§ 1 Scope

The provisions of Annex A to this Regulation shall apply to shipping on the river Danube between Kehlheim (km 2414,60) and Jochenstein (km 2201.77). Unofficial table of contents

§ 2 Exceptions

Signal lights may also be used on vehicles with a travel certificate in accordance with § § 5 and 6 if they comply with the requirements of Annex II to this Regulation in place of the requirements of Annexes 4 and 5 to Appendix A to this Regulation. § 3 Competent Authority

(1) Competent authority within the meaning of Article 6.32 (1) (a) of Annex A to this Regulation is the Federal Ministry of Transport. (2) Unless otherwise specified in paragraphs 4 and 5, the competent authority shall be the competent authority within the meaning of this Regulation. April 1955, concluded in accordance with Section 1 (1) (2) of the Inland Waterways Act, the police forces of the Land of Bavaria. (5) Competent authority for the affixing of the sunset marks in accordance with section 2.04 (1) of Annex A to this Regulation and the In accordance with § 2.04 (2) of Annex A to this Regulation in conjunction with Annex 2 (3) and (4) to Annex A to this Regulation, the central office of the Shipboard Investigation Mission/Shipyards (6) shall be subject to the conditions laid down in § 48. or 49 of the Administrative Procedure Act, the competent authority may, after Annex A to this Regulation, also permit a temporary and conditional connection to this Regulation. § 4 Vehicles of the public service

Vehicles of the Water and Shipping Administration of the Federal Government, the Water Protection Police, the Civil Order Police, the Federal Police, the Armed Forces, the Customs Service, the Fire Brigade, the Civil and Civil Protection and the Civil and Civil Protection Service, as well as the Water management administrations are exempted from the provisions of Annex A to this Regulation to the extent that this is urgently required for the performance of public functions, taking into account public security and order. § 5 Administrative Offences pursuant to the Inland Waterway Task Act

(1) Contrary to the provisions of Section 7 (1) of the Inland Waterway Act, who intentionally or negligently acts

1.

a fully-retractable requirement pursuant to section 1.21 (3) or 7.01 (2) of Appendix A to this Regulation, including in conjunction with Section 3 (6), or

2.

one with a permission pursuant to § 1.23, § 3.48 No. 2 (b), § 3.49 sentence 2, § 8.10 letter c, § § 10.03, 11.07, 11.11, 13.04, 13.06 No. 2 or § 14.02 No. 2 of Appendix A to this Regulation, also in conjunction with § 3 paragraph 6, connected full-size edition

(2) A breach of order within the meaning of Section 7 (1) of the Act on Inland Waterways Act, which violates a provision of Annex A to this Regulation, by intentionally or negligently

1.

contrary to Section 1.03 (1) sentence 1 or No 2, the ship ' s guide shall not be followed by the ship ' s guide,

1a.

Contrary to § 1.09 (2) sentence 1, it is not in a position to give or receive any instructions or information,

2.

, contrary to § 1.13 no. 1, a ship's mark is used, damaged or unusable,

3.

, contrary to § 1.15 (1), fixed articles or other substances or, contrary to § 1.15 (2) sentence 1, enter or initiate oil residues into the waterway,

4.

Contrary to Article 1.17 (1), second sentence, it shall not remain on board or in the vicinity of the accident site;

5.

Contrary to § 1.23, one of the events referred to therein shall be carried out or carried out without authorization,

6.

Contrary to § 4.01 (3) sentence 1, the sound of a vehicle on which the leader of the association is not located,

7.

, contrary to § 6.17 no. 3, attached to a vehicle or a floating body, hanging on it or driving in the sogwater,

8.

, as a person who exercises water sports without a vehicle, does not keep sufficient distance, contrary to Section 6.17, point 4,

9.

against § 6.36 fishing or fishing equipment,

10.

in accordance with § 6.37, in places where shipping could be impeded,

10a.

contrary to the second sentence of Article 8.02a (2), the rate or speed of a vehicle is determined despite the fact that it has a blood alcohol concentration of 0.8 or more per mille or an amount of alcohol leading to such a concentration of blood alcohol in the body,

11.

