§ 1 Purpose of the Law

As a contribution to the presentation of energy supply and use of energy, in particular in the form of energy balances of the federal and state governments, for purposes of
1.
the design of the energy policy framework for a secure, economical and environmentally friendly energy supply,
2.
The fulfilment of the European and international reporting obligations of the Federal Republic of Germany
the statistical surveys referred to in § 2 shall be carried out as federal statistics. Unofficial table of contents

§ 2 Surveys

The statistics comprise the surveys
1.
in the electricity industry (§ 3),
2.
in the gas industry (§ 4),
3.
in the heat industry (§ 5),
4.
on coal imports and exports (§ 6),
5.
on renewable energy sources (§ 7),
6.
on the use of energy (§ 8).

§ 3 Surveys in the electricity industry

(1) The survey shall cover a maximum of 1 000 operators
1.
of installations for the production of electricity, including installations for the production of electricity and heat in coupling processes, on a monthly basis, information on the following survey characteristics:
a)
Generation of electricity or of electricity and heat according to the energy sources and process types used,
b)
Release of the decoupled heat to domestic consumers and exports,
c)
operating and own consumption, in each case of electricity or heat,
d)
Pumparbeit,
e)
Low-pass performance, available power, maximum capacity for electricity generation or electricity and heat at a cut-off date,
f)
Use hours of facilities in the coupling process,
g)
Reference, inventory and use of energy sources for the production of electricity or of electricity and heat, in each case also by species and heat content;
2.
of installations for the transmission or distribution of electricity on a monthly basis, data on the following survey characteristics:
a)
Supply of electricity from domestic supplier groups and imports, separated by country,
b)
Collection of electricity by domestic consumer groups and exports, separated by State,
c)
Network losses of electricity.
Electricity is to be supplied separately after production from conventional and renewable energy sources. (2) The survey shall cover all operators of installations for the production of electricity, including installations for the production of electricity. Generation of electricity and heat in coupling processes, for the transmission or distribution of electricity, and for third parties who use these facilities for distribution, annual data on the following survey characteristics for the previous year:
1.
Supply of electricity to domestic consumer groups and exports,
2.
Operating consumption of electricity,
3.
Proceeds from the supply of electricity to domestic customer groups as well as value of export,
4.
in the case of installations for the production of electricity and heat in coupling processes, the current characteristic C, as defined in Annex II to Directive 2004 /8/EC of 11 February 2004, in compliance with the guidelines for the implementation and application of Annex II.
The groups referred to in paragraphs 1 and 3 cover the sectors of industry, transport, households and other sectors. (3) The survey shall cover all operators of own-supply installations for the production of electricity. , including installations for the production of electricity and heat in coupling processes, annual data on the following survey characteristics for the previous year:
1.
Generation of electricity or of electricity and heat according to the energy sources and process types used,
2.
Purchase of electricity or heat from domestic supplier groups and imports,
3.
Supply of electricity or heat to domestic consumer groups and exports,
4.
Operating and own consumption of electricity or heat,
5.
the performance and the available power of the electricity or electricity and heat generation facilities on a cut-off date;
6.
Reference, inventory and use of energy sources for the production of electricity or of electricity and heat, in each case also by species and heat content,
7.
in the case of installations for the production of electricity and heat in coupling processes, the current characteristic C, as defined in Annex II to Directive 2004 /8/EC of 11 February 2004, in compliance with the guidelines for the implementation and application of Annex II.
(4) The information referred to in paragraph 1 (1) (e) shall also be provided for a period of 24 hours on a cut-off date. The information referred to in paragraph 2 (1) and (3) shall also be reported by country. Unofficial table of contents

