This Regulation provides for the implementation of Council Directive 92/75/EEC of 22 September 1992 on the indication by labelling and standard product information of the consumption of energy and other resources by household appliances (OJ L 327, 22.12.1992, p. § 1 Scope

This Regulation shall apply to the energy-related products referred to in Annexes 1 and 2 which, during use, have a significant direct or indirect effect on the consumption of energy and, where appropriate, on other important products. (2) This Regulation shall not apply to:
1.
used products,
2.
Means of transport for passengers or goods,
3.
tyres,
4.
labels, labels, performance signs or other information and signs of products where these are required by other legislation or are appropriate for safety reasons; and
5.
Products intended solely for use for military purposes.

§ 2 Definitions

For the purposes of this Regulation
1.
Are energy-related product items within the meaning of § 2 (1) (a) of the Energy Labelling Act of 30 January 2002 (BGBl. 570), as last amended by Article 1 of the Law of 10 May 2012 (BGBl. 1070);
2.
shall be deemed to be a supplier of the natural or legal persons referred to in Article 2 (8) of the Energy Energy Labelling Act;
3.
Is the dealer of any natural or legal person referred to in Article 2 (12) (a) of the Energy Labelling Act;
4.
the initial use of a product for its intended purpose is to be used for the first time;
5.
Data sheet is a uniform compilation of information on a given product;
6.
other important resource water, chemicals or other resources which the product in question consumes during normal operation;
7.
are technical promotional literature, which describes the specific technical parameters of a product and which are used for marketing, in particular technical manuals or brochures, either printed or available online;
8.
Are direct effects on the consumption of energy effects of products that actually consume energy during use;
9.
are indirect effects on the consumption of energy effects of products which themselves do not consume energy, but contribute to saving energy during use;
10.
is a display mechanism for each screen, including a touchscreen, or any other image technology to display Internet content for users.

§ 3 Labelling obligation

(1) Energy-related products which are offered or issued for the final consumer at the place of sale for purchase, for the conclusion of a rental contract or on similar charges for use shall be subject to the conditions laid down in § § 4 and 5 as well as Appendix 1 and the regulations of the European Union according to Appendix 2, indicating the consumption of energy and other important resources as well as additional information. § 4 Labels, datasheets

(1) Suppliers shall be provided with labels and data sheets free of charge to dealers if they place on the market energy-related products from the Directives referred to in the first sentence of Annex 1 or in Annex 2, Section 1. , are covered by the provisions of paragraph 1. Appendix 1 (5) or the Regulations referred to in Annex 2 (1) (1).
By way of derogation from the first sentence, suppliers of luminaires covered by the Regulation referred to in Annex 2, Section 1 (1) (7), shall not have to provide data sheets. (2) Suppliers shall also have electronic labels for dealers and to provide data sheets free of charge if they place on the market products covered by a Regulation referred to in Annex 2 (1) (1). They shall provide labels and data sheets in accordance with the requirements of that Regulation, which is relevant for the relevant product group. (3) shall have suppliers if they place products on the market which: To include data sheets in all product brochures in which the respective product model is listed. If the suppliers do not produce such product brochures, they will have to provide the data sheets with the documents that they supply to the energy-related products. (4) Dealers shall have the labels referred to in the second sentence of the second sentence of paragraph 1, clearly visible at the places in which they are placed. The Directives referred to in Appendix 1 or the Regulations referred to in Annex 2, Section 1 (1), shall be provided for when they issue energy-related products as referred to in the first sentence of paragraph 1. The labels may not be hidden by any other information, imprints or clues. (5) By way of derogation from paragraph 4, distributors of products covered by the Regulation referred to in Annex 2, Section 1 (1) (7), shall be: Rules to be applied:
1.
Dealers may issue electrical lamps only if they are provided by the suppliers with the labels required in accordance with Section 4b (1) (4),
2.
In the event that they sell luminaires placed on the market in a packaging intended for end-users, they shall have the electrical lamps which the end user can exchange in the luminaires, to ensure that:
a)
the original packaging of these lamps is included in the packaging of the lamp; or
b)
on the outside or inside of the packaging, the information required on the original packaging of the lamps shall be shown on the basis of the Regulation referred to in Annex 2, Section 1 (1), point 7, or on the basis of the following: , in accordance with Article 15 of Directive 2009 /125/EC of the European Parliament and of the Council of 21 June 2009, October 2009, establishing a framework for the setting of ecodesign requirements for energy-related products (OJ L 327, 28.12.2009, p. 10) of the European Parliament and of the Council of 31 October 2009 on the following regulations:

Section 4a Labels for products according to Appendix 1

Suppliers may choose their own label delivery methods for the products covered by the Directives listed in Appendix 1. In particular, they may also supply the label in divided form, divided into a basic label which does not contain any device-specific information, and into a data strip which has the device-specific information. The suppliers must ensure that the labels are immediately available to any dealer on request. Unofficial table of contents

Section 4b Labels for products according to Appendix 2

(1) Suppliers shall supply the necessary labels for the products covered by the Regulations referred to in Annex 2, Section 1, paragraph 1, where suppliers of products from the products listed in Annex 2 (1) (1) (7), (9), (9), (10) and (11) , to comply with the following specific requirements:
1.
in the case of the placing on the market of room heaters with heat pumps or hot water heaters with a heat pump, suppliers shall supply the label in the packaging of the heat generator,
2.
in the case of space heaters to be used in composite installations made from room heaters, temperature regulators and solar installations, suppliers have to supply a second label for each room heating device,
3.
in the case of the placing on the market of hot water heaters to be used in composite installations of hot water heaters and solar installations, suppliers shall supply a second label for each water heater,
4.
when electric lamps are placed on the market as individual products intended to be sold through a point of sale, suppliers shall have a label affixed to the individual packaging of each lamp or printed or attached to the packaging; and to indicate the nominal power of the lamp outside the label. Section 4 (4), second sentence, shall apply accordingly;
5.
in the case of the placing on the market of luminaires to be sold through a point of sale, suppliers may choose a delivery method where labels are made available only at the request of the dealers,
6.
in the case of the placing on the market of luminaires placed on the market in a packaging intended for end-users, which contains electric lamps which the end user can exchange in the luminaires, suppliers shall ensure that:
a)
the original packaging of these lamps is included in the packaging of the lamp; or
b)
on the outside or inside of the packaging of the lamps, the information required on the original packaging of the lamps shall be shown on the basis of the Regulation referred to in paragraph 1 (7) of Annex 2, or on the basis of the provisions of 4 (5) (2) (b),
7.
when baking ovens with several cooking rooms are placed on the market, suppliers have to supply a label for each cooking area.
(2) Irrespective of the chosen procedure, the suppliers shall ensure that the required labels are immediately available to any dealer on request. Unofficial table of contents

§ 5 Products not issued

Products covered by the Directives referred to in the first sentence of Annex 1 or in the Regulations referred to in Annex 2, Section 1, paragraph 1, shall be obtained by mail order, in catalogues, on the Internet, by telephone marketing or on another Provided by suppliers and distributors, where interested parties do not see the products displayed, suppliers and distributors shall, before the conclusion of the contract, inform the interested party of the information required under Annex 1 (3), (6) and (7), or to the abovementioned Regulations. § 6 Technical Documentation

(1) In so far as there is a mandatory labelling requirement in accordance with § 3, the supplier shall have a technical documentation for the individual product model in accordance with the conditions laid down in paragraph 8 of Appendix 1 or in accordance with the regulations of the European Union referred to in Annex 2 , to verify the accuracy of the information provided on the label and in the data sheet. (2) Documents may be used for the preparation of the technical documentation, which are already based on the legislation of the European Union. The supplier shall keep the documentation available for a review for a period of five years after the end of the production of the individual product model. After five years, the technical documentation shall no longer be required. (3) The supplier shall provide the technical documentation to the competent market surveillance authorities, the market surveillance authorities of the Member States. the European Union or a Contracting State of the Agreement on the European Economic Area and the European Commission, at the request of the receipt of an application, within ten working days in electronic form. § 6a Requirements for advertising

Suppliers and distributors shall ensure that the advertising of a specific product model within the meaning of Annexes 1 and 2 refers to the energy efficiency class of the product, provided that information on the energy consumption is provided in the advertising or the price indicated. In the case of lamps covered by the Regulation referred to in Annex 2, Section 1 (1) (7), suppliers and distributors shall only ensure that, in the case of advertising referred to in the first sentence, the information which contains the label shall be subject to the conditions laid down in the Regulation. shall be made available. § 6b Requirements for technical promotional literature