Contrary to § 14.02 No. 2 sentence 1, a statement of supervision is not followed,

12.

a provision of § 14.03 Nos. 1, 3 or 5 on the boarding or disembing of passengers or of § 14.05 No. 3 on safety on board or at the landing places; or

13.

a provision of section 14.03, no. 2 or 4, relating to the boarding or exit of passengers.

(3) An administrative offence within the meaning of Article 7 (1) of the Act on Inland Waterways Act shall be deemed to be contrary to a provision of Annex A to this Regulation by intentionally or negligently acting as the ship's guide, the leader of a floating installation, or Responsible person according to § 8.02 for course and speed

1.

Contrary to Article 1.19 (1) of a fully-enforceable instruction of officials of the competent authorities,

2.

Contrary to § 3.01 no. 2, the additional signs are not set,

3.

Lights which do not comply with § 3.02 or require other lights or visual signs contrary to § 3.05 no. 1 or may be used in circumstances for which they are not required or approved,

4.

Contrary to § 3.06 sentence 1 or 3 lights, does not set or does not set in time,

5.

a provision of § 3.07 concerning the use of signal lights, headlights, boards, flags or other objects, or

6.

a vehicle, a bandage, a floating body or a floating installation

a)

at night during the journey according to § 3.08 No. 1, 3, § 3.09 No. 1 to 3 sentence 1, § 3.10 No. 1, also in conjunction with No. 2, § 3.11 No. 1, also in connection with No. 2, § 3.12 No. 1, § 3.13 No. 1 letter a sentence 1, letter b, c, no. 3, 4 sentence 1, no. 5, 6, § § 3.14 to 3.16, 3.18 or 3.19 or

b)

§ 3.30 bis 3.32 no. 1, 2, 3 sentence 2, § 3.33 no. 1, 2, 3 sentence 2, § 3.34 sentence 1, § § 3.35 or 3.36

not or not in the prescribed manner.

(4) An administrative offence within the meaning of Article 7 (1) of the Act on Inland Waterways Act, which violates a provision of Appendix A to this Regulation, by intentionally or negligently acting as a ship's guide or leader of a floating installation

1.

Contrary to § 1.04, the necessary precautions are not taken and, as a result, the life of another person is at risk, a vehicle, a float, a shore, a control structure or any other plant mentioned there, which hinders the navigation of the ship, or the Danube pollutes,

2.

a vehicle or a floating body, on which, contrary to § 1.12 No. 1, objects project beyond the sides,

3.

Contrary to § 1.12, no. 3, sentence 1, a report shall not be made or not made in due time, or contrary to the second sentence of Article 1.12 (3), the loss office shall not

4.

Carry out a special transport without permission in accordance with § 1.21 No. 2,

5.

a provision of section 3.03 on boards or flags,

6.

a vehicle, a bandage, a floating body, a floating facility, a floating device, a fishing gear or an anchor

a)

at night during the closing of the period pursuant to § 3.20 No. 1, 2, § § 3.21 to 3.23 No. 2 sentence 1, 3, § 3.25 sentence 1, § § 3.26, 3.27 No. 1, 2 or § 3.28 or

b)

in accordance with § 3.36a no. 1, § § 3.37, 3.38, 3.40, 3.41 No. 1, 3 sentence 1, no. 4 or § 3.42

not designated or not in the prescribed manner, or

7.

a provision on

a)

In accordance with § § 7.01, 7.05 No. 1 to 5, § § 7.06, 7.07 No. 1, § 13.10 No. 1, 2 Half-sentence 1, No. 3, 4 or § 13.11 No. 1 to 4, the anchorage according to § 7.03 or the arrest or the arrest in accordance with § § 7.04 or 14.01 or

b)

by guard or supervision in accordance with § 7.08 No.1, 3 sentence 1 or § 8.14 No. 1 sentence 1 or 2, also in conjunction with sentence 4,

shall be contrary.

(5) An administrative offence within the meaning of Article 7 (1) of the Act on Inland Waterways Act acts as to who is in breach of a provision of Annex A to this Regulation by intentionally or negligently acting as a ship's guide or in accordance with § 8.02 for the course and Speed responsible person

1.

a vehicle, a bandage or a swimming body, the length, width, height, draught or speed of which are not adapted to the conditions of the waterway or the installations to be used, contrary to § 1.06,

2.

a vehicle on which an outcast or item is not situated in accordance with the fourth sentence of Article 1.09 (2),

3.

