General provisions

§ 1 Scope

§ 2 Definitions

(1) For the purposes of this Regulation, the definitions of rules 3, 21 and 32 of the conflict prevention rules shall apply; in other respects, for the purposes of this Regulation:
1.
Parts of the water which are bounded or marked by points of sight B.11 and B.13 of Appendix 1 or which, if not, are defined on inland waterways for continuous navigation; the Water shall be considered to be close to the water in the sense of the rules on conflict of contraception;

19.
Visual signs of vehicle lights, signal bodies, flags and panels;
20.

22.

§ 3 Basic rules for behaviour in transport

§ 4 Responsibility

§ 5 Shipping signs

Section 7 Vehicles of the public service

(2) The minimum scope of all the lights prescribed in this Regulation for vehicles and exceptional floating bodies shall comply with the requirements of Rule 22 of the Collision Prevention Rules. § 9 Use of position lanterns and sound signalling systems

§ 21 Principles

(2) The use of the anchor for maneuvering purposes shall not be considered as a anchorage. (1) The handling of certain dangerous goods (§ 2 para. 1 no. 16) is only permitted on the reeden and recumbings provided for this purpose in accordance with § 60 para. 1 and only in compliance with the conditions made known. The envelope shall be notified to the competent shipping office in good time. (2) During the cover, only one vehicle involved in the envelope shall be allowed to be placed on each side of a vehicle carrying certain dangerous goods. § 37 Behaviour in the case of shipping accidents and in the event of loss of objects

(1) In the event of danger of sinking, the vehicle shall be able to be created as far as possible from the running water, that the shipping is not impaired. After a collision, the driver of a vehicle, who is in a swimming capacity, is also obliged to do so. (2) The condition of the shipping lane required for shipping or the safety and lightness of the traffic is carried out by

in the shipping lane, helpless driving, stranded, stranded or sunken vehicles, floating installations or exceptional floating bodies, or other driving or ground-based objects, or

Section 38 Exerciseof fishing and hunting

The fishes for certain types of fishing, shooting or hunting are prohibited on the water surfaces published in accordance with section 60 (1). In the case of vehicles of the professional fishing industry, the ban on the anchorage shall not apply in the water, except for the water areas which have been disclosed in accordance with the first sentence. Section 39 timetables for passenger ships and ferries

(1) Passenger ships and ferries may only carry out passenger transport services from landing sites which are approved or lawfully available pursuant to Section 31 (1) (2) and (3) of the Federal Waterway Act. The rules on authorisations, permits and permits for the installation of landing places, passenger ships and ferry services shall remain unaffected. Section 40 Co-operation of documents

The ship ' s guide of an inland waterway vessel shall ensure that there is an imprint of this Regulation and of the 1972 Regulation on the prevention of collisions at sea on board the vehicle. Section 41 Scope

In addition to the other provisions of this Regulation, the North Sea-Baltic Canal and its access roads are subject to the provisions of this section, in particular to those laid down in § 23 (3) and (5), § 24 (4), § 29 (2) and § 32 (1) No. 5 Special provisions for the North Sea-Baltic Sea Canal. Section 42 Approval

(1) The North-Baltic Sea Canal may only be used by vehicles, as well as by thrust and towing associations, if:
1.
the dimensions specified in section 60 (1) shall not be exceeded;
2.
the stability and maneuverability is guaranteed,
3.
that the rudder position indicator is sufficiently illuminated,
4.
do not project any objects beyond the side of the board and
5.
the safety and ease of transport is not adversely affected in any other way.
This shall apply in respect of floating equipment and floating installations. (2) In the case of trawls, it must be ensured that a speed of 9 kilometres (4.9 nautical miles) can be maintained at the hour and that at least one of the following shall be at least (3) Vehicles carrying certain dangerous goods (§ 2 para. 1 no. 16) shall be notified as such at the latest when registering in accordance with § 43. This does not apply to war vehicles. Vehicle drivers of erased tankers shall submit a written declaration on the vehicle's freedom of gas with the notification. (6) Vehicles which do not comply with the conditions laid down in paragraphs 1 to 5 may refuse or impose conditions on the competent water and shipping authority. Section 43 Registration and logout

Section 45 Transport in the access roads

The access roads may only be used by vehicles entering or leaving the North Sea-Baltic Canal. This shall not apply
1.
for vehicles on the route from and after the transhipment point at the Schleusenvorhafen Kiel-Holtenau,
2.
for passenger ships on the route from and to the landing stage in Kiel-Holtenau,
3.
for sports vehicles on the routes to and from the approved recumbering sites;
4.
for vehicles of the electricity and shipping industry, pilotage vehicles and approved tugs.

