§ 1

(1) By way of derogation from the first sentence of Article 8 (1) in conjunction with Annex V (4.1) (a) of Regulation (EC) No 999/2001 of the European Parliament and of the Council of 22 May 2001 laying down rules for the prevention, control and eradication of certain products spongiform encephalopathies (OJ L 327, 30.4.2004 EC No 1), as last amended by Commission Regulation (EC) No 746/2008 of 17 June 2008 (OJ L 145, 31.5.2008, p. EU No 11), a slaughterhouse skull without a lower jaw, but including brain and eyes, does not have to be removed from the heads of bovine animals over 12 months of age if the heads concerned are
1.
have been obtained and treated in accordance with the requirements laid down in Article 8 (1), first sentence, in conjunction with Annex V (9) (a) to (d) of Regulation (EC) No 999/2001, and
2.
shall be carried under official supervision to a cutting plant which has been granted a permit pursuant to Article 2 (1).
The competent authority may prohibit a slaughterhouse from carrying the heads referred to in paragraph 1 if the requirements referred to in paragraph 1 are not complied with. Unofficial table of contents

§ 2

(1) By way of derogation from the first sentence of Article 8 (1) in conjunction with Annex V (4.1) (a) of Regulation (EC) No 999/2001, the competent authority may, at the request of cutting plants, obtain the production of head meat of the heads of more than 12 months old (2) The competent authority may grant the authorisation referred to in paragraph 1 only if:
1.
the applicant
a)
a presentation of the working sequence in the extraction of head meat
aa)
in the slaughterhouses from which heads are transported for the operation of the applicant, and
bb)
in the cutting operation,
b)
in connection with the introduction of specific working conditions in accordance with the first sentence of Article 8 (1) in conjunction with Annex V (9) (e) (iii) of Regulation (EC) No 999/2001, working instructions for all employees in workplaces where: Heads treated, under appointment
aa)
critical workplaces and work steps where contamination of meat with specified risk material seems possible; and
bb)
the areas of the head affected by a possible contamination
shall be presented for consideration,
2.
the applicant ensures that the requirements of the first sentence of Article 8 (1) in conjunction with Annex V (9) (e) and (f) of Regulation (EC) No 999/2001 are complied with,
3.
after examination of the documents submitted in accordance with point 1 (a) and (b), an impurity of meat with specified risk material is excluded.
The authorisation referred to in paragraph 1 shall be granted subject to the reservation that it shall be revoked if the requirements of the first sentence are no longer met. The authorisation may, even subsequently, be subject to conditions to the extent that this is necessary to ensure compliance with the requirements of the first sentence. (3) The competent authority shall have the authorisation, without prejudice to Article 49 of the Administrative procedural law corresponding to national law provisions, in accordance with paragraph 1, if the requirements of the first sentence of paragraph 2 are no longer fulfilled. § 3
