On the basis of § 8 of the Health Care Act of 16 July 2003 (BGBl. I p. 1442), the Federal Ministry of Health and Social Protection, in agreement with the Federal Ministry for Family Affairs, Senior Citizens, Women and Youth, and in consultation with the Federal Ministry of Education and Research, is responsible for:

Section 1
Training and general examination regulations

§ 1 Structure of training

(1) The training in health and nursing care, health care and paediatric care shall comprise at least the theoretical and practical teaching of 2 100 hours and the practical courses listed in Appendix 1. Training of 2 500 hours. The training consists of a 1 200-hour-wide differentiation phase in the classroom and in practical training, which is based on the skills to be provided for health and nursing care or health care and paediatric care. (2) In the classroom, pupils must be given sufficient opportunity to develop and practise the necessary practical skills and skills. § 2 Practical training

(1) During the practical training in accordance with § 1 (1), the knowledge and skills required to achieve the training objective in accordance with § 3 of the Nursing Act are to be provided. It is an opportunity to deepen the knowledge acquired during teaching and to learn to apply them in the course of their subsequent professional activities. (2) The practical training institutions provide practical training for the pupils. Pupils in accordance with § 4 (5) sentence 3 of the Nursing Act are safe by suitable specialists. The task of the practice guidance is to gradually lead the pupils to the independent perception of the professional tasks and to ensure the connection with the school. To this end, it is necessary to ensure an adequate ratio between the number of pupils and the number of practical guides in the respective area of application in accordance with Annex 1 (B). Persons with a permit pursuant to § 1 (1) sentence 1 (1) or (2) of the Nursing Act, who have a professional experience of at least two years as well as an additional vocational education qualification in the scope of the practical guidance at least 200 hours. The competent authority may, up to five years after the entry into force of this Regulation, authorise derogations from the scope of the supplementary vocational education and training qualification. In so far as the training takes place in nursing facilities in accordance with § 71 of the Eleventh Book of Social Code, the second sentence of the second sentence of § 2 (2) of the Elder Care Training and Examination Ordinance applies. (3) The schools provide the practical support of the Pupils in the institutions of practical training in accordance with § 4 (5) sentence 2 of the Nursing Act are certain. § 3 State Examination

(1) The state examination for the training in accordance with § 1 (1) shall include a written, oral and practical part. (2) The examinee shall submit the examination at the school in which he concludes the training. The competent authority in whose area the examination or part of the examination is to be filed may, for important reasons, allow for exceptions. § 4 Examination Committee

(1) At each school an examination board shall be formed, consisting of at least the following members:
1.
a suitably qualified representative or representative of the competent authority or of a suitably qualified person responsible for the performance of that task by the competent authority,
2.
the head of the school, or the head of the school,
3.
Specialist examiners who teach at the school and of which
a)
at least two teachers and
b)
a doctor or a doctor or a diploma in medicine pedagogue or a diploma in medical education
, and
4.
at least one specialist examiner, who is active as a practice manual in accordance with Article 2 (2), second sentence, second sentence.

§ 5 Approval for Examination

(1) The Chairman of the Audit Committee shall decide on the admission to the examination at the request of the examinee and shall set the examination dates in consultation with the school management. The start of the examination should not be less than three months before the end of the training period. (2) The admission to the examination shall be granted if the following evidence is available:
1.
the identity card or passport in an officially certified copy,
2.
the certificate in accordance with § 1 (4) concerning participation in the training events.
(3) The approval as well as the examination dates shall be communicated to the examinee in writing at the latest two weeks before the start of the examination. § 6 Niederschrift

"satisfactory" (3), if the performance in general meets the requirements,

"sufficient" (4) if the performance does not have any defects, but is still in accordance with the requirements,
-
"defective" (5) if the performance does not meet the requirements, but makes it clear that the necessary basic knowledge is available and that the deficiencies can be remedied in the foreseeable future,
-
"insufficient" (6), if the performance does not meet the requirements and even the basic knowledge is so patchy that the deficiencies cannot be remedied in the foreseeable future.