Section 46 Entrance during entry into the locks and during the run-out

(1) By way of derogation from Rule 9 (b) to (d) and Rules 15 and 18 (a) to (c), the rules contained in the subsequent paragraphs shall apply to the conflict prevention rules. (2) In Kiel-Holtenau, those rules shall apply to the New Lock Vehicles running in front of the vehicles running out of the old lock. In Brunsbüttel, the vehicles running out of the airlock ports in the access road have a journey towards the vehicles entering this area. § 47 Prohibition of the entry into the locks and the discharge

§ 48 Fahrabstand

(1) Outside the mollusc areas and locks of the Kiel Canal, with the exception of an area of 1000 metres before and 2000 metres behind the boundaries of the Vistemic Areas, vehicles
1.
transport groups 1, 2 and 3 shall be at a distance of at least 600 metres,
2.
of transport groups 4 and above a distance of at least 1000 metres
to be complied with by a vehicle ahead of the vehicle, unless the vehicle is overhauled in accordance with Article 23 (4) and (5). (2) The minimum distance prescribed for vehicles of less than 20 metres in length may be less than the prescribed minimum distance. Unofficial table of contents

§ 49 Behaviour before and in the Vistemic Areas

(1) The mollusc areas are to be rapidly entered. Section 50 Rules relating to drivers and towing and towing associations

(1) In the case of reduced visibility on the Kiel Canal, free drivers are only allowed to drive if:
1.
the radar is working properly and
2.

Section 51 Rules relating to the driving of sports vehicles

(1) Sports vehicles may use the access roads and the Kiel Canal only for passage through, only during the daytime running times within the meaning of § 50 para. 2 and not in the case of reduced visibility. This does not apply to the acceptance of a pilot or to the search for berths approved for sports vehicles at the Kiel-Holtenau airport and in the inland port of Brunsbüttel or the floodgates registered at the Schleusenmeister on the Elbe. Section 55 Maritime tspolizei

(1) Shipping authorities shall be the North and Northwest Water and Shipping Directorates and their downstream water and ship offices; they shall operate in accordance with the agreements concluded between the Federal Government and the Länder on the Exercise of the maritime policy functions of the Water Protection Police of the Coastal Countries as well as in accordance with § 3 (2) of the Law of the Federal Police and the Customs Administration. (2) Local measures of the shipping police meet the Water and shipping offices. If a measure has an effect beyond the district of a water and shipping office, the office in whose district the facts to be regulated enters first shall be the responsibility of that office. By way of derogation from this, the competent authority for water and shipping may delegate responsibility for certain tasks relating to the shipping industry to a specific water and shipping office on a seagoing ship road. If a measure has an effect beyond the district of a water and shipping directorate, the Water and Shipping Office of the Water and Shipping Directorate is responsible, in the district of which the facts to be regulated enter first. If a measure is of fundamental importance, it shall meet the competent water and shipping directorate. Section 56 Ships in the Maritime Shipbuilding Industry

(1) In order to carry out the tasks set out in Section 3 of the Law on Maritime Affairs, the shipping authorities may issue orders addressed to certain persons or to a particular group of persons and containing a bid or prohibition (2) The provisions of this Regulation and the arrangements made by means of shipping signs shall be adopted in the form of provisions relating to the shipping policy. Section 57 Shipowners ' licences

(1) Approval of the water and shipping office responsible pursuant to section 55 (2) shall be subject to a ship-to-ship-day approval
1.
The traffic of exceptionally large vehicles, of air-cushion, airborne and ground-effect vehicles, of high-speed craft and of watercraft and aircrafts, outside approved airfields in accordance with § 6 of the Air traffic law and external starting and landing sites according to § 25 of the Aviation Act,
2.
the traffic of exceptional thrust and towing associations as well as the towing of extraordinary floats,
3.
Batch purchases,
4.
the recovery of vehicles, exceptional floats and objects, in so far as the safety and ease of transport may be compromised or a danger to the marine environment may arise; this shall not apply where the recovery is carried out by: the Maritime Safety Authority has been ordered,
5.
the testing and testing of the tractive force of vehicles, as well as stand samples, which may affect the safety and ease of transport,
6.
water sports events on the water,
6a.
Parasailing,
7.
Other events on or on maritime routes which may affect the safety and ease of transport or pose a risk to the marine environment.
(2) The authorisation shall be requested in good time. (3) The authorisation may be granted subject to conditions and conditions which:
a)
prevent and compensate for the safety and lightness of transport; or
b)
prevent the harmful environmental effects of the shipping industry within the meaning of the Federal Immission Control Act, or
c)
that prevent or eliminate the risk to the marine environment.

Section 58 Shipowners ' reports

(1) The drivers of vehicles, thrust and towing associations which exceed the dimensions and sizes made known in accordance with section 60 (1), as well as of vehicles within the meaning of section 30 (1) shall have the traffic control centre made known in accordance with section 60 (1) to report the following information:
1.
if the notification of the following information has not already been made pursuant to section 1 (1) in conjunction with point 2.6 of the annex to § 1 para. 1 of the start-up condition regulation, in good time before the date of the date of the date of the entry into force of the information provided pursuant to § 60 (1) Maritime routes:
a)
Name, distinguishing signal, IMO ship identification number where applicable, or Maritime Mobile Service Identity (MMSI) number and type of vehicle,
b)
the position of the vehicle,

f)
Indication of whether dangerous or polluting goods are transported within the meaning of the Appendix to § 1 (1) of the Start-up Condition regulation,
g)
declaration as to whether there are any deficiencies in ship or cargo; and
h)
Total number of persons on board;
2.
during the further journey in the case of the positions announced pursuant to section 60 (1):
a)
The name and the distinguishing signal of the vehicle,
b)
the position of the vehicle,
c)
speed of the vehicle and
d)
the passing time of the vehicle;
3.
Interruption and continuation of the journey.
(2) Upon submission of the first notification, the leader of a vehicle as referred to in paragraph 1 shall be constantly responsive to the FM channels made known in accordance with § 60 (1) and, if technically feasible, to VHF channel 16. (3) Ships equipped with AIS and are located in an area made known in accordance with section 60 (1), the skipper shall submit the reports referred to in paragraph 1 (1) (1) and (2) above AIS. Section 60 authorizing the adoption of announcements and legal regulations in the field of shipping

