 (BGBl. 226), as amended by Article 9 of this Regulation,
4.
the Water Skiing Ordinance of 17 January 1990 (BGBl. 107), as last amended by Article 10 of the Regulation of 18 December 2002 (BGBl I). 4580),

§ 3 Watermotorcycling

(1) On inland waterways (Article 1 (1)), driving with motorcycles is outside the scope of Article 1 of the Regulation on the introduction of the Rhine-Navigation Ordinance of 19 December 1994, by means of the E.22 table of Appendix 7 to the Annex to Article 1 of the Regulation (BGBl. 3816) prohibited water areas. Sentence 1 shall not apply to:
1.
Trips to reach the nearest released water surface and for tours or hiking trips,
2.
the use as a moving vehicle within the meaning of the second sentence of section 3 (3) of the Water Skiing Regulation on the lines and water areas released by the E.17 (Section 1 (1), first sentence, No. 1 of the Water Skiing Regulation),
3.
Rescue operations carried out by service vehicles of public service vehicles recognised as non-profit-making bodies and public service vehicles.
The second sentence of the second sentence of paragraph 1 shall apply only if a clearly identifiable straight course is complied with. (2) In the cases referred to in the second and third sentences of paragraph 1, the driving style of the water motorcycle shall not endanger or impede any more than the circumstances of the case, or are being harassed. § 4 Water motorcycle surfaces

(1) Water motorcycles may be used on the water surfaces released by the E.22 table sign. In doing so, the driver shall not jeopardise any other vehicle which does not obstruct the rest of the navigation and does not prevent other vehicles, shore or control structures, floating or fixed installations, ship signs and shore vegetation. damage. § 5 Allowing water to be taken out of the water

§ 6 Restrictions

(1) The driving of water motorcycles is only permitted in the period from 7.00 am to 20.00 o'clock, but not before sunrise and after sunset, and only in weather with a view of more than 1,000 metres. In addition, the driving of water motorcycles is only allowed,
1.
if it is ensured, by means of appropriate technical equipment, that, in the event of the vehicle driver ' s overtaking, the engine switches off automatically or automatically switches back to the smallest driving level, and then the water-powered motor wheel the circular path;
2.
if the driver of the vehicle and the accompanying person carry swimming aids which meet at least the requirements of DIN EN 393 or otherwise ensure a lift of at least 50 newtons.
The DIN standard referred to in the second sentence of the second sentence is to be obtained from the German Patent and Trademark Office in Munich in an archival form and by the German Institute for Standardization, Burggrafenstraße 6, 10787 Berlin. § 7 Transfer of powers

The Water and Shipping Directorates are empowered to adopt measures derogating from this Regulation by means of a regulation on water bodies released for the purpose of transport by motorcycles, in particular:
1.
to set different time-limit prohibitions for water-motorcycles in so far as they allow or permit the local conditions; and
2.
allow different maximum speeds for water motorcycles, if this does not affect the state of the waterway, including the shore vegetation, and the rest of the shipping traffic, as well as harmful environmental effects in the sense of § 3 (1) of the Federal Immission Protection Act, as amended by the Notice of 14 May 1990 (BGBl. 880), as last amended by Article 2 (5) of the Law of 23 November 1994 (BGBl I). 3486), are not to be evoked.

§ 8 Administrative Offences

Contrary to the provisions of Section 7 (1) of the Act on Inland Waterway Transport, who intentionally or negligently
1.
as the leader of a water-powered motorcycle
a)
, contrary to § 3 (1) sentence 1, outside of the released water areas,
b)
Contrary to Article 3 (2), others are at risk or are more than unavoidably disabled or harassed in the circumstances,
c)
Contrary to the second sentence of Article 4 (1), other endangered or obstructed shipping or other vehicles, shore or control structures, floating or fixed installations, shipping signs or riverside vegetation are damaged or
d)
, contrary to § 5 or § 6 (1), a water-powered motorcycle is allowed to water, takes out water or leads, or
2.
, as the owner of a water-powered motorcycle contrary to § 6 (2), orders or allows the driver to carry a water-powered motorcycle.

Section 10 Entry into force

This Regulation shall enter into force on 15 June 1995.