Suppliers and distributors shall ensure that information on energy consumption is made available in technical promotional literature for products within the meaning of Appendices 1 and 2, or to the energy efficiency class of the product. , provided that the specific technical parameters of a product are described in these technical promotional literature and that there is no deviation from the regulations of the European Union referred to in Annex 2. § 7 Misuse of designations

§ 8 Administrative Offences

Contrary to the provisions of Section 15 (1) (1) of the German Energy Labelling Act, those who intentionally or negligently act in accordance with the provisions of the law
1.
, contrary to Article 4 (1), second sentence, point 1 (b) or point 2 (b), a label or a data sheet shall not be made available in a correct or timely manner,
2.
does not provide an electronic label or an electronic data sheet, either correctly or in good time, in accordance with the second sentence of Article 4 (2) (2),
3.
Contrary to § 4 (3) sentence 1, a data sheet shall not be included in a product brochure correctly or in a timely manner,
4.
, contrary to § 4 (3) sentence 2, a data sheet shall not be made available, not correct or not in good time,
5.
, contrary to § 4 (4) sentence 1, does not apply a label, correct or not in good time,
6.
the second sentence of Article 4 (4) conceals a label,
7.
, contrary to Article 4 (5) (1), exposes a lamp,
8.
Contrary to Article 4 (5) (2) (a), it does not ensure that the original packaging is included,
9.
Contrary to Article 4 (5) (2) (b), it does not ensure that the information referred to therein is expelled,
10.
Contrary to § 4 (6), a data sheet is not available or is not available in the correct way,
11.
Contrary to § 4a sentence 3 or § 4b paragraph 2, it does not ensure that a label is available,
12.

§ 9 Transitional provision

Domestic baking ovens which comply with the provisions of the Regulation referred to in Annex 2, Section 1, paragraph 1, point 11, and which are placed on the market or offered for sale, hire or hire purchase before 1 January 2015 shall be considered as: , compatible with the provisions of Directive 2002 /40/EC referred to in Annex 1. Appendix 1 Labelling requirements for household appliances

Commission Directive 96 /60/EC of 19 September 1996 on the implementation of Council Directive 92/75/EEC as regards energy labelling for combined household washing machines (OJ L 327, 22.12.1996, p. OJ L 266, 18.10.1996, p. 1), hereinafter Directive 96 /60/EC,
-
Commission Directive 2002/40/EC of 8 May 2002 on the implementation of Council Directive 92/75/EEC on energy labelling of electric ovens (OJ L 327, 30.12.2002, p. 45), and subsequently Directive 2002 /40/EC.
Equipment to be identified The types of network-driven electrical household appliances listed in column 1 of Table 1 shall be subject to the labelling requirement laid down in Article 3 of this Annex. Equipment models of the types of equipment listed in column 1 of Table 1, which can also be operated from other sources of energy, such as batteries, are excluded from this. The beginning of the labeling obligation The labelling requirement in accordance with § 3 shall begin at the time indicated in Table 1, column 2, for the individual types of equipment. 3. Data sheets The data sheets must comply with the requirements resulting from the Annexes to Directives 96 /60/EC or 2002 /40/EC listed in Table 1, column 4. They are to be written in German. 6. Equipment which has not been issued If a device subject to the labelling requirement in accordance with § 3 is offered on the routes described in § 5, the information must comply with the requirements arising from the appendixes listed in Table 1, column 5. of Directives 96 /60/EC or 2002 /40/EC. These requirements shall also apply to offers of built-in appliances for fitted kitchens. 7. Class classification The classes for energy efficiency and, where appropriate, further information on the characteristics of the device models shall be given in accordance with the Annexes to Directives 96 /60/EC or 2002 /40/EC listed in Table 1, column 6, in each case. Technical documentation The technical documentation referred to in § 6 shall contain the following information:
a)
the name and address of the supplier;
b)
a general description of the device model which is sufficient for identification,
c)
information and, where appropriate, drawings on the essential constructional characteristics of the device model, in particular those characteristics which have a significant impact on its energy consumption;
d)
reports on measurements carried out on the basis of European standards, which are relevant to the type of equipment in accordance with point 3 of this Appendix;
e)
Operating instructions when they are supplied to the device.

(2) The content of the labelling obligation shall be derived from the provisions of the regulations of the European Union referred to in paragraph 1.
Section 2:
Start of labelling requirements
The labelling requirement referred to in Section 1 shall begin at the time determined in the regulations of the European Union referred to therein.
