§ 1 Full application ban

Plant protection products consisting of a substance listed in Appendix 1 or containing such a substance may not be used. Unofficial table of contents

§ 2 Limited Use Ban

Plant protection products consisting of a substance listed in Appendix 2 or containing such a substance may only be used, to the extent permitted by column 3. Unofficial table of contents

§ 3 Application Restrictions

(1) Plant protection products consisting of or containing a substance listed in Annex 3 (A) may not be used, to the extent that this is prohibited by column 3. (2) Plant protection products derived from a plant protection product listed in Annex 3 Section B shall consist of or contain such a substance, shall not be used in water protection areas and health-source protected areas, unless:
1.
it follows from column 3, or
2.
the plant protection product is placed on the market in weed sticks, ready for use in spray cans, for use after addition of water in manual atomizers, or as chopsticks or fences for use in potted plants, or
3.
an application is expressly permitted under the protection scheme.
The competent authority may order plant protection products consisting of or containing a substance listed in Annex 2 (2), (2), (3) and (5) or in Annex 3 (B), also outside water protection areas, and Healing source protection areas in defined areas
1.
Catchment areas of drinking water extraction plants or mineral springs, or
2.
other areas for the protection of groundwater

§ 3a Special discharge conditions

plant protection products consisting of a substance listed in Appendix 4 or containing such a substance and intended for use on a field of free land which is not used for agricultural, forestry or gardening purposes; may be delivered to another person only if a prior authorisation has been submitted to the transferor in accordance with Section 12 (2) of the Plant Protection Act. § 4 Prohibition of use in protected areas and national parks

Plant protection products consisting of or containing a substance listed in Appendix 2 or 3 may be used in nature reserves, national parks, national natural monuments, natural monuments and legally protected biotopes in the sense of § 30 of the Federal Nature Protection Act (Bundesnaturschutzgesetz) shall not be applied unless an application is expressly permitted under the protection regime or the nature protection authority expressly permits the application. § 5 Import prohibitions

(1) planting material in or on which a plant protection product consisting of a substance listed in Appendix 1 or containing such a substance may not be introduced. (2) Saat or planting material or culture substrate, in or on the A plant protection product consisting of a substance listed in Appendix 2 or containing such a substance may not be imported. This shall not apply to the extent to which, in accordance with Annex 2, column 3, the use of the substance for the treatment of the seed or planting material or crop substrate is expressly permitted and does not require the consent of the competent authority. § 6 impurities

In the context of § § 1 to 4, minor contamination with substances listed in the plants shall not be taken into consideration, insofar as this does not prevent the protection of human health or the prevention of hazards, in particular: for the health of humans and animals and for the natural environment. § 7 Exceptions

(1) The Federal Office for Consumer Protection and Food Safety may apply the use of plant protection products outside water protection areas and health-source protection areas, as well as the import of seed or planting material or culture substrate in By way of derogation from § § 1 to 3 and 5, individual cases may be approved for research, examination or testing purposes. (2) The competent authority may authorise in individual cases that:
1.
in greenhouses or similarly closed systems, by way of derogation from
a)
§ 2 Plant protection products derived from a substance listed in Appendix 2, which must not be used in water protection areas or health-source protected areas,
b)
Section 3 (2) Plant protection products derived from a substance listed in Annex 3 (B)
or containing such a substance, to be used in a water protection area or a health protection area where it is ensured by means of protective measures that the plant protection products or their degradation products are not quenched, or can seep into the earth;
2.
by agreement with the competent authority under water law, by way of derogation from
a)
§ 2 Plant protection products derived from a substance listed in Appendix 2, which must not be used in water protection areas or health-source protected areas,
b)
Section 3 (2) Plant protection products derived from a substance listed in Annex 3 (B)
shall be applied in a water protection area or a health protection area where it is ensured that this will protect the health of humans and animals and the protection of groundwater and the protection of groundwater and the protection of the environment, Natural budget is not affected.

§ 8 Crime offences and administrative offences

(1) In accordance with Section 69 (1) (2) (6) of the Plant Protection Act, the person who applies a plant protection product in breach of § 1 shall be punished. (2) Disciplinary action in accordance with Section 68 (1) (3) (a) of the Plant Protection Act shall be punishable as a result of deliberate action. or negligently, in contrast to § 3a, a plant protection product. § 9 Applicability of regulations

Points 1a, 5a and 7 of Appendix 3, Section A, shall no longer be applicable from 31 May 2016. Unofficial table of contents
