§ 1

(1) Each court may refer the matter to the Court of Justice of the European Communities in the field of police law cooperation and judicial cooperation in criminal matters, under the conditions laid down in Article 35 of the EU Treaty, submit a question for a preliminary ruling, which is in a pending procedure and which is valid and valid for the purpose of the the interpretation of framework decisions and decisions, or on the interpretation of conventions or on the validity and interpretation of the implementing measures thereto, when a decision on the adoption of its judgment, or Decision is considered necessary.(2) A court whose decisions may no longer be challenged by means of appeal under national law shall, for a preliminary ruling, submit questions to the Court of Justice in accordance with paragraph 1 if it makes a decision on the issue of its Judgment or decision is considered necessary.
