§ 1

The burden sharing is the responsibility

1.

the supreme economic authorities of the Länder as territorial distribution agencies; by national law higher and lower administrative authorities as well as the municipalities as group, district and region slastdistributors can carry out tasks of burden sharing;

2.

the Federal Ministry for Economic Affairs and Energy as a federal load distributor.

§ 3

(1) In the case of the Federal Ministry for Economic Affairs and Energy and the supreme economic authorities of the Länder, special positions shall be set up for the implementation of the burden-sharing. They bear the names

Federal load distribution center for electrical energy, area load distribution center for electrical energy.

(2) To the extent to which group, district or area slastdistributors are to be determined in accordance with § 2 no. 1, special positions shall also be established in the case of these distributors. They bear the names

Group load distribution point for electrical energy, district load distribution point for electrical energy, range load distribution point for electrical energy.

§ 4

(1) The boundaries of the territorial distribution shall be the result of the annex to this Regulation. The authority to amend these limits by means of a legal regulation shall be conferred on the Federal Ministry for Economic Affairs and Energy. § 5

(1) The load distributors may issue orders

1.

to undertakings and undertakings producing, transmitting or distributing electrical energy,

a)

the production, transmission, transformation, re-tension, allocation, supply, reference and use of electrical energy;

b)

the manufacture, maintenance, delivery, transfer, use, repair and modification of fixed and movable equipment and means of production necessary for the supply of electrical energy;

c)

the storage, stockpiling, supply and use of industrial goods necessary for the supply of electrical energy;

2.

to consumers about the allocation, the reference and the use of electrical energy and the exclusion from the use of electrical energy.

(2) The distributors may, within a specified period, require undertakings and undertakings which produce, transmit or distribute electrical energy, and consumers, to enter into contracts of the content referred to in paragraph 1 of this Article. , or to conclude new contracts of this content, in so far as the desired conduct cannot or cannot be achieved in good time by the application of existing contracts. In the case of a service, the normal fee or, in the absence of such a service, an appropriate fee shall be fixed; for the other terms and conditions of the contract, the same shall apply. § 6

The local authority is the load distributor, in its district

1.

the premises of an undertaking or establishment affected by a service provided for in Article 5 (1) (1); the premises also include those not occupied by operating personnel, the supply of electrical energy to consumers equipment used;

2.

the electricity supply point of the premises of a consumer, which is subject to a service provided for in Article 5 (1) (2).

§ 6a

(1) The head of a load distribution centre must be well acquainted with the technical load distribution and the supply-related conditions and the consumption structure of its load distribution. (2) To the head of a load distribution point, a senior A member of the electricity supply undertaking shall be appointed to which the supply of the respective load distribution area is wholly or partly responsible. The employment relationship with its electricity supply company shall remain unaffected. § 7

An advertisement according to § 5 of the Energy Economics Act or an authorisation pursuant to § 4 (1) of the Energy Economics Act does not require, insofar as the activity subject to notification or approval by a disposition pursuant to § 5 (1) No. 1 of this Act Regulation has been ordered. § 8

Anyone who intentionally or negligently is contrary to a fully-accessible disposition pursuant to section 5 (1) deals with an infringement within the meaning of Section 18 of the German Economic Protection Act (Economic Protection Act), which is punished in accordance with the 1954 Economic Criminal Law. § 9

The competent administrative authority within the meaning of Section 21 (2) of the German economic security law is the authority which has issued the order in accordance with § 5. Unofficial table of contents

§ 10

The Senate of the Länder of Bremen and Hamburg is hereby authorized to adapt the provisions of this Regulation on the competence of the authorities to the special administrative structure of their countries. Unofficial table of contents

§ 11

(1) This Regulation shall enter into force on the day following the announcement. (2) It may only be applied in accordance with Article 80a of the Basic Law pursuant to Article 80a of the Basic Law and only if it is the Federal Ministry for Economic Affairs and Security (3) Articles 2 and 4 shall apply with the entry into force of the law.