§ 4 Surveys in the gas industry

(1) The survey shall cover a maximum of 100 operators of installations for the production, production or distribution of gas per month, including by gas type, on the following survey characteristics:
1.
Generation and production of energy sources used,
2.
Reference to domestic supplier groups and imports for domestic consumption, separated by Member State,
3.
storage balance,
4.
Operating and own consumption,
5.
Tax on domestic consumer groups and exports from domestic extraction and imports, separated by country.
(2) The survey shall cover annually for the previous year information for all operators of installations for the production, production, transmission or distribution of gas as well as for third parties using the equipment for distribution. by type of gas, to the following survey characteristics:
1.
Generation and production of energy sources used,
2.
Reference to domestic supplier groups,
3.
storage balance,
4.
Operating and own consumption,
5.
Levy according to domestic customer groups,
6.
the existence and use of energy sources for the production of gas, in each case also by species and heat content,
7.
Imports and exports, also by value, separately by country, in each case without transit quantities for other States,
8.
Transit quantities of others for other States,
9.
Proceeds from the levy according to domestic customer groups.
(3) The survey shall cover not more than 130 undertakings which submit liquefied gas to the final consumer or reseller, each year the survey characteristic of the supply of liquefied petroleum gas to domestic customer groups. (4) The information referred to in paragraph 2 (1) to (4) shall be: only in the case of operators not covered by paragraph 1. The information referred to in paragraph 2 (5) and (9) and paragraph 3 shall also be reported by country. Unofficial table of contents

§ 5 Survey in the heat industry

The survey shall cover at most 1 000 operators of heat-supply installations, including absorption systems for refrigeration, where they are not already covered by § 3, and in the case of third parties using these installations for distribution, Annual data on the following survey characteristics for the previous year:
1.
Generation of heat according to the energy sources used,
2.
Reference of heat to domestic supplier groups,
3.
Release of heat by domestic customer groups,
4.
the existence, reference and use of energy sources for the production of heat, in each case also by species and heat content,
5.
Operation and own consumption of heat,
6.
installed heat pass capacity on a cut-off date,
7.
Net loss of heat.
The information referred to in point 3 shall also be reported by country. The groups referred to in point 3 shall cover the sectors of industry, transport, private households and other sectors. Unofficial table of contents

§ 6 Survey on coal imports and exports

The survey shall cover the following survey characteristics on a monthly basis for all companies carrying out or running lignite, lignite, hard coal, coal coke or briquettes.
1.
Import and export, in each case also by species and values free German border, including costs, insurance and freight, after heat retention, after the delivery contract period, in each case by states separately,
2.
Population by species,
3.
Levy, also on the basis of coal and domestic customer groups.

Section 7 Surveys on renewable energy sources

The surveys cover annually for the previous year
1.
in the case of all operators of networks for general supply:
a)
the electricity fed into its network, which has been produced exclusively from hydropower, wind power, solar radiation energy, geothermal energy, bio-, landfill, sewage or mine gas, or from solid or liquid biomass,
b)
the number of installations the electricity produced is fed in,
c)
their installed capacity, broken down in each case by these energy sources and countries;
d)
the electricity produced and consumed by the feed itself, from energy sources as referred to in point (a), from installations with connection to the network of the network operator,
2.
in the case of a maximum of 6 000 operators of treatment plants, information on the following survey characteristics:
a)
Extraction of gas, even after heat content,
b)
Use of gas by type of use,
c)
Supply of gas to domestic customer groups and countries,
d)
production and supply of electricity by country;
3.
in the case of a maximum of 100 operators of facilities for the use of geothermal energy, information on the following survey characteristics:
a)
the nature and performance of the plant;
b)
produced heat by type of use,
c)
Levy of heat by domestic customer groups and countries;
4.
in the case of a maximum of 500 operators of installations for the production of fuels from biomass, information on the following survey characteristics:
a)
the nature and performance of the plant;
b)
The use of bioenergy carriers by type and by origin from Germany and abroad,
c)
produced biofuels by species,
d)
Delivery of biofuels by species, by domestic customer groups and by country, and imports and exports.
The energy content of the fuels is measured in accordance with Annex III to Directive 2009 /28/EC of the European Parliament and of the Council of 23 April 2009 on the promotion of the use of energy from renewable sources and amending and subsequent Repeal of Directives 2001 /77/EC and 2003 /30/EC (OJ L 197, 21.7.2003, p 16), as amended in each case.

