Section 1
General provisions

§ 1 Scope

(1) This Regulation provides for the protection of animals in connection with slaughter or killing, in particular the implementation of Council Regulation (EC) No 1099/2009 of 24 September 2009 on the protection of animals at the time of killing (OJ L 327, 22.12.2009, p. 1). (2) This Regulation shall apply to:
1.
the caring of animals in a slaughterhouse,
2.
the storage of fish and crustaceans intended for the production of food or intended for use as feedingstuffs,
3.
frenchment and stunning before slaughter or killing of animals intended for the production of meat, hides, furs or other products;
4.
the slaughter or killing of the animals referred to in point 3; and
5.
the resting places, stunning and killing of animals in the event of a killing by the authorities.
(3) The provisions of this Regulation shall not apply to:
1.
an animal test to the extent that other requirements are essential for the purpose pursued,
2.
the right to practice hunting,
3.
permitted pest control measures and
4.
a mass catch of fish, in so far as it would not be possible, or only with a disproportionately high level of effort, to carry out anesthesia according to the state of the art.

§ 2 Definitions

For the purposes of this Regulation:
1.
Animal: any living animal;
2.
Gatterwild: wild ruminants and wild boars kept in an enclosure;
3.
Chicks: poultry aged up to 60 hours after slippage;
4.
Caring for: teaching, feeding, drinking and caring for the animals, including the driving and the transport of animals within a slaughterhouse;
5.
Slaughtering: slaughtering outside a slaughterhouse, provided that the meat is to be obtained and used exclusively in the owner's own household for private domestic consumption.

§ 3 General principles

(1) In addition to the requirements laid down in Article 3 (1) of Regulation (EC) No 1099/2009, the animals shall be cared for, rested, stunned, slaughtered or killed in such a way that they no longer constitute unavoidable excitement or damage. (2) In addition to the requirements laid down in Article 3 (3) of Regulation (EC) No 1099/2009, equipment for resting places and equipment and installations for the stunning, slaughtering or killing of the animals must be planned in such a way as to be able to: to maintain and use rapid and effective anaesthesiae and battles, or Killing is possible. § 4 Sachkunde

(1) If animals are cared for, calm, stunned, slaughtered or killed, they must have the necessary knowledge and skills (in terms of expertise). (2) The proof of competence referred to in Article 21 (1) (b) of Regulation (EC) No 1099/2009 shall be: shall be issued by the competent authority or by the body (competent authority) responsible for the purposes of national law, on request, if, in the context of a successful examination, the instrument is subject to the conditions laid down in paragraph 3 or in accordance with Article 21 (7) of the Regulation (EC) No 1099/2009 has been recognised as equivalent (3) On request, the competent authority shall carry out an examination of the facts relating to the categories of animals referred to in the application, as well as the methods of stunning and killing procedures. The exam consists of a theoretical part and a practical part. It is filed in the theoretical part in writing and orally. The examination shall cover the areas referred to in Annex IV to Regulation (EC) No 1099/2009 as well as the basic knowledge of anatomy and physiology, knowledge of animal welfare regulations, basic knowledge of physics and chemistry, to the extent that: (4) The examination has been passed if, in the theoretical and practical part, at least sufficient services are provided for (5) A repetition of the test shall be carried out at the earliest after three months. (6) The proof of proof of proof shall be withdrawn if the holder of the certificate has repeatedly failed to infringe the requirements of this Regulation or of Regulation (EC) No 1099/2009 on a number of occasions, and if the facts justify the adoption of such a statement (7) expert certificates issued in accordance with § 4 (2) of the Animal Welfare Ordinance of 3 March 1997 (BGBl. I p. 405) have been issued until December 31, 2012 until December 31, 2012, and until 8 December 2015 shall be considered as a proof of proof within the meaning of Article 21 (1) (b) of Regulation (EC) No 1099/2009 in respect of the following: (8) Those who, in the course of their professional activities, contribute to the direct delivery of small quantities of meat to poultry or rabbit
1.
Final consumer or
2.
local businesses in the retail sector slaughtering direct supply to the final consumer,
shall be subject to a valid proof of competence as referred to in paragraph 2. Paragraphs 3 to 7 shall apply accordingly. Small quantities within the meaning of the first sentence are small quantities in accordance with Article 3 (2) (3) of the Animal Foodstuffs Hygiene Regulations of 8 August 2007 (BGBl. I p. 1816, 1828), as last amended by Article 1 of the Regulation of 10 November 2011 (BGBl. 2233). Unofficial table of contents

