§ 1 Content of training

(1) The training for midwives and debindungspfleger shall comprise at least the theoretical and practical instruction given in Appendix 1 of 1,600 hours and the practical training of 3,000 hours indicated in Appendix 2. The allocation of the subjects prescribed in Appendix 1 and the areas prescribed in Appendix 2 to training years may be dismissed with the consent of the competent authority, insofar as this is due to organisational reasons. § 2 State Examination

(1) The state examination comprises a written, oral and a practical part. (2) The examinee shall submit the examination at the midwifery school in which he has completed the training. § 3 Examination Committee

(1) At each school of midwifery, a Selection Board consisting of the following members shall be formed:
1.
a professional representative of the competent authority or of a suitably qualified person appointed by the competent authority with the performance of that task;
2.
a representative of the school administration, if the school is subject to state supervision by the school administration in accordance with the school laws of a country,
3.
a commissioner from the school's management,
4.
the following specialist examiners:
a)
at least one doctor or one doctor,
b)
at least one teacher's office or one teacher's training provider,
c)
another midwife, or another debinding plagiarist,
d)
further teaching staff in accordance with the subjects to be tested;

(1a) In the medical schools which are officially recognised as midwives in accordance with § 30a (2) of the Hebammengesetz (Hebammengesetz) , by way of derogation from paragraph 1 (4) (b), the examination committee may also be staffed as a midwife with at least one diploma in medical education or a medical teacher with the medical school leaving certificate. § 4 Approval for Examination

(1) The Chairperson shall decide on the admission to the examination at the request of the examinee and shall set the examination dates in consultation with the head of the Hebammenschule. (2) The admission to the examination shall be granted if the following proof is available:
1.
the identity card or passport in an officially certified copy,
2.
the certificates of participation in the training courses prescribed in accordance with this Regulation.
(3) The admission as well as the examination dates shall be communicated to the examinee in writing at the latest four weeks before the start of the examination. § 5 Written part of the examination

(1) The written part of the examination shall cover the following subjects:
1.

Professional, Law and Citizenship.
The examinee has to answer in writing questions from these subjects in a respective supervisory work. The supervisory work in subject 1 lasts 120 minutes, in subject 2 90 minutes and in the subjects 3, 4 and 5 each 60 minutes. The written part of the exam is to be done on two days. The supervisory boards are appointed by the head of the midwifery school. (2) The tasks for the supervisory work are determined by the Chairman of the Audit Committee in consultation with the head of the midwifery school. Each supervisory work must be bended by at least two specialist examiners in accordance with § 9. The Chairman of the Audit Committee, in agreement with the specialist examiners, shall form the examination note for the written part of the examination from the grades of the examiners. § 6 Oral part of the examination

(1) The oral part of the examination shall cover the following subjects:
1.
Obstetrics including the one in Appendix 1 in 2. and 3. Training year under points 2 to 7,
2.
Paediatrics,
3.
Nursing,
4.
Health care and hygiene.
The test specimens are tested individually or in groups of up to five. In one compartment, the test item should not be tested for more than 20 minutes. The examinee shall present his/her abilities in the obstetric phantom. (2) The oral part of the examination shall be taken from at least three examiners and shall be named in accordance with § 9. The Chairman of the Audit Committee, in agreement with the specialist examiners, shall form the examination note for the oral part of the examination from the grades of the examiners. In so doing, the subject referred to in paragraph 1 (1) shall be weighted by a factor of 2 and the other subjects in a simple way. (3) The Chairman of the Audit Committee may, on request, allow the presence of listeners in the oral part of the examination. Unofficial table of contents

§ 7 Practical part of the examination

(1) The practical part of the examination shall be based on the following tasks:
1.
Recording of a pregnant woman and documentation of the findings collected with the preparation of a treatment plan,
2.
Implementation of a release with initial care of the newborn and documentation with the consent of the pregnant woman,
3.
a practical care demonstration on an infant,
4.
a case briefing/care demonstration on a worker who has recently given birth.
On a case-by-case basis, the disconnection referred to in point 2 may be replaced on the basis of compelling circumstances by the participation in an operational decommitment. The practical part of the test shall last for a maximum of eight hours; it may be distributed over two days. (2) The practical part of the test shall be taken from at least two examiners and shall be subject to the procedure in accordance with § 9. § 8 Niederschrift