§ 8 existence and repetition of the examination

(1) The examination has been passed if each of the parts of the examination required pursuant to § 3 (1) has been passed. (2) A certificate shall be issued in accordance with the model of Appendix 3 on the state examination passed. In case of non-existence, the examinee receives a written notice from the chairman of the examination board, stating the examination notes. (3) Each supervisory work of the written examination, each subject area of the oral examination. The examination and the practical test may be repeated once the test item has received the grade "defective" or "insufficient". (4) If the test item has to repeat the practical part of the test or all parts of the test, it may be used for the examination of the test item. Repeat examination can only be admitted if he/she is involved in a further training , the duration and content of which shall be determined by the Chairman of the Audit Committee or the Chairman of the Audit Committee. The further training, including the time required for the examination, must not exceed the duration of one year laid down in § 14 para. 2 of the Nursing Act. A proof of further training must be attached to the application of the test specimen for approval for the reexamination. The re-examination must be completed no later than 12 months after the last examination, and the competent authority may allow exceptions in duly justified cases. Unofficial table of contents

§ 9 Resignation of the Examination

(1) If a test item returns after its admission from the examination or part of the examination, it shall inform the chairman of the examination board immediately in writing of the reason for his resignation. If the chairman approves the resignation, the examination or the corresponding part of the examination shall be deemed not to have been undertaken. The authorisation shall only be granted if there is an important reason. In the event of a disease, the submission of a medical certificate may be required. (2) If the authorization for the resignation is not granted or if the examinee fails to inform the reason for his resignation without delay, the following shall apply: Examination or the corresponding part of the examination as not passed. § 10 Follow-up

(1) If a test specimen fails a test date, he does not issue a supervisory work or does not terminate the examination in time or if he interrupts the examination, the examination shall be deemed not to exist if there is not an important reason; § 8 (3) shall apply accordingly. If there is an important reason, the examination or the relevant part of the examination shall be deemed not to have been made. (2) The decision as to whether there is an important reason shall be taken by the chairman of the examination board. The first sentence of Article 9 (1) and (4) shall apply accordingly. Section 11 Administrative infringements and attempts at deception

The chairman of the examination board, or the chairman of the examination board, may not, in the case of examinees who have seriously disturbed the proper conduct of the examination or have been guilty of deception, consider the part of the examination in question for not , Section 8 (3) shall apply accordingly. § 12 Examination documents

Examination regulations for training in health and nursing care

Section 13 Written part of the examination

(1) The written part of the examination shall cover the following subject areas of Appendix 1 (A):
1.
Recognize, record and evaluate nursing situations in people of all ages,
2.
select, perform and evaluate care measures,
3.
To align care products with care scientific knowledge, quality criteria, legal framework conditions as well as economic and ecological principles.
The examinee has to deal with these subject areas in a respective supervisory work in writing. The supervisory work lasts 120 minutes each. The written part of the examination shall be carried out on three days. The supervisors are appointed by the school board. (2) The tasks for the supervisory work are selected by the Chairman of the Audit Committee on the proposal of the schools. In the selection of tasks, the differentiation phase in health care and nursing care must be taken into consideration appropriately. Each supervisory work must be bended by at least two specialist examiners. From the grades of the specialist examiners, the chairperson of the examination board, in consultation with the specialist examiners, forms the note for the individual supervisory work. From the notes of the three supervisory work, the Chairman of the Audit Committee forms the examination note for the written part of the examination. The written part of the examination has been passed if each of the three supervisory work is at least "sufficiently" bended. Unofficial table of contents