§ 5 Trubbing and promoting animals within a slaughterhouse

(1) In addition to the rules on the handling of animals in accordance with Annex III, point 1.8. and 1.9 of Regulation (EC) No 1099/2009, the use of electric power equipment is only within slaughterhouses in the case of a healthy and uninjured person over a year old. Bovine animals and pigs over four months old, which refuse to move in the area of separation before or during direct access to the fixation facility. Electrical stunning equipment shall not be used to induce animals to move. (2) In addition to the rules on handling animals in transport containers referred to in Annex III, point 1.3. of Regulation (EC) No 1099/2009, Containers holding warm-blooded animals shall always be in an upright position, unless they are inclined so as to automatically unload poultry so that the animals do not fall on top of each other. Animals may only be unloaded from the containers while avoiding pain, suffering or damage. Animals delivered in containers shall be immediately slaughtered. (3) Paragraphs 1 and 2 shall apply to house slaughters. (4) Paragraph 2 shall apply to the slaughter of poultry or rabbits in the context of a professional Activity for the direct delivery of small quantities of meat

Final consumer or
2.
Local retail businesses for direct delivery to final consumers
accordingly.

Section 2
Rules on slaughterhouses

§ 6 Requirements for equipment

In addition to the requirements for the design, construction and equipment of slaughterhouses in accordance with Annex II of Regulation (EC) No 1099/2009, the operator of a slaughterhouse shall ensure that:
1.
Slaughterhouses shall have facilities for unloading animals from means of transport which make it possible to:
a)
Animals which are not delivered in containers must overcome only a slight inclination, which is as small as possible, and which does not exceed 20 degrees.
b)
unloading animals in containers in upright position,
2.
the ground in the whole area of residence of the animals shall be safe,
3.
are designed in such a way as to promote the self-employed forward movement of the animals,
4.
The drivings and ramps are provided with a side guard, which is designed so that the animals do not overcome them, cannot stretch out limbs and cannot injure themselves, and
5.
The propellers and ramps have an inclination of not more than 20 degrees, with the inclination of the propellers to the anesthetic device being at most ten degrees, for bovine animals not more than seven degrees.

Section 7 General provisions on the subject of animals

(1) The alarm system required in accordance with Annex II, point 1.2. of Regulation (EC) No 1099/2009 in the event of the use of automatic ventilation or ventilation shall report an operational malfunction to the supervising person. The alarm system shall be regularly checked for its operability. (2) Water from a natural water source or a potion in accordance with point 2.6 of Annex II. Article 3 of Regulation (EC) No 1099/2009 as well as water referred to in Annex III, point 1.5. (c) and (1.6) of Regulation (EC) No 1099/2009 must be of sufficient quality. Animals in containers which are not supplied within two hours of delivery of slaughter shall be supplied with drinking water. (3) By way of derogation from point 1.2 of Annex III. The third sentence of Regulation (EC) No 1099/2009 provides that animals which are not supplied to the slaughterhouse of slaughter within six hours of delivery shall be supplied with suitable fodder. (4) Animals which are among themselves on the basis of their nature, of their sex, age or origin, they must be accommodated separately. (5) The general health and health status of the animals must be checked at least every morning and evening. To the extent necessary, animals must immediately be condoned or killed. Section 8 Care of animals that are not in containers

(1) The operator of a slaughterhouse shall ensure that:
1.
sick or injured animals, and animals which have not yet been removed, immediately after their arrival, and immediately slaughtered or killed,
2.
sick or injured animals, who are obviously suffering from severe pain or have large, deep wounds, severe bleeding or a severely disturbed general condition, are slaughtered or killed immediately after their arrival; and
3.
Animals which, due to illness or injury, are unable to reach the place of slaughter, where they are located, without painful driving aids, where they are being stunned or killed.
(2) The operator of a slaughterhouse shall ensure that animals which are not immediately slaughtered after unloading are housed in such a way as to ensure that:
1.
in addition to the requirements laid down in point 2.1 of Annex III to Regulation (EC) No 1099/2009, all animals are free to lie, stand up and lie down,
2.
there is a lying surface for each animal, which meets the requirements for the deck in terms of heat dissipation, and
3.
there is a frescoes for each animal.
The second subparagraph of paragraph 2 shall not apply to the extent to which the animals are slaughtered within six hours of their arrival. The first subparagraph of paragraph 3 shall not apply to the extent to which the animals are slaughtered within 12 hours of their arrival.