§ 9 Benotung

The written supervisory work, as well as the performances in the oral and practical tests, shall be envied as follows:
"very good" (1), if the performance meets the requirements to a particular extent,
"good" (2) if the performance is fully compliant with the requirements,
"satisfactory" (3) if the performance is generally in accordance with the requirements,
"sufficient" (4) if the performance has defects, but still meets the requirements,
"defective" (5) if the performance does not meet the requirements, but indicates that the necessary basic knowledge is available and that the deficiencies can be remedied in the foreseeable future,
"insufficient" (6), if the performance does not meet the requirements and even the basic knowledge is so patchy that the deficiencies cannot be remedied in the foreseeable future. Unofficial table of contents

§ 10 existence and repetition of the examination

(1) The examination shall be passed if the written, oral and practical parts of the examination are at least "sufficiently" bended. Within the written and oral part of the examination, the subject "obstetrics" must be at least "sufficiently" benoted. (2) A certificate shall be issued in accordance with the model of Appendix 4 on which the State examination has been passed, on which the Test notes are to be entered. In case of non-existence, the examiner receives a written notice from the chairman of the examination board, stating the examination notes. (3) Each part of the examination can be repeated once the test item is "defective" or "insufficiently". In order to repeat part of the test, the test item should be loaded at an appointment within six months of the date of the test filed without success. The first and second sentences apply to the subject "obstetrics" if the examinee has received the grade "deficient" or "insufficient" within the written or oral part of the examination in this subject. (4) If the test piece has all parts the examination must be repeated, so that it may only be admitted for examination if it has participated in a further training, the duration and content of which shall be determined by the chairman of the examination board. An appropriate proof of this is to be attached to the application of the test specimen for approval for the repeat examination. Section 11 Resignation of the Examination

(1) If a test item returns from the examination after its approval, it shall immediately inform the Chairman of the Audit Committee in writing of the reasons for his resignation. If the Chairman approves the resignation, the examination shall be deemed not to have been made. The authorisation shall only be granted if there are important reasons. In the event of a disease, the submission of a medical certificate may be required. § 12 Follow-up

§ 13 Administrative infringements and attempts at deception

Section 16 Special arrangements for holders of training certificates from another Contracting State of the European Economic Area

(1) Applicants who apply for a permit pursuant to Article 1 (1) of the Act and who are nationals of another Member State of the European Economic Community or of another Contracting State of the Agreement on the European Economic Community A certificate issued by the competent authority of the home Member State, or a certificate issued by the competent authority of the home Member State, may provide evidence that the conditions are in accordance with Article 2 (1) (2) of the Act. , or, if such an extract cannot be provided, provide equivalent proof. § 16a Recognition schemes for evidence of formal qualifications from a Member State of the European Union or another State Party to the Agreement on the European Economic Area

(1) Applicants who apply for a permit pursuant to Section 1 (1) of the Hebammengesetz (Hebammengesetz) and
1.
have completed their training in a Member State of the European Union or any other State Party to the Agreement on the European Economic Area, but not under Article 2 (3) of the Hebammengesetz or § 28 of the Hebammengesetz , or
2.
have a training certificate as a midwife or a de-bindment provider from a State which is not a Member State of the European Union or a State Party to the Agreement on the European Economic Area, but which is not a Member State of the European Union; The European Union or any other State Party to the Agreement on the European Economic Area,
in order to compensate for the substantial differences identified by the competent authority in the course of the examination of their application for the authorisation to conduct the professional title, and not through knowledge and skills The applicant has been able to take up an adaptation period in accordance with paragraph 2, or take an aptitude test in accordance with paragraph 3. Section 16b Recognition schemes for evidence of formal qualifications from a third country

It shall be taken up and assessed by two specialist examiners, one of whom must comply with the conditions laid down in Article 3 (1) (4) (b). The oral part of the proficiency test has been successfully completed if the specialist examiners assess it in a total consideration with "passed". § 16a (3) sentence 9 shall apply accordingly. If the examiners come to a different evaluation, the chairman of the examination board shall decide on the existence of the exam after consultation with the examiners. Section 16c Time limits, notice, implementing provisions

(1) The competent authority shall, in the short term, in connection with Article 2 (2), 2a or 5 of the Hebammengesetz (Hebammengesetz), have submitted requests for the granting of a licence as a midwife or a de-bindungspfleger in conjunction with Article 2 (2), (2a) or (5) of the Hebammen Act, months, in the case of applications pursuant to § 2 (3) of the Hebammengesetz (Hebammengesetz) no later than three months after the submission of the documents required for decisions pursuant to § 2 of the Hebammengesetz. (3) The aptitude test in accordance with § 16a (3) and the proficiency test in accordance with § 16b (3) shall take the form of a state examination before a state examination board.
