§ 1 Scope of application

(1) This Regulation shall apply to the energy-related products referred to in Annexes 1 and 2 which have significant direct or indirect effects on the use of the products during use. Consumption of energy and, where appropriate, other important resources.(2) This Regulation does not apply to

used products,

Transportation for people or goods transport,
3.
Tires,
4.
Labels, labels, performance tags, or other information and signs of products as required by other legislation or For security reasons,

§ 2 Definitions

For the purposes of this Regulation
1.
are energy-related product items within the meaning of § 2 (1) (a) of the Energy consumption labelling law of 30. January 2002 (BGBl. 570), as last amended by Article 1 of the Law of 10. May 2012 (BGBl. 1070);
2.
is deemed to be a supplier of the natural or legal entities referred to in § 2 (8) of the German Energy Labelling Act (Energy Labelling Act). Persons;
3.
is the dealer of any natural or legal entity listed in Section 2 (12) (a) of the Energy Labelling Act. People;
4.
is the initial use of a product for its intended purpose;
5.
is data sheet a unified collection of information about a particular product;
6.
are different important resource water, chemicals, or other resources that the product in question consumes during normal operation;
7.
are technical Promotional literature, which describes the specific technical parameters of a product and which are used for marketing, in particular technical manuals or brochures, either printed or available online. are;
8.
are direct effects on the consumption of energy effects of products that actually energy during use
9.
are indirect effects on the consumption of energy effects of products that do not consume energy themselves, but during use. Contribute to saving energy;

§ 3 Labelling requirement

(1) Energy-related products that are relevant to the End-users at the place of sale for purchase, for the conclusion of a rental contract or on similar charges for use offered or issued are subject to the conditions laid down in § § 4 and 5 as well as the provisions of Appendix 1 and the regulations of the European Union according to Appendix 2, indicating the consumption of energy and other important resources, as well as additional information.(2) An obligation to identify the labelling referred to in paragraph 1 shall not apply to energy-related products the manufacture of which has been discontinued prior to the date on which, in accordance with Appendix 1 or Appendix 2, the individual types of products shall be: energy-related products must be labelled.(3) The suppliers shall be responsible for the accuracy of the information given by them on labels and data sheets pursuant to § 4; their consent to the publication of this information shall be deemed to have been granted. § 4 Labels, Data Sheets

(1) Suppliers have access to labels and data sheets free of charge to merchants. if they place on the market energy-related products covered by the directives referred to in the first sentence of Annex 1 or the regulations referred to in Annex 2, Section 1, paragraph 1. You have to make available

b)
Appendix 1, paragraph 5, or in accordance with the section referred to in Appendix 2, Section 1, paragraph 1 Regulations.
way of derogation from the first sentence, suppliers of luminaires covered by the Regulation referred to in Annex 2, Section 1 (1) (7), shall not be required to provide data sheets.(2) Suppliers shall also be provided with electronic labels and data sheets free of charge to distributors when placing products on the market covered by a Regulation referred to in Annex 2, Section 1, paragraph 1. They shall make available labels and data sheets in accordance with the requirements of that Regulation, which shall be relevant for the relevant product group.(3) If they place products on the market, suppliers have to include the data sheets in all product brochures in which the respective product model is listed. If the suppliers do not produce such product brochures, they will have to provide the data sheets with the documents that they supply to the energy-related products. Sentence 2 shall not apply to electrical lamps covered by the Regulation referred to in Annex 2, Section 1 (1) (7). In the case of these lamps, the supplied label shall be regarded as a data sheet, if no product brochures are provided.(4) traders shall display the labels referred to in the first sentence of paragraph 1, point 1, clearly in the places provided for in the Directives referred to in Appendix 1 or in the Regulations referred to in Annex 2, Section 1, paragraph 1, where they are relevant to energy-related Issue the products referred to in the first sentence of paragraph 1. Traders are allowed to issue electrical lamps only if they are required by the suppliers with the required Labels in accordance with Section 4b (1) (4),
2.
Dealers have, in the event that they sell luminaires, in a packaging intended for end users in traffic, which contains electrical lamps that the end user can exchange in the luminaires, to ensure that
a)
the original packaging of these lamps is included in the packaging of the luminaire or
b)
on the outside or on the inside of the bulbs, the information required on the original packaging of the lamps shall be indicated on the basis of the Regulation referred to in Annex 2, Section 1 (1) (7), or on the basis of the following referred to in Article 15 of Directive 2009 /125/EC of the European Parliament and of the Council of 21 October 2009, establishing a framework for the setting of ecodesign requirements for energy-related products (OJ L 327, 28.12.2009, p. 10), adopted by the Commission:

§ 4a Labels for products according to Appendix 1

Suppliers may be used for the products covered by the policies set out in Appendix 1 select a separate delivery method for the labels. § 4b Labels for products according to Appendix 2

(1) Suppliers have the required labels for those of the regulations products covered by Section 1 (1) of Appendix 2, where suppliers of products covered by the Regulations referred to in Annex 2, Section 1 (1) (7), (9), (10) and (11), comply with the following specific requirements are:
1.
when they are placed on the market of room heaters with heat pump or hot water heaters with heat pump have suppliers to supply the label in the packaging of the heat generator,
2.
on the placing on the market of room heaters, which are placed in composite installations made of room heating appliances, To use temperature regulators and solar installations, suppliers have to supply a second label for each room heater,

4.
when electric lamps are placed on the market as individual products to be sold through a sales office, suppliers have a label on the individual packaging of each lamp or to be attached to the packaging, and to indicate the nominal output of the lamp outside the label. Section 4 (4), second sentence, shall apply accordingly,
5.
suppliers shall be allowed to enter into the market of luminaires to be sold through a sales point Choose delivery method where labels are made available only at the request of the dealers,
6.

§ 5 Unissued Products

§ 6 Technical documentation

(1) Where there is an obligation to identify information in accordance with § 3, the supplier shall be responsible for the individual to produce a technical documentation in accordance with the provisions of paragraph 8 of Appendix 1 or in accordance with the regulations of the European Union referred to in Annex 2, which make it possible to verify the accuracy of the information provided on the label and in the data sheet. § 6b Requirements for technical advertising labels

§ 7 misuse of labels

It is forbidden to use trademarks, symbols, labels, or other labels , which are not in accordance with the requirements of the marking referred to in Article 3 (1) and which are suitable to lead to confusion with the end user in accordance with Article 3 (1) or to a final consumer to a mislead or confusion with regard to the consumption of energy or other important resources during use. § 8 Administrative Offences

An administrative offence within the meaning of Section 15 (1) (1) of the German Energy Labelling Act (Energy Consul) Who intentionally or negligently acts as

contrary to § 4 (1) sentence 2 (1) (b) or 2.

contrary to § 4 (2), second sentence, an electronic label or a data sheet,

13.

Appendix 1 Houseware label obligation

Commission Directive 2002/40/EC of 8 October 1996 on the application of the European Commission's Directive on the application of the European Parliament and the Council of the European Communities. May 2002 on the implementation of Council Directive 92/75/EEC on energy labelling of electric ovens (OJ L 206, 22.7.1992, p. 45), and subsequently Directive 2002 /40/EC.
1. Equipment to be identified The types of grid-operated electrical household appliances listed in Table 1, column 1, shall be subject to the labelling requirement in accordance with this Annex in accordance with § 3. These requirements shall also apply to offers of built-in appliances for fitted kitchens. 7. Class classification The classes for energy efficiency and, where appropriate, further information on the characteristics of the device models shall be given in accordance with the Annexes to Directives 96 /60/EC or 2002 /40/EC listed in Table 1, column 6, respectively. Technical documentation The technical documentation according to § 6 shall contain the following information:
a)
Supplier's name and address,
b)