Section 3
Rules on the preservation of fish and crustaceans

§ 9 Store of fish

(1) Living fish may only be kept in containers with a volume of water which provides sufficient movement for the animals. Unsafe fish must be kept separate from each other. Account must be taken of the water quality, temperature and lighting requirements of each species. In particular, adequate water exchange and adequate supply of oxygen to the animals must be ensured. (2) The general health and health status of the animals must be monitored at least every morning and evening. To the extent necessary, animals must immediately be condoned or killed. Dead fish must be removed immediately from the container. (3) Fish are not allowed to be delivered to the final consumer. Unofficial table of contents

§ 10 Store of crustaceans

The preservation of live crustaceans on ice is prohibited. They may only be stored in the water or only temporarily during transport in a direct connection with the delivery to the final consumer on a damp base.

Section 4
Rules on frenchment, stunning, slaughtering and killing of animals

§ 11 Fishing of warm-blooded animals

(1) Animals that are to be stunned or killed by the use of a mechanical or electrical device shall be placed in such a position that the apparatus can be set and operated without difficulty, precisely and as long as necessary. For this purpose, in the case of solipeds and cattle, their head movements are to be restricted. In slaughterhouses in which pigs are slaughtered to a level exceeding 20 large-scale units per week or more than 1 000 in accordance with the conversion rate laid down in Article 17 (6) (c) and (d) of Regulation (EC) No 1099/2009. In the case of large-scale livestock units per year, pigs weighing more than 30 kilograms shall be individually quietly applied when using electrostunning in stunning or similar equipment. (2) Electrical stunning equipment shall not be allowed to: shall be used to retire animals. (3) In addition to the requirements of the Article The provisions of Article 9 (3) of Regulation (EC) No 1099/2009 shall not allow animals to be rested until the person in question is ready for the immediate stunning or killing of the animals. § 12 Beets, Battle and Killing

(1) In addition to the requirements for stunning in accordance with the first and second sentences of Article 4 (1) of Regulation (EC) No 1099/2009, animals shall be stunned in such a way as to ensure that they are rapidly and without suffering from pain or suffering in a sustained period of time to death. (2) Article 4 (4) of Regulation (EC) No 178/EC. In accordance with Article 4 (1) of Regulation (EC) No 1099/2009, if a vertebrate animal kills a vertebrate, it shall, in accordance with the provisions of Article 4 (1) of Regulation (EC) No 1099/2009, do so in accordance with the provisions of Article 4 (1) of Regulation (EC) No 1099/2009, as far as it is not in Annex 1 to other than that. The competent authority may apply a stunning procedure in accordance with Article 4 (1) in conjunction with Annex I, Chapter I, Table 3, to Regulation (EC) No 1099/2009, subject to Annex 1, having regard to the first sentence of Article 26 (1) of the Regulation (EC) No 1099/2009 shall prohibit or restrict, in so far as the Animal Welfare Regulation is in force until 1 January 2013, a more comprehensive protection of the animals to be stunned with a view to the particular stunning procedure (4) If the poultry in the water tank are stunned by electric stunning, a Animal, which has not been stunned in the water basin, immediately by hand to be stunned or killed. In the context of the slaughter of chickens, guinea fowls, pigeons and quails, if anesthetic was not sufficiently effective in the case of individual animals, further stunning may be dispensed with, in so far as the slaughter or killing is carried out by (5) In addition to the requirements for the maintenance and control of the equipment for resting or stunning in accordance with Article 9 (1) of Regulation (EC) No 1099/2009, stun appliances are and facilities on each working day