Contrary to § 3.49, sentence 2, the name shall be without written permission,

4.

contrary to Article 4.01 (1) (a) (1) or (b) (1) (1) (a) (1) (b), 1 (1) of the

5.

in accordance with § 4.01 No. 6 sentence 1 or § 4.02 No. 1 in conjunction with Appendix 6 to Annex A to this Regulation, the necessary sound signs are not properly provided,

6.

Contrary to § 4.01 No. 2 sentence 1 with the sound signs, there are not simultaneously equal signs of light,

7.

Contrary to § 4.03 No. 1 of the German Sound Mark, or contrary to § 8.13 of the German Sound Signs,

8.

Contrary to Article 5.01 (2), in conjunction with point 1, an order is not followed by a sign referred to in Annex 7 (I) (A) or (B),

9.

a provision on

a)

the driving rules for high-speed vehicles or small-scale vehicles in accordance with the first sentence of § 6.01a, section 6.02 No.2 or 6.03a No 3 or 4 sentence 1 or 2,

b)

§ 6.05 No. 1 sentence 2, No. 2 to 5 sentence 1, § 6.06 to 6.08 No. 1, 3 or § 13.01 No. 1, 2 sentence 2, also in conjunction with No. 3 or 4, overtaking according to § 6.03 No. 1 up to 3, § 6.09 No. 1, 2 sentence 1, 2, § 6.10 No. 2 sentence 1, No. 4 to 7, § 6.11 sentence 1, § 6.26 No. 3, § 6.28 No. 4 or § 6.32 no. 7 or crosses pursuant to § 6.03a No. 1 sentence 1 or 2,

c)

the journey on routes with a prescribed course in accordance with § 6.12 no. 2,

d)

the behaviour or drawing of the drawing in accordance with § 6.13 No. 1 to 3, 5 sentence 1 or § 13.13 No. 1 sentence 1 or no. 2 or at the departure according to § 6.14,

e)

the behaviour or the sign of crossing the waterway or the entrance to or exit from ports or secondary waterways according to the first sentence of § 6.16 (1), (2), (2), (3), first sentence, (4) or (5),

f)

the behaviour in order to avoid any risk of wave impact or suction in accordance with Article 6.20 (1) or (3),

g)

the operation, the driving, lying or loading of ferries in the water according to § 6.23,

h)

the passage or the conduct in the passage of bridges or weirs according to § 6.24 No. 1, 2 letter a, § 6.25 No. 1, § 6.26 No. 1, 2 or § 6.27 No. 2,

i)

the obligation to provide information, the behaviour in the area of the lock or the passage of the boat locks, boat alleyways or relaying facilities in accordance with § 6.28 No. 1, 2, 3 sentence 3, 4, No. 4 to 8 sentence 1, No. 11 sentence 2, § 6.28a No. 4, § 6.29 sentence 2, § 13.05 No. 1 sentence 1, 2 to 7 sentence 1, no. 8, 9, § 13.06 No. 1 sentence 1, No. 2, § 13.07 No. 1 sentence 1, No. 2 sentence 1 or § 13.08 No. 3 letter a sentence 1, letter b or No. 4,

j)

the behaviour or the drawing during the journey in the case of limited visibility in accordance with § 6.30 No. 1 sentence 1, 3, 4, 2, 3 sentence 2, no. 4 to 6 sentence 1 or § 6.33 no. 2 or 5, or

k)

the behaviour in the perception of the three-tone character in accordance with § 6.33 No. 4

shall be contrary to

Contrary to § 6.17 no. 1, the vehicle is travelling on the same level with a vehicle or is approaching in more detail than is permitted in section 6.17 no. 2,

11.

, in accordance with § 6.18 (1), 2 (2) or 6.27 (no. 1), anchors, trosses or chains are allowed to be ground,

12.

In accordance with § 6.19 (1) sentence 1, driving the vehicle,

13.

contrary to § 6.22 before the prohibition sign, does not stop or, contrary to § 6.22a, moves past the vehicles referred to in § § 3.27 or 3.41,

14.

Contrary to § 6.35 No. 4, the tow rope is draining empty,

15.