(1) The North and Northwest Water and Shipping Directorates shall be empowered, each for their area of responsibility, to adopt the notices provided for in the preceding provisions, if and to the extent to which they are intended to prevent risks to the the safety and ease of transport, the prevention of hazards to the marine environment or the prevention of harmful environmental impacts arising from the navigation of the marine environment, as defined by the Federal Immission Control Act. The notices are to be published in the Federal Gazette. (2) The North and Northwest Water and Shipping Directorates are empowered, each for their area of responsibility, to impose legal regulations on the limitation of military and civilian (3) The North and Northwest Water and Shipping Directorates are empowered, each for their area of responsibility, by means of a legal order temporary with a period of validity of not more than three years on special occasions for the safety and ease of transport on the maritime routes, the prevention of risks to the marine environment or the prevention of harmful environmental effects of shipping in the The meaning of the Federal Immission Control Act is required. § 61 Administrative Offences

(1) Contrary to the provisions of Section 15 (1) (2) of the Law on the Law of the Sea or in the sense of Section 7 (1) of the Act on Inland Waterways, who intentionally or negligently
1.
Contrary to the first sentence of Article 3 (1), it does not act in such a way that no other person is injured, endangered or more than is unavoidable, obstructed or harassed in the circumstances,
1a.
Contrary to § 3 (3), a vehicle or another activity of the bridge, decking or machinery service is carried out by means of a water-powered motorcycle, a kite-surfboard or a sailing surfboard, although it is caused by physical or mental defects or by the the consumption of alcoholic beverages or other intoxiating means in the safe management of the vehicle or in the safe pursuit of the activities of the bridge, decking or machinery service is impeded;
1b.
Contrary to § 3 (4), a vehicle or another activity of the bridge, decking or machinery service is carried out with a water motorcycle, a kite surfboard or a sailing surfboard, although it is 0.25 mg/l or more of alcohol in the breathing air or 0.5 if you have a promille or more alcohol in your blood or an amount of alcohol in your body, which leads to such a concentration of breath or blood alcohol,
1c.
Contrary to Article 3 (5), during the journey, alcoholic beverages shall be accepted or shall be under the effect of such beverages at the time of service,
2.
the provision of Article 4 (2) concerning the guidance of the management of the ship or the provisions of paragraph 4 relating to the determination of the responsible driver of the vehicle shall be contrary to the provisions of paragraph
3.
contrary to Article 5 (2), an order made by means of a bid or prohibition mark is not followed,
4.
Contrary to § 5 para. 3, ship signs are damaged or impaired in their recognizability,
5.
a provision in § 6 on the use of the visual signs, sound signals, lanterns, lamps or headlights, the equipment with sound-signalling systems or the guarantee of their effectiveness or operational safety;
6.
a provision in § 8 on the carrying out or affixing, the field of vision, the scope or the nature of the visual signs,
7.
Contrary to Section 9 (1) sentence 1, position lamps or sound-signalling systems which are not approved by the Federal Maritime and Hydrographic Office, contrary to the second sentence of paragraph 1, shall not be used for proper repair or replacement, or not in good time, contrary to the provisions of the first sentence of paragraph 2, the non-electrical position lamps shall be used, contrary to paragraph 4, sentence 1, other than the position lamps listed there or approved in accordance with the rules on contraception, or contrary to paragraph 4 Sentence 2 does not provide for proper repair or replacement, or does not provide for in time,
8.
a provision in accordance with Article 10 (1), (2) and (5) relating to the driving of visual signs or the driving ban referred to in paragraph 3;
9.

a provision of section 35 on the anchorage, the arrest, the holding of a security clearance, the presence of equipment for protection against sparking, and the vehicles carrying certain dangerous goods, the Longitudinal seizus of such vehicles or the catching-up are contrary,
16.
a provision of section 36 on the handling of certain dangerous goods or the display of the envelope;
17.
a provision in § 37 on the conduct of accidents in the event of accidents or the loss of objects, as well as the notifying in the event of fire or other incidents which endanger the safety and lightness of the traffic,
18.
a provision in § 38 on fishing, shooting or hunting;
19.
a provision of section 39 on passenger and ferry services,

Contrary to the first sentence of Article 40, the ship's guide shall not ensure that there is an imprint of the regulations referred to therein,

the Nord-Ostsee-Kanal with a vehicle that does not meet the requirements of § 42 para. 1,