Section 14 Oral part of the examination

(1) The oral part of the examination shall cover the following subject area of Appendix 1 (A):
1.
Provide support, advice and guidance in matters of health and care relevant to health and care,
2.
develop professional self-understanding and learn to cope with professional requirements,
3.
to participate in medical diagnostics and therapy and work together in groups and teams.
In the oral examination, the examinee has to prove application-ready vocational skills. The examination shall include the differentiation phase in health and nursing care as well as the knowledge bases referred to in Appendix 1 (A). (2) The test specimens shall be tested individually or in groups of up to four. The examination shall take at least 10 minutes and no more than 15 minutes for the individual test item for each subject area referred to in paragraph 1 (1) to (3). (3) The examination of each topic shall be carried out by at least two specialised examiners, or Specialist examiners have taken off and bended. A person in accordance with Article 4 (1) (3) (b) shall be required for the examination referred to in paragraph 1 (3) as a specialist examiner or examiner. The Chairman of the Audit Committee shall be entitled to participate in the examination on all subjects; it or he may also examine it. From the grades of the specialist examiners, the chairperson of the examination board, in consultation with the specialist examiners, forms the grade for the respective subject area. From the notes of the subject areas, the Chairman of the Audit Committee forms the examination note for the oral part of the examination. (4) The chairman of the examination committee may, with the consent of the examinee, the presence of audience members in the examination. permit an oral part of the examination if there is a legitimate interest. § 15 Practical part of the examination

(1) The practical part of the examination shall cover the care of a group of patients of not more than four patients. In the field of its differentiation area according to Appendix 1 (B), in which he participates in the practical training at the time of the examination, the examinee shall carry out all the tasks of a process-oriented care, including the Documentation and submission. In an examination interview, the examinee has to explain and justify his/her care trade as well as to reflect on the examination situation. In doing so, he has to prove that he is able to apply the skills acquired during the course of the training and is able to perform the tasks in health and nursing care in accordance with § 3 (1) of the German Health Care Act (Nursing Act) (2) The selection of the patients as well as the selection of the specialist area in which the practical test is carried out shall be carried out by a specialist examiner in accordance with § 4 (1) (3) (a) of the Agreement with the patient or the patient and on the patient or the patient Patients responsible for professional staff. The practical part of the test should normally be completed in six hours for the individual test specimen; it may be distributed over two consecutive days. The examination note for the practical part of the examination is made up of the grades of the examiners ' grades, the chairperson of the examination board, in consultation with the specialist examiners. Examination regulations for the training in health care and paediatric care

Section 16 Written part of the examination

(1) The written part of the examination shall cover the following subject areas of Appendix 1 (A):
1.
Recognize, record and evaluate nursing situations in people of all ages,
2.
select, perform and evaluate care measures,
3.
To align care products with care scientific knowledge, quality criteria, legal framework conditions as well as economic and ecological principles.

Section 17 Oral part of the examination

(1) The oral part of the examination shall cover the following subject areas of Appendix 1 (A):
1.
Provide support, advice and guidance in matters of health and care relevant to health and care,
2.
develop professional self-understanding and learn to cope with professional requirements,
3.
to participate in medical diagnostics and therapy and work together in groups and teams.
In the oral examination, the examinee has to prove application-ready vocational skills. The examination shall include the differentiation phase in health care and paediatric care, as well as the knowledge bases mentioned in Appendix 1 (A). (2) § 14 (2) to (4) shall apply accordingly. Section 18 Practical part of the examination

(1) The practical test of the examination shall cover the care of a group of patients of not more than four children or adolescents. In the field of its differentiation area according to Appendix 1 (B), in which he participates in the practical training at the time of the examination, the examinee shall carry out all the tasks of a process-oriented care, including the Documentation and submission. In an examination interview, the examinee has to explain and justify his/her care trade as well as to reflect on the examination situation. In doing so, he has to prove that he is able to apply the skills acquired during the course of the training and is able to perform the tasks in the health and paediatric care system according to § 3 (1) of the Pursuant to Section 15 (2) and (3), the Health Care Act shall be carried out in accordance with its own responsibility.

Authorisation

§ 19 Permits of approval

If the conditions laid down in § 2 of the Nursing Act are fulfilled for the granting of a licence to lead the professional title pursuant to Article 1 (1) (1) (1) (1) or (2) of this Act, the competent authority shall issue the certificate of approval in accordance with the Model of Appendix 4.