Contrary to § 10.04 No. 1, a skilled trawling group does not turn up or

Contrary to § 12.01 No. 1 sentence 1, an Altwasser is sailing.

(6) An administrative offence within the meaning of Article 7 (1) of the Inland Waterway Act is to be in breach of a provision of Appendix A to this Regulation by intentionally or negligently acting as a ship's guide

1.

Contrary to § 1.02 no. 3 during the journey or the operation, it is not on board,

2.

Contrary to § 1.02 N ° 4, sentence 2, sentence 1, also in conjunction with sentence 3, a statement of the ship's guide of the association is not followed,

3.

is carrying a vehicle,

a)

which, contrary to § 1.07 No. 1, is downloaded more deeply than is permitted,

b)

the cargo of which, contrary to § 1.07, no. 2, endangers the stability of the vehicle or adversely affects the view from the tax base,

c)

which, contrary to § 1.07 No. 3, has more passengers than has been admitted on board;

d)

the rowing of which, contrary to § 1.09 No. 1, is filled with a person who is not technically suitable for this purpose or not at least 16 years old,

e)

which is not marked in accordance with Section 2.01 (1) to (3), (6) or (2) (2), (2), (2) or (3), or is not marked in accordance with the rules;

f)

on board, contrary to § 8.05 sentence 2, an imprint of Appendix A to this Regulation or of a regulation pursuant to § 8.05 sentence 1 is not carried out in the applicable version in each case, or

g)

which, contrary to § 13.04 No. 2 sentence 1, dives deeper than admissible or the lock passes without permission in accordance with § 13.04 No. 2 sentence 2,

4.

a vehicle or a floating body,

a)

on board of which, contrary to § 1.10 (1) (a), (b), (d), (d), (3) or (8), No. 1, sentence 1, one of the documents referred to therein is not located or, contrary to § 14.05 (5), sentence 3, a stability calculation is not carried out, or

b)

in which, contrary to Article 1.12 (2), a forerunned anchor projects under the ground, the keel or the lower level,

5.

Contrary to § 1.12 No. 4, § 1.13 No. 2, 3, § § 1.14, 1.15 No. 2 sentence 2, § 1.17 No. 1 sentence 1, No. 3, § 8.15 No. 8 or § 13.09 a report does not or does not make a notification in time or contrary to § 13.12 sentence 4 its position is not known,

6.

Contrary to § 1.16 no. 2, it does not provide assistance or does not provide assistance in good time if there is a risk of a blocking of the water

7.

, contrary to § 1.17 (2), does not provide a warning in due time or not in the prescribed manner,

8.

Contrary to § 1.18, the necessary measures to free the water are not taken,

a vehicle on which the prohibition of entering under Section 3.43, the smoking or use of unprotected light or fire in accordance with § 3.44 or the close-up is not referred to in accordance with Article 3.47 (1) or (2) or not in accordance with the proper rules ,

13.

shall be contrary to a provision relating to radio communications in accordance with Section 4.04 (4) or 10.02 (1) or (4) sentence 1 or 3,

14.

In contrast to § 6.15, the distance between the parts of an entrainers ' association is reached,

15.

a provision on

a)

the compilation of associations according to § 6.21 No. 1, 2 or 4,

b)

The drawing of a stylistic system in the case of limited visibility in accordance with § 6.31 no. 1 or 2 or

c)

the journey with radar in accordance with § 6.32 (2) sentence 1, 4 (a), 5 (a), 5 (a), (6) or (7), also in conjunction with point 8,

shall be contrary to

16.

Contrary to Article 6.21, point 3, with a vehicle equipped with a machine drive, other towed vehicles, whether or not carried along with the vehicle, are left in the form of a vehicle,

16a.

contrary to § 8.02a no. 1 sentence 2, although it has a blood alcohol concentration of 0.8 or more per mille or an amount of alcohol which leads to such a concentration of blood alcohol, in the body,

16b.

