§ 1 Enforcement of certain provisions of Regulation (EC) No 999/2001

Contrary to Regulation (EC) No 999/2001 of the European Parliament and of the Council of 22 May 2001 laying down rules for the prevention, control and eradication of certain products, the provisions of Article 32 (2) (8) of the Animal Health Act are in breach of Regulation (EC) No 999/2001 of the European Parliament and of the Council of 22 May Transmissible spongiform encephalopathies (OJ L 136, 30.4.2004, p. EC No 1), as last amended by Commission Regulation (EC) No 571/2008 of 19 June 2008 (OJ L 145, 31.5.2008, p. EU No 4), by intentionally or negligently

used in accordance with Article 9 (2), first sentence, bone,
1a.
a enforceable order pursuant to Article 12 (1) (1) to (4) or (2) or Article 13 (1) (1) of the first subparagraph;
2.
shall, without the authorisation referred to in Article 13 (2), produce a TSE-susceptible animal or an animal product produced from it,
2a.
in accordance with Article 15 (1), first sentence, in conjunction with Annex VIII, Chapter A, Section I, point (a), point (ii), to the placing on the market of an animal or a product referred to therein,
3.
, contrary to Article 15 (2), placing on the market an animal of the first generation of progeny of a TSE suspect or TSE-infected animal or semen, an embryo or an oocyte of such an animal,
3a.
, contrary to Annex IV, Section III, Chapter E, No 1, or to the product referred to in Annex IV, Section III, Chapter E, No 2, to a product or product referred to in that section,
4.
, contrary to Annex VIII, Chapter C, Part B, a product referred to in Annex VIII, Chapter C, Part A, shall be carried out within the Community
5.
contrary to Annex IX
a)
Chapter B, Part B or C, a bovine animal,
b)
In Chapter C, Part B, C or D, a product referred to in Annex IX, Chapter C, Part A,
c)
Chapter D, Part B, an animal by-product referred to in Part A,
d)
Chapter E (a) or (b) a sheep or goat,
e)
Chapter F, a product referred to therein; or
f)
Chapter H Seeds or an embryo

§ 2 Entry into force

This Regulation shall enter into force, subject to the provisions of the second sentence, on the day following the date of delivery. § 1 nos. 6 to 8 shall take place on the 1. October 2001, in force.