Defects as set out in the first sentence of the first subparagraph shall be submitted immediately. (6) If the animal slaughters or otherwise kills an animal with a blood withdrawal, it must immediately after stunning, and in particular for the stunning procedures set out in Annex 2, column 1, within the respective in column 2, with the start of bleeding. He must bleed the animal as long as it is incapable of sensation and perceptions. In the case of the bleeding of warm-blooded animals, an immediate severe blood loss must be guaranteed and controllable. In addition to the requirements for the slaughter of the poultry referred to in Article 15 (1) in conjunction with point 3.3 of Annex III to Regulation (EC) No 1099/2009, the operator of a slaughterhouse shall ensure that the automatic neck-and-neck car (7) A further dressing or broth of an animal in accordance with point 3.2 of Annex III. Article 3 of Regulation (EC) No 1099/2009 may not take place until such time as movements of the stunned animal are no longer to be carried out. Anyone who slaughters an animal without anaesthesia must not hang the animal before the bleeding is complete. (8) In the case of killings without a blood withdrawal, further intervention on the animal may not be carried out until after the death has been established. (9) The operator of a hatchery has ensure that non-slippery chicks are killed immediately after the end of the breeding process. (10) If a fish slaughters or kills a fish, it must be stunned immediately prior to slaughter or killing in accordance with the provisions of Annex 1, point 9. By way of derogation from the first sentence,
1.
Flatfish by a quick cut that cut the throat and the spine, and
2.
Eels, if they are caught and processed at most up to a number of 30 animals per day, through a stitch severing the spinal column close to the head and immediate removal of the intestines including the heart
(11) crustaceans, snails and bivalve molluscs are only allowed to be killed in boiling water, which they completely cover and must continue to cook strongly after they have been added. By way of derogation from the first sentence,
1.
Taschenkrebse was killed by mechanical destruction of the two main nerve centers,
2.
Snails and mussels killed in over 100 degrees Celsius hot steam, as well as
3.
Crustaceans are electrically stunned or killed
. If the electrostunning does not lead to the immediate death of the crustaceans, they are to be killed immediately after the electrostunning by a method according to the first sentence or the second sentence of the second sentence of the second sentence. The first sentence and the second sentence of paragraph 2 shall not apply in the case of the crude consumption of oysters and the official examination of live snails or bivalve molluscs. Section 13 Official admission of further stunning or killing procedures

(1) By way of derogation from the first sentence of Article 12 (3), including in conjunction with Appendix 1, the competent authority may, in a limited period,
1.
permit other stunning or killing procedures for the purpose of their testing;
2.
in the context of administrative killings, allow other methods of stunning or killing, provided that the animals are safely stunned and killed thereby avoiding pain or suffering; Section 12 (8) shall apply mutagenically;
3.
By way of derogation from Annex 1, point 6.4, with a minimum flow time of two seconds and, by way of derogation from Appendix 1, point 6.5, for bovine animals over six months without electrical cardiac flow, to be used as a stunning method, in so far as it is necessary to meet the needs of persons belonging to certain religious communities, to which mandatory provisions of their religious community prohibit the use of other methods of stunning.
(2) By way of derogation from the first sentence of Article 12 (6) in conjunction with Annex 2, the competent authority may, in duly substantiated individual cases, authorise derogations from the maximum period between stunning and bleeding cut if it is established that the requirements (3) By way of derogation from the first sentence of Article 12 (3), including in conjunction with Appendix 1, the competent authority may allow other stunning or killing procedures to be carried out for a limited period of time for a non-government-based clearing of the stock, as far as the animals are safely stunned and killed with them in the avoidance of pain or suffering § 12 (8) shall apply accordingly. Section 14 obligations for retention of storage and charges

The records of the key parameters of electrical stunning procedures as set out in point 4.1 of Annex II. Sentence 1 and point 5.10. Article 1 of Regulation (EC) No 1099/2009 and records of gas concentration and duration of exposure in the case of gas-stunning methods as set out in point 6.2 of Annex II. The first sentence of Regulation (EC) No 1099/2009 shall be submitted to the competent authority at the request of the competent authority for inspection. Unofficial table of contents

§ 15 Corresponding application of EU rules

(1) Where the killing of animals is governed neither by national law nor by a directly applicable act of the European Community or of the European Union, Articles 3 (1) and 4 (1), first sentence, shall apply in Link with Annex I to Regulation (EC) No 1099/2009 accordingly. Insofar as something else is determined or approved in accordance with Appendix 1, the regulations of Appendix 1 shall apply by way of derogation from the first sentence of sentence 1. (2) The following provisions of Regulation (EC) No 1099/2009 shall apply to the slaughtering of the house in accordance with:
1.
Article 9 (2) on the requirements for the use of narcotic devices,
2.
Article 9 (3) for the frenchment of animals for slaughter,
3.
Article 15 (3) and
4.
Annex III, point 1.8., 1.9., 1.10. and 3.2.
(3) For the slaughter of poultry or lagomorphs in the context of a professional activity, for the direct delivery of small quantities of meat
1.
Final consumer or
2.
Local retail businesses for direct delivery to final consumers
paragraph 2 shall apply accordingly.

