§ 1 Legal form of the foundation

Under the name "Stiftung ReichPresidents-Friedrich-Ebert-Gedenkstätte" (Stiftung ReichPresidents-Friedrich-Ebert-Gedenkstätte), headquarted in Heidelberg has established a legal foundation under public law. The Foundation shall come into force with the entry into force of this Act. Non-official table of contents

§ 2 Foundation Purpose

(1) The purpose of the foundation is to commemorate the work of the first German President Friedrich Ebert to maintain and to contribute to the understanding of the German history of his time.(2) The performance of this purpose shall, in particular, be as follows:
1.
Setup, Entertainment and Expansion of the public memorial "Stiftung Reichsidents-Friedrich-Ebert-Memorial" in Heidelberg;
2.
Setting up and entertainment of a memorial site in Heidelberg Archive in addition to Research and Documentation Center in Heidelberg;
3.
Scientific investigations;
4.
Events for the purpose of the foundation purpose.

§ 3 Foundation assets

(1) The assets of the Foundation are those immovable and movable property which the Federal Republic of Germany acquires for the purpose of the Foundation.(2) The Foundation shall be entitled to accept grants from third parties.(3) In order to fulfil the purpose of the foundation (§ 2 para. 1), the foundation shall receive an annual grant from the federal government in accordance with the respective federal budget.(4) The performance of the Foundation's assets and other income shall be used only in the sense of the purpose of the foundation. § 4 Statutes

The foundation is set up by the Board of Trustees by a majority of four fifths of its members. and the approval of the Federal Government Commissioner for Culture and the Media needs to be approved. The same shall apply to amendments to the Articles of Association. Non-official table of contents

§ 5 Institutions of the Foundation

§ 6 Board of Trustees

(1) The Board of Trustees consists of five members, who are appointed by the Federal President for the Duration of five years is to be ordered. Two members are proposed by the Federal Government, one member each is proposed by the State of Baden-Württemberg and the city of Heidelberg; the fifth member elects the Federal President. A representative shall be ordered in the same way for each of the five members. Repeated order is allowed.(2) If a member of the board of trustees or his representative is prematurely divorcing, an appointment of the successor may be effected only for the remainder of the time for which the member or the representative was appointed.(3) The Board of Trustees shall elect a Chairperson and his deputy.(4) The Board of Trustees shall decide on all fundamental questions which are part of the remit of the Foundation. § 7 Board of Directors

(1) The Executive Board is made up of three members. They are appointed by the Board of Trustees by a majority of four fifths of its members, including a board member on a proposal from the Federal Government Commissioner for Culture and the Media Affairs. The articles of association may stipulate that the member proposed by the Federal Government Commissioner for Culture and the Media shall be Chairman of the Board of Management.(2) The Board of Management shall execute the decisions of the Board of Trustees and shall conduct the operations of the Foundation. He represents the Foundation in court and out of court.(3) The provisions of the Statute shall be laid down in detail. Non-official table of contents

§ 8 Non-official and honorary activity

The members of the Board of Trustees and the Board of Management are, as far as they are not Volunteer work on the side of the programme. Non-official table of contents

§ 9 Supervision, Budget, Auditing

(1) The Foundation is subject to the supervision of the Federal Government Commissioner for Affairs of culture and media. In the performance of its tasks, the Foundation is supported by the Federal Archives; the Federal Government Commissioner for Culture and the Media regulates the nature and scope in consultation with the Board of Trustees.(2) The provisions applicable to the Federal Administration shall apply to the budget, treasury and accounting system as well as to the accounts of the Foundation. § 10 employees

(1) The business of the foundation is usually carried out by employees (employees and workers) perceived.(2) The employees of the Foundation shall be subject to the collective agreements and other provisions applicable to employees of the Federal Government.(3) The Foundation may be granted the right to have officials by means of statutes. § 11 Fees

§ 13 Berlin clause

This law occurs on the 1. 1 January 1987.
