§ 1

(1) Any court may, under the conditions laid down in Article 35 of the EU Treaty, give a question to the Court of Justice of the European Communities in the field of police cooperation and judicial cooperation in criminal matters. For a preliminary ruling, which is in a pending procedure and which is based on the validity and interpretation of the framework decisions and decisions, or on the interpretation of conventions or on the validity and interpretation of the , if it makes a decision on the issue of its judgment or decision. (2) A court whose decisions are no longer able to be challenged by means of appeal under national law has referred questions to the Court of Justice for a preliminary ruling under paragraph 1 if it deems it necessary to take a decision on the adoption of its judgment or decision. § 2

(1) This Act shall enter into force on the day on which the Treaty of Amsterdam amending the Treaty on European Union, the Treaties establishing the European Communities and certain related acts of the second paragraph of the Treaty of Amsterdam shall take effect. (2) The Federal Ministry of Justice shall announce the date of the entry into force of this law in the Federal Law Gazans.
