§ 1 Electoral bodies

Electoral bodies within the meaning of § 53 (1) sentence 1 of the Fourth Book of the Social Code are
1.

the election committees of the insurance institutions, district administrations or national offices which form their own bodies (electoral committees),
3.
the Federal Electoral Committee and the Land Electoral Committees (Complaints Committee Committees),

§ 2 Electoral Officer

(1) The electoral officers and their alternates shall each have the effect of 1. § 3 Electoral Committees

§ 4 Board of Appeal Committees

(1) The Federal Ministry of Labour and Social Affairs shall appoint a Federal Electoral Committee at the seat of the Federal Electoral Officer for the Social Security Elections and shall appoint the body responsible for the conduct of its business. The supreme administrative authority of each country shall appoint a Land Electoral Committee at the seat of the Land Electoral Officer for the social security elections and shall designate the body responsible for its operations. § 5 Election Lines

(1) The electoral committee shall appoint or carry out its duties on postal ballot lines. § 6 Compensation of electoral officers

§ 7 Compensation of the members of the electoral committees

§ 8 Compensation of the members of the Board of Appeal Committees

§ 9 Compensation of the members of the electoral boards and other electoral helpers

§ 10 Election Day, WahlanAnnunciation

Section 11 Procedure for the early determination of the right of proposal

(1) In the application for the award of the right of proposal pursuant to § 48b (1) sentence 2 of the Fourth Book of the Social Code, the Electoral Committee shall be given the facts from which the right of the association is to be obtained. The applicant shall in particular:
1.
the name and abbreviation of the association, as they result from the register of registered associations or otherwise from the articles of association;
2.
the founding date of the association;
3.
the names, addresses and dates of birth of the members of the Management Board,
4.
whether the association fulfils the conditions of labour law for trade union property (§ 48a (1) sentence 1 first alternative to the Fourth Book of the Social Code) or which other social or professional-policy purpose the association and in what way it has actually persecuted it in detail (§ 48a (1) sentence 1 second alternative and sentence 2 of the Fourth Book of the Social Code),
5.
whether, and in what way, other persons, as employees in the association, can take decisive influence, through their share in the number of members, by representation on the board of directors or in any other way,
6.
where, in the name of the association, a particular group of persons is mentioned as to whether and in what way other persons can influence the relevant influence by their share in the number of members, by representation on the board of directors or in any other way,
7.
whether the association consists of more than 25 of the hundreds of staff of the insurance institution, whether the staff of the insurance carrier on the board of the association have a voting share of more than 25 per cent and whether and in what other way the the employees of the insurance institution have not been given insignificant influence,
8.
whether the association had, from the beginning of the calendar year prior to the calendar year of the electoral tender, a permanent number of members with a number of contributing members, which had at least half of the required number of members required pursuant to section 48 (2) of the Fourth Book of Social Law the number of articles,
9.
the level of the membership fees fixed,
10.
whether the actual contribution income of the association is at least equal to the contribution amount to be paid by the number of members required under section 48a (4) sentence 1 of the Fourth Book of the Social Code,
(2) The application for the determination of the right of proposal shall be accompanied by the association's statutes and a copy of the minutes of the last meeting of the Members or Delegates. the other persons and associations entitled to complain pursuant to section 48b (3) of the Fourth Book of the Social Code, who have requested notification of the decisions no later than one week after the meeting of the Election Committee,
shall be notified immediately in writing of an appeal for appeal. Section 12 Procedure for the determination of the general right of proposal

Section 13 Complaint in the case of the arrest procedure

Section 14 Election Committee

Section 86 Reimbursement of expenses in appeal proceedings

(1) In accordance with § § 13 and 24, the appellant shall be obliged to reimburse the insurance institution with the necessary expenses. Section 87 Costs of the Board of Appeal Committees

(1) The costs incurred by the appointment of the Federal Electoral Committee and its activities shall be borne by the federal insurance institutions for which an election with a ballot has taken place or which is involved in a complaint procedure according to the ratio of the number of insured persons entitled to vote. Section 93 Elections in special cases