Special arrangements for holders of evidence of formal qualifications from a Member State of the European Union or of another State Party to the Agreement on the European Economic Area or a third country

Section 20 Special arrangements for holders of evidence of formal qualifications from another Contracting State of the European Economic Area

(1) Applicants who apply for a permit pursuant to Section 1 (1), first sentence, number 1 or 2 of the Nursing Act may, for proof that the conditions pursuant to § 2 (1) (2) of this Act are in place, may be submitted by the competent authority of the a certificate issued by the Member State of origin or an extract from the register issued by such authority or, where such an extract may not be provided, provide equivalent proof. If the applicant has already pursued the profession in the home Member State, the competent authority of the competent authority of the competent authority of the Member State responsible for issuing the permit referred to in the first sentence of Article 1 (1) (1) or (2) of the Health Care Act may be granted. The certificates and communications referred to in sentences 1 to 3 shall be treated as confidential. They may only be used if the exhibition does not exceed three months at the time of presentation. (2) Applicants who apply for a permit pursuant to Section 1 (1), first sentence, number 1 or 2 of the Nursing Act may be entitled to: , proof that the conditions laid down in Section 2 (1) (3) of this Act are met, provide proof of the condition of their home Member State. Where such proof is not required in the home Member State, an attestation issued by a competent authority of that State shall be recognised as a result of which the conditions laid down in Section 2 (1) (3) of the Health care law is fulfilled. The fourth and fifth sentences of paragraph 1 shall apply by analogy. (3) Applicants who have a training certificate in the profession of nurse or nurse responsible for general care or a training certificate in the profession of: Health and paediatric nurses who have been acquired in another Contracting State of the European Economic Area shall, after the recognition of their professional qualifications, carry out the professional title of "Health and Nursing Nurse" or "health care and nurses" or " health care and health care ' Children ' s nurse 'or' health and paediatric nurse '. (4) The certificates referred to in the first sentence of paragraph 1 shall not be issued by the competent body of the home Member State or the certificates referred to in the second sentence of paragraph 1 or the third sentence of paragraph 1 shall be replaced by the following: , the applicant may replace it with the competent authority of the home Member State by submitting a certificate to the competent authority of the home Member State by submitting a certificate of the discharge of a declaration. § 20a Recognition arrangements for evidence of formal qualifications from a Member State of the European Union or of another State Party to the Agreement on the European Economic Area

(1) Applicants who apply for a permit pursuant to Section 1 (1), first sentence, point 1 of the Health Care Act; and
1.
have completed their training in a Member State of the European Union or in another State Party to the Agreement on the European Economic Area, but which are not covered by Article 2 (4) of the Health Care Act or § 25 of the health care law, or
2.
a certificate of training as a nurse responsible for general care from a Member State which is not a Member State of the European Union or a State Party to the Agreement on the European Union (a third country), but which has been recognised in a Member State of the European Union or another State Party to the Agreement on the European Economic Area,
in order to compensate for the substantial differences identified by the competent authority in the course of the examination of their application for the authorisation to conduct the professional title, and not through knowledge and skills The applicant has been able to take up an adaptation period in accordance with paragraph 2, or take an aptitude test in accordance with paragraph 3. The aptitude test extends to a practical examination, which is connected to an examination interview. The examinee must demonstrate in at least one and at most four care situations that he/she plans, take over the measures required for the overall care process, document their implementation as well as the transfer can be made. The competent authority shall determine the number of care situations and the supply areas, areas or subjects referred to in Annex 1 (B) to which the examination extends, in accordance with the essential differences identified. The test should not take longer than 120 minutes for each care situation and should be designed as a patient examination. It shall be taken up and evaluated by a specialist examiner in accordance with Article 4 (1), first sentence, point 3 (a) and a specialist examiner in accordance with Article 4 (1), first sentence, point 4. During the examination, the examiners are allowed to ask questions relating to the concrete practical approach. The aptitude test is completed successfully if the specialist examiners evaluate each care situation in accordance with "passed". The existence of the test shall at least require the performance of the test item to meet the requirements in spite of its shortcomings. If the specialist examiners come to a different evaluation, the chairman of the examination board shall decide on the existence of the examination after consultation with the examiners. The aptitude test is to be offered at least twice a year and should be repeated once in each care situation that has not been passed. A certificate issued in accordance with the model of Appendix 6 shall be issued in respect of the aptitude test passed. Unofficial table of contents

Section 20b Recognition schemes for evidence of formal qualifications from a third country