§ 8 Survey on the use of energy

The survey shall cover a maximum of 60,000 farms in the mining sector, the extraction of stones and earth and the manufacturing industry annually for the previous year's data on the following survey characteristics:
1.
Reference, stock, consumption and supply of energy sources by species,
2.
energetic and non-energy use of energy sources.

§ 9 auxiliary characteristics

The auxiliary characteristics are:
1.
the name and address of the undertaking, the holding or the other bodies;
2.
names and telecommunications terminal numbers of the persons available for inquiries,
3.
Type and location of the plants.

§ 10 The obligation to provide information

(1) The information in accordance with § 9 No. 2 is voluntary; otherwise there is obligation to provide information. (2) Information should be provided for
1.
for the surveys according to § 3:
a)
the lines of undertakings, establishments or other facilities supplying energy to others, supplying electricity to another energy supplier or operating a general supply network,
b)
the lines of undertakings, establishments or other establishments which use the equipment for distribution;
c)
the lines of undertakings, undertakings or other facilities for the thermal recovery of waste,
d)
in addition, for the purposes of the survey referred to in Article 3 (3), the lines of undertakings or undertakings in the mining sector, the extraction of stones and the manufacturing or manufacturing industries, in so far as they operate power generation plants to meet their own needs;
2.
for the surveys according to § 4:
a)
the pipelines of gas supply undertakings,
b)
in the case of the survey in accordance with Article 4 (2), in addition, the lines of other facilities which are used by the installations for distribution,
c)
for the survey in accordance with Article 4 (3), the lines of undertakings which supply liquefied gas to the final consumer or reseller;
3.
for the survey according to § 5:
a)
the lines of undertakings, undertakings or other facilities for the supply of heat,
b)
the lines of undertakings, establishments or other establishments which use the equipment for distribution;
4.
for the survey in accordance with § 6, the lines of the undertakings;
5.
for the survey in accordance with Article 7 (1), the pipelines of energy supply undertakings operating networks for the general supply;
6.
in the case of the surveys referred to in Article 7 (2) to (4), the lines of undertakings, establishments or other establishments operating the installations;
7.
for the survey according to § 8 the lines of the holdings.

§ 11 The transfer of addresses

The competent authorities responsible for the approval or promotion of the installations referred to in § § 3 to 8 shall transmit the names and addresses of the operators to the statistical offices of the countries on request. Unofficial table of contents

§ 12 Collection and preparation

(1) The data on § 3 (3) of the Federal Statistical Office are prepared by the Federal Statistical Office. (2) The statistical offices of the Länder, at the request of the Federal Statistical Office, transmit the details of the statistical offices to be added to the Federal Statistical Office. and special preparations by the Federal Government. Section 13 Regulation authorisation

The Federal Ministry of Economics and Energy is authorized to limit the number of respondents by means of a regulation with the consent of the Federal Council for the surveys in accordance with § § 3 to 8, if this is the reliability of the results is not affected. Unofficial table of contents

Section 14 Delivery arrangements

(1) The Federal Statistical Office and the Statistical Offices of the Federal Statistical Office may apply to the highest federal and state authorities for use in relation to the legislative bodies and for the purposes of planning, but not for the regulation of individual cases. Countries tables with statistical results are transmitted, even if the table fields have only one case. (2) The Federal Environment Agency is allowed to comply with the obligations of the Federal Republic of Germany in order to comply with European and international law. Emission reporting, but not for the regulation of individual cases, of Statistical Federal Statistical Office tables with statistical results are transmitted, even if table fields have only one case. The tables may only be stored and used by the organisational units of the Federal Environment Agency responsible for this task. These organisational units must be separate from the organisational units of the Federal Environment Agency, which are dealt with by law enforcement tasks. (3) The Federal Network Agency may be responsible for the performance of national and international organisations. Europarechtlicher obligations for the performance of the internal energy market and for the energy transition, but not for the regulation of individual cases, are transmitted by the Federal Statistical Office tables with statistical results, even if table fields are only Have a single case. The tables may only be stored and used by the organisational units of the Federal Network Agency responsible for this task. These organisational units must be separate from the organisational units of the Federal Network Agency, which are dealt with by law enforcement tasks.
