§ 1

(1) By way of derogation from the first sentence of Article 8 (1) in conjunction with Annex V (4.1) (a) of Regulation (EC) No 999/2001 of the European Parliament and of the Council of 22 June 2001, May 2001 laying down rules for the prevention, control and eradication of certain spongiform encephalopathies (OJ L 136, 31.5.2001, p. EC No 1), as last amended by Commission Regulation (EC) No 746/2008 of 17 June 2008 OJ L 327, 31.12.2008, p. 21 June 2008 (OJ C 327, EU No 11), a slaughterhouse skull without a lower jaw, but including brain and eyes, does not have to be removed from the heads of bovine animals aged over 12 months if the heads concerned are
1.
in compliance with the requirements of Article 8 (1) sentence 1 in conjunction with Appendix V No. 9 Point (a) to (d) of Regulation (EC) No 999/2001 have been obtained and treated, and
2.
under official supervision shall be carried to a cutting plant (
)
competent authority may prohibit a slaughterhouse from carrying the heads referred to in paragraph 1 if the requirements referred to in paragraph 1 are not met. Non-official table of contents

§ 2

(1) By way of derogation from the first sentence of Article 8 (1) in conjunction with Annex V (4.1) (a) of Regulation (EC) No In 999/2001, the competent authority may, at the request of cutting plants, authorise the production of head meat of the heads of bovine animals over 12 months old.(2) The competent authority may grant authorisation in accordance with paragraph 1 only if
1.
the applicant
a)
a representation of the workflow in the extraction of head meat
aa)
in the slaughterhouses, from which heads are transported to the applicant's operations , and
bb)
in the cutting operation
b)
in connection with the Introduction of specific working conditions in accordance with the first sentence of Article 8 (1) in conjunction with Annex V (9) (e) (iii) of Regulation (EC) No 999/2001 Working instructions for all workers at work places where heads are treated,
aa)
the critical workplaces and work steps where an impurity of Meat with specified risk material appears possible, and
bb)
the areas of the product concerned, each of which is affected by a possible contamination of the Head

2.
the applicant ensures that the requirements of the first sentence of Article 8 (1) in conjunction with Annex V, point 9 Point (e) and (f) of Regulation (EC) No 999/2001 are complied with
3.
after examination of the documents referred to in point 1 (a) and (b), an impurity of Meat with specified risk material shall be excluded.
The authorization referred to in paragraph 1 shall be granted subject to the reservation to withdraw it if the requirements of the first sentence are no longer met. The authorisation may, even subsequently, be subject to conditions where it is necessary to ensure compliance with the requirements of the first sentence.(3) The competent authority shall revoke the authorisation in accordance with paragraph 1, without prejudice to the provisions of paragraph 49 of the Administrative Procedure Act, if the requirements of the first sentence of paragraph 2 are no longer met.