(1) Applicants applying for a permit in accordance with the first sentence of Article 1 (1) (1) (1) or (2) of the Nursing Act shall complete an adaptation period referred to in paragraph 2 which shall be subject to an examination of the content of the adaptation period or a proficiency test as referred to in paragraph 3, if they have a certificate of training acquired in a third country and that their training has substantial differences in the German training provided by the competent authority in the context of the examination of its application for authorisation to conduct the professional title has been established and could not be compensated for by the knowledge and skills acquired by the applicants in the course of their proven professional practice. The first sentence shall apply in cases where an examination of the equivalence of the level of training is not carried out on the basis of the circumstances under Section 2 (3), sentence 5 of the Health Care Act. (2) The adaptation period shall be used together with the final discussion of the finding that the applicants have the knowledge and skills required to pursue the profession of health care and nursery or the profession of health and paediatric nurse (Course target). It shall be in the form of theoretical and practical instruction, practical training with theoretical instruction or both in the case of institutions pursuant to § 4 (2) sentence 1 or sentence 3 of the Nursing Act or on the basis of the teaching programme objective. shall be carried out by the competent authority as comparably recognised bodies and shall conclude with an examination of the content of the adaptation period. On the theoretical instruction, practical managers who meet the requirements of § 2, paragraph 2, sentence 4 or sentence 6, should be involved in an appropriate manner. The competent authority shall determine the duration and content of the adaptation period in such a way that the course objective can be achieved. The successful performance of the adaptation period must be verified by means of a certificate issued in accordance with the model of Appendix 7. The certificate shall be issued if, in the examination carried out in the form of a final interview, it has been established that the applicants have achieved the aim of the course. The final interview shall be conducted by a specialist examiner in accordance with § 4 (1), first sentence, point 3, together with the teacher or the practical instructor according to sentence 3, which the applicant has taken care of during the course of the course. If, in the final interview, the applicant has not successfully completed the adaptation period, the specialist examiner decides, in accordance with § 4 (1), first sentence, point 3, in consultation with the teaching force participating in the interview or the Practical guide on an appropriate extension of the adaptation period. An extension is only allowed once. The extension will be followed by another final interview. If the certificate referred to in the fifth sentence cannot be issued even after the result of the interview, the adaptation period may be repeated only once. (3) In the case of the examination of knowledge, the applicants have to prove that they are responsible for the exercise of the Occupational health and health care professionals or the profession of health care and paediatric nurse. The proficiency test shall include an oral and practical part. It has been successfully completed when each of the two parts of the examination has been passed. (4) The oral part of the proficiency examination shall cover the subject areas 3 and 8 of Appendix 1 (A) and the following excerpts from the thematic areas 7, 10 and 12:
1.
reflect legal framework conditions and take them into account in their care trade,
2.
deal constructively with crisis and conflict situations,
3.
explain, adequately and safely represent nursing needs in an intra-as well as an interdisciplinary team, as well as to participate in the negotiation of joint treatment and care concepts, as well as
4.

The oral part of the test shall last at least 15 minutes for the individual test specimen and not more than 60 minutes. It shall be taken up and assessed by two specialist examiners, one of whom must meet the conditions laid down in Article 4 (1) (3) (b). The oral part of the proficiency test shall be completed successfully if the specialist examiners, in an overall view, are concerned with the subject areas 3 and 8 of Appendix 1 (A) and the extracts listed in the first sentence of the first sentence of paragraph 1 to 4 of Annex 1 to this Regulation. Subject areas 7, 10 and 12 of Appendix 1 (A) shall be assessed in a consistent manner with "passed". The provisions of Article 20a (3) sentence 9 shall apply accordingly. If the specialist examiners come to a different evaluation, the chairman of the examination board shall decide on the existence of the exam after consultation with the examiners. Section 20c Time limits, notice, implementing provisions

an explanation as to why the main differences could not be compensated by the knowledge and skills acquired by the applicants in the course of their proven professional practice.
(3) The aptitude test in accordance with § 20a (3) and the proficiency test in accordance with § 20b, paragraph 3, shall take the form of a state examination before a state examination board.