Section 5
Irregularities and final provisions

§ 16 Administrative Offences

(1) Contrary to the provisions of Section 18 (1) (3) (a) of the Animal Welfare Act, those who intentionally or negligently act
1.
shall apply, contrary to the first sentence of Article 5 (1), an electric propulsion device
2.
Contrary to Section 6, point 2, it does not ensure that a ground referred to therein is non-slip,
3.
Contrary to Section 6, point 4, it does not ensure that a leaven or ramp is provided with a side-guard referred to therein,
4.
Contrary to Article 7 (2), second sentence, it does not ensure that an animal referred to in the second sentence is supplied with drinking water,
5.
In contrast to § 9 (3), a fish or
6.
, contrary to § 10 sentence 1, a crustaceans are kept.
(2) In the sense of Section 18 (1) (3) (b) of the Animal Welfare Act, who intentionally or negligently acts in the sense of the order of law
1.
does not ensure, contrary to the first sentence of Article 8 (1) (1) or (2), that the animal referred to in that paragraph is slaughtered or killed,
2.
does not ensure, contrary to Article 8 (1), first sentence, point 3, that an animal referred to in that paragraph is stunned or killed,
3.
Contrary to Article 12 (3) sentence 1, a vertebrate animal is killed,
4.
Contrary to § 12 (4) sentence 1, an animal shall not, not properly, be stunned or killed in the prescribed manner or in a timely manner,
5.
contrary to Article 12 (6), first sentence, in the period laid down in column 2 of Appendix 2, the bleeding does not begin or does not begin in good time,
6.
Contrary to the fourth sentence of Article 12 (6), it does not ensure that an animal referred to in that sentence is debled,
7.
Contrary to § 12 (7) sentence 1, an animal is to be treated or brewed,
8.
Contrary to the second sentence of Article 12 (7), an animal is suspended,
9.
Contrary to § 12, paragraph 8, an intervention on the animal,
10.
Contrary to Section 12 (9), it does not ensure that a non-slipable chick is killed in time, or
11.
Contrary to § 12 (10) sentence 1, a fish is not stunned, not properly, in the prescribed manner or not in good time.
(3) Contrary to Council Regulation (EC) No 1099/2009 of 24 September 2009 on the protection of animals at the time of killing (OJ L 393, 30.12.2009, p. 1), by intentionally or negligently
1.
Contrary to Article 7 (2) (a), it does not ensure that the handling and care of animals before they are held is carried out by a person who has a proof of proof of material referred to in that person's certificate,
2.
contrary to Article 14 (1), in conjunction with point 1.2 of Annex II, does not ensure that an alarm system and an emergency power supply system are present,
3.
contrary to Article 15 (1), in conjunction with Annex III, point 1.1., it does not ensure that each consignment is assessed directly after their arrival with animals,
4.
contrary to Article 15 (1), in conjunction with point 1.3 of Annex III. Sentence 1 (a) does not ensure that a transport container with animals is not thrown, dropped or dipped,
5.
Contrary to Article 15 (1), in conjunction with Annex III, point 1.5. Sentence 2 (a) does not ensure that lactating milk is milked at least every twelve hours,
6.
contrary to Article 15 (1), in conjunction with point 1.6 of Annex III, it does not ensure that an animal referred to in that paragraph has access to drinking water at all times,
7.
contrary to Article 15 (1), in conjunction with point 1.8 of Annex III. Point (a) does not ensure that an animal is not beaten or kicked;
8.
contrary to Article 15 (1), in conjunction with point 1.8 of Annex III. Point (b) does not ensure that there is no pressure on a body part of an animal referred to in that paragraph,
9.
contrary to Article 15 (1), in conjunction with point 1.8 of Annex III. Point (c) does not ensure that an animal is not raised or drawn up on the head, ears, horns, legs, tail or fur, or that an animal is not treated in such a way as to cause pain or suffering to it,
10.
contrary to Article 15 (1), in conjunction with point 1.8 of Annex III. Point (d) does not ensure that a driving aid or other equipment referred to therein is not used;
11.
contrary to Article 15 (1), in conjunction with point 1.8 of Annex III. Point (e) does not ensure that the tail of an animal is not squeezed, rotated or broken, or that an animal is not in the eyes of an animal,
12.
Contrary to Article 15 (1), in conjunction with point 1.9 of Annex III. Sentence 3 does not ensure that a current surge is administered only to the muscle parts of the back quarters,
13.
Contrary to Article 15 (1), in conjunction with point 1.9 of Annex III. Sentence 4 does not ensure that a current surge is not repeated,
14.
Contrary to Article 15 (1), in conjunction with Annex III, point 1.10. Sentence 1 shall not ensure that an animal is not tied up in the manner referred to therein or that its legs are not bound together; or
15.
, contrary to Article 15 (1), in conjunction with point 2.4 of Annex III, it does not ensure that a quarantine bay is established.
(4) Contrary to Council Regulation (EC) No 1099/2009 of 24 September 2009 on the protection of animals at the time of killing (OJ L 393, 30.12.2009, p. 1), by intentionally or negligently
1.
, contrary to Article 7 (2) (b), (c), (d), (e), (f) or (g), does not ensure that the activity is carried out only by a person who has a proof of professional competence referred to therein,
2.
does not ensure, contrary to the first sentence of Article 9 (1), that a device referred to in that paragraph is maintained or controlled;
3.
Contrary to Article 14 (1), in conjunction with Annex II, point 4.1. Sentence 1 shall not ensure that an electrostunning device is equipped in the manner prescribed therein,
4.

Section 17 Transitional provisions

(1) The provisions of Sections 6, 7 (1) and 2 (1) and 14 shall not apply to slaughterhouses or parts of slaughterhouses until 8 December 2019, to the extent that they have been put into service before 1 January 2013. Derogations and additional provisions concerning the permitted stunning procedures in accordance with Annex I to Regulation (EC) No 1099/2009

1.
Bolzenshot
1.1
By way of derogation from Annex I, Chapter I, Table 1 (1) of Regulation (EC) No 1099/2009, the penetrating Bolt Committee shall:
1.1.1
in the case of pigs, only for slaughter in emergencies and with the consent of the competent authority for the stunning or killing of pigs which are kept outdoors throughout the year, as well as in the case of house slaughterings and as a substitute procedure for the duration of a Repair in the case of electrical or carbon dioxide stunning systems,
1.1.2
in the case of gunmen, only for the slaughter or emergency slaughter of fixed animals or with the consent of the competent authority, if a shooting permit cannot be issued for safety reasons,
1.1.3
not in fur animals
shall be applied.
1.2
When the bolt is penetrated, the device must be set in such a way and the size and the impact energy of the bolt must be dimensioned in such a way that the bolt penetrates into the brain with certainty. It is forbidden to shoot animals in the back of the head. Sentence 2 shall not apply to ovine and caprine animals, to the extent that the application of the scouting apparatus on the front of the head is impossible due to the horns; the shot must be placed in the centre of the head directly behind the base of the horn towards the mouth. The bolt shot apparatus may only be used if the bolt has been completely inserted into the shaft before the shot.
1.3
By way of derogation from the provisions of the third sentence of Article 4 (1) of Regulation (EC) No 1099/2009, the penetrating bolt shot may only be used in the case of killings without a blood withdrawal if the spinal cord is destroyed or carried out following the bolt-shot. electrical cardiac flow is caused by cardiac arrest.
1.4

2.
Ball shot
2.1
By way of derogation from Annex I, Chapter I, Table 1 (3) of Regulation (EC) No 1099/2009, the gunfire may be carried out using a firearm

in the case of solipeds, cattle, sheep, goats, swine, poultry and rabbits, only for emergency rescue,
2.1.2
only with the consent of the competent authority for the stunning or killing of bovine animals kept open all year round,
2.1.3
not in fur animals,
2.1.4
not in fish and crustaceans
shall be applied.
2.2
The shot shall be placed on the head of the animal in such a way that the projectile shall have such a caliber and an impact energy such that the animal shall be immediately stunned and killed.
2.3
Gown game must be stunned and killed only with buckling cartridges with a calibre of at least 6.5 millimetres and an impact energy of at least 2 000 Joules per 100 metres. The first sentence shall not apply to the fishing shot, provided that it is required and that it is carried out with gun or turret shot with a mouth energy of at least 200 Joules.
2.4
By way of derogation from the first sentence of point 2.3, the fallow deer shall also be stunned and killed in enclosures with box cartridges of a calibre of at least 5.6 millimetres and a mouth energy of at least 300 joules, provided that:
2.4.1
the weft removal is less than 25 metres,
2.4.2
the shot is delivered from a high level of up to 4 meters high and
2.4.3
the high level is situated in a closed enclosure with an unattached bottom, the fenced area of which is at least 1.80 metres high.
3.
Crushing
3.1
By way of derogation from Annex I, Chapter I, Table 1, point 4 of Regulation (EC) No 1099/2009, the reduction may be applied only in the case of chicks and in the case of chicks which are not capable of being slid.
3.2
In addition to the requirements for shredding in accordance with Annex I, Chapter I, Table 1, point 4, in conjunction with Chapter II, point 2 of Regulation (EC) No 1099/2009, chicks and hatching residues shall be supplied to the apparatus in such a way that each animal supplied shall be subject to the following conditions: is killed immediately.
4.
Genickbruch

By way of derogation from Annex I, Chapter I, Table 1, point 5, to Regulation (EC) No 1099/2009, for poultry only outside slaughterhouses, in the case of emergency operations referred to in Article 2 (d) of Regulation (EC) No 1099/2009, and only in the case of Connection to anesthetic is carried out.
5.
Blunt blow to the head
5.1
By way of derogation from Annex I, Chapter I, Table 1, point 6, of Regulation (EC) No 1099/2009, a blunt blow to the head shall be permitted.
5.1.1
in the case of piglets, sheep and goat lambs only outside slaughterhouses, only up to a live weight of 5 kilograms and only in the individual cases in which no other stunning methods are available and in which the stunning and bleeding of the animals is is made by the same person,
5.1.2
for the stunning of chicks and non-slippery chicks only in the case of not more than 50 animals per holding and day,
5.1.3
not in fur animals
shall be applied.
5.2
By way of derogation from Annex I, Chapter I, Table 1, point 6, in conjunction with Chapter II (3) of Regulation (EC) No 1099/2009, the blunt blow to the head shall be classified as a simple stunning method. The blunt impact on the head is to be carried out with a suitable object and sufficiently strong. A process leading to death must be carried out immediately thereafter.
5.3
When the blunt impact on the head for anaesthesia is applied in accordance with point 9.2, the length of time between the catch and the stunning shall be kept as short as possible. Number 5.2 shall apply accordingly.
6.
Electrostunning
6.1
By way of derogation from Annex I, Chapter I, Table 2 (1) and (2) of Regulation (EC) No 1099/2009, solipeds, chicks, gunmen and fur animals may not be electrically stunned.
6.2
In the case of electrostunning or killing, the brain has to be flowed through first or at least simultaneously with the body. For a good flow of electricity through the brain or the body of the animal is to be ensured, especially if necessary, by moistening the skin of the animal. In the case of automatic stunning, the electrode adjustment must be adapted to the size of the animals; if necessary, the animals shall be pre-sized according to their size.
6.3
In the case of electric stunning, the minimum current intensity shall be as set out in Annex I, Chapter II, point 4.2. Table 1 of Regulation (EC) No 1099/2009 is reached within the first second. By way of derogation from Annex I, Chapter II, point 4.2. Table 1 of Regulation (EC) No 1099/2009 is the minimum current level for cattle 2.5 ampere (A) for at least six months old. For rabbits, the minimum current intensity is 0.3 A and for ostrich birds 0.5 A.
6.4
Except in the case of high-voltage stunning, the minimum current strength must be maintained for at least 4 seconds. The minimum current strengths and current flow times are based on rectangular or sinusoidal alternating currents of 50 to 100 Hertz (Hz); the same applies to pulsating direct currents, rectified alternating currents and phase-controlled alternating currents. Currents, provided that they do not differ significantly from Sinus 50 Hz.
6.5
In the case of bovine animals over six months and in the case of killings without a blood withdrawal, a cardiac arrest must be caused following anaesthesiration by an electrical heart flow lasting for at least 8 seconds. By way of derogation from the first sentence, a full-body flow can be carried out in poultry.
6.6
In addition to the requirements for the stunning of poultry in the electric water bath in accordance with Annex I, Chapter II, point 6 of Regulation (EC) No 1099/2009, the minimum current intensity of the first poultry in the water bath must be the minimum current level within the first Second. By way of derogation from Annex I, Chapter II, point 6.3. in conjunction with Table 2, line 2, of Regulation (EC) No 1099/2009, the minimum current intensity in the case of slaughter with blood withdrawal for chickens is 120 milliampere (mA) and 60 mA for quails. 6.7
The effect of electric shocks on the animal before anaesthesiration is to be avoided.
6.8
The plant for electrostunning must have a device which allows the connection of an external device to display the stunning voltage and the stunning current intensity.
6.9
In abattoirs, the electrical stunning plant, which is not anesthetized in the water basin, must be equipped with a device which prevents the stunning voltage from being switched to the electrodes when the measured resistance is applied to the electrodes. between the electrodes is outside the range where the required minimum current flow can be reached, and the performing person indicates faulty anaesthesiration with respect to the flow of the current.
6.10
In the stunning of fish in water bath stunning systems, the electrodes must be so large and so arranged that a uniform electrical flow through the fish is ensured in all areas of the stunning plant. Fish and electrodes must be completely covered with water.
6.11
In the electrostunning of eels, drinking water with an electrical conductivity of less than 1 000 microsiemens per centimeter (microS/cm) is to be used. Before commencement of stunning, the electrical conductivity of the water in the stunning plant shall be measured and the current density required for anaesthesiration shall be adjusted. For this purpose, the applied voltage is to be adjusted in such a way that an alternating current in amperes per square decimeter flows between the electrodes (A/qdm), which is the one shown in the following table for the measured electrical current. Conductivity specified corresponds to the current density:

The stunning stream must flow for at least 5 minutes. Immediately after completion of the flow, the eels are to be unveil and slaughtered.
7.
Carbon dioxide stunning
7.1
By way of derogation from Annex I, Chapter I, Table 3 (1) of Regulation (EC) No 1099/2009, fur animals must not be stunned with carbon dioxide.
7.2
The carbon dioxide concentration required for the stunning of pigs required in accordance with Annex I, Chapter I, Table 3, point 1, in conjunction with Chapter II, point 7 of Regulation (EC) No 1099/2009, shall be at the first stop and at the last stop before the ejection in the Carbon dioxide stunning plant at head height of the animals is guaranteed.
7.3
The chamber in which the pigs are exposed to the carbon dioxide must be equipped with devices for measuring the gas concentration at the first stop and at the last stop before ejection.
7.4
Pigs must reach the first stop at least 30 seconds after the introduction into the stunning plant.
7.5
For the purpose of stunning, pigs must remain at least 100 seconds in the carbon dioxide concentration referred to in Annex I, Chapter II, point 7 of Regulation (EC) No 1099/2009, for at least 10 minutes for killing without a blood withdrawal.
7.6
The dusting systems for pigs shall meet the following requirements:
7.6.1
the entry into the means of transport must be ground-free and free of swelling and falseback;
7.6.2
The transport device and the chamber must be illuminated with indirect light in such a way that the pigs can see their surroundings;
7.6.3
the chamber must be visible at the stopping height of the conveying device.
7.7
The transport facilities shall be loaded with at least two pigs.
7.8
The pigs must be able to stand upright and on solid ground without any constriction of the chest until they lose consciousness.
7.9
By way of derogation from Annex I, Chapter I, Table 3 (1) to (4) of Regulation (EC) No 1099/2009, chickens, turkeys, guinea fowl, pigeons and quails, including chicks, may be killed by carbon dioxide in other cases than slaughter only by: Animals are introduced into a gas atmosphere with a carbon dioxide concentration of at least 80% by volume, produced from a source of 100% carbon dioxide, and at least 10 minutes by the time of their death, remaining. Before the animals are introduced, the gas concentration must be checked. Live animals must not be placed on top of each other.
7.10
By way of derogation from Annex I, Chapter I, Table 3 (1) to (4) of Regulation (EC) No 1099/2009, only pigs and turkeys may be stunned for the purpose of slaughter with carbon dioxide.
8.
Carbon monoxide anaesthesia
8.1
By way of derogation from Annex I, Chapter I, Table 3 (5) and (6) of Regulation (EC) No 1099/2009, only fur animals with carbon monoxide may be stunned and killed.
8.2
In addition to the requirements for stunning of carbon monoxide in accordance with Annex I, Chapter I, Table 3, points 5 and 6, in conjunction with Chapter II, point 9 of Regulation (EC) No 1099/2009, animals shall be allowed to use carbon monoxide only from a source of: are exposed to 100% carbon monoxide. They must be introduced freely movably into the stunning chamber.
9.
Anaesthesiology for fish

For the stunning of fish, the following procedures shall be permitted:
9.1
electro-stunning,
9.2
blunt blow to the head,
9.3
Carbon dioxide exposure in salmonids,
9.4
Administration of a substance with anesthetic effect, with the exception of substances such as ammonia, which simultaneously serve to abmucus.