, or admitting that, contrary to Section 8.02a (2) sentence 2, someone determines the course or speed of the vehicle, even though it has a blood alcohol concentration of 0.8 or more per mille or an amount of alcohol to such an extent as blood alcohol concentration, in the body,

17.

contrary to § 8.15 No. 1 sentence 1 or 3, the lead-away signal does not trigger,

18.

contrary to § 8.15 (3) to (5) or (7), when the lead-away signal is perceived, the measure does not meet any of the measures referred to therein,

19.

a vehicle or an association which exceeds the dimensions or groupings approved in sections 9.01 to 9.04 or 13.04 No 1,

20.

Contrary to § 10.01 No. 1 sentence 1, the shipping does not cease,

21.

an attempt to free a fixed vehicle without permission in accordance with § 10.03,

22.

Contrary to Article 10 05 (1) of the European Parliament, contrary to Article 10 (1),

23.

a provision of the first sentence of § 10.06 No. 1, 2 sentence 2 or § 10.08 sentence 1 on the carrying or moving of vehicles or drawers in an association,

24.

Contrary to § 10.07, outside a wheelset, it moves a school lead or another vehicle without a rudder system,

25.

Contrary to § 13.02, sentence 1, the vehicles or bodies referred to therein shall be used,

26.

Contrary to § 14.02 No. 1, a landing site is not or is not released in due time or is applied without permission in violation of § 14.02 No. 2 sentence 2,

27.

a requirement for safety on board or at the landing places in accordance with Section 14.05 (2), (4) or (5) sentence 1 or 4; or

28.

In contrast to § 14.06, the passenger ship is coupled with a passenger ship, drags it or uses it for towing.

(7) An administrative offence within the meaning of Article 7 (1) of the Act on Inland Waterways Act is to be contrary to a provision of Annex A to this Regulation by intentionally or negligently acting as owner or equipment supplier.

, or admises that, contrary to the provisions of the first sentence of Article 1.02 (1) or (5), the first sentence of paragraph 1, in each case also in conjunction with Article 1.21 (4), a vehicle, a floating body, a floating installation or a special transport shall be carried out by an unsuitable person,

2.

orders or permits the guidance of a vehicle, an association or a floating body, the length, width, height or draught of which are not adapted to the conditions of the waterway or the installations to be used, contrary to § 1.06,

3.

ordering or allowing a vehicle to be put into service,

a)

which, contrary to § 1.07 No. 1, is downloaded more deeply than is permitted,

b)

the cargo of which, contrary to § 1.07, no. 2, endangers the stability of the vehicle or adversely affects the view from the tax base,

c)

which, contrary to § 1.07 No. 3, has more passengers than has been admitted on board;

d)

which is not marked in accordance with Section 2.01 (1) to (3), (6) or (2) (2), (2), (2) or (3), or is not marked in accordance with the rules;

e)

which is not sufficient, contrary to § 2.03, or

f)

which, contrary to § 13.04 No. 2 sentence 1, dives deeper than admitted or does not have the necessary permission in accordance with § 13.04 No. 2 sentence 2 to pass through the lock,

4.

The entry into service of a vehicle or a floating body on board which, contrary to § 1.10 (1) (a), (b), (d), (3) or § 8.04 (1), first sentence, is not located or contrary to § 14.05 (5) sentence 3 of the first sentence of the third sentence of the third sentence of the third sentence of the third sentence of a stability calculation is not carried out,

5.

carrying out a special transport without permission in accordance with section 1.21 (2);

6.

does not ensure that floating bodies or floating installations are identified in the manner prescribed in the first sentence of section 3.25, sentence 1,

7.

does not ensure that the vehicle is notified in accordance with § 3.44 or the Stilliegen in accordance with section 3.47 (1) or (2) of the ban on entering under Section 3.43, the smoking or the use of unprotected light or fire in accordance with § 3.44 or the style of the condition,

8.

shall be ordered or allowed to:

a)

a vehicle without the telephone system prescribed in accordance with Section 6.30 (1), second sentence, which must be in a sound operating condition; or

b)

a vehicle with a machine drive, a floating device or a free-running ferry without the equipment required pursuant to § 10.02 No. 1 sentence 1

is put into operation,

9.

orders or permits the radar travel of a vehicle in whose tax house, contrary to § 6.32 (2), the persons referred to there are not staying,

10.

Contrary to § 7.08 Nos. 1, 3 sentence 1 or § 8.14 (1) sentence 1, it is not ensured that an operating guard is constantly in a position on a stilted vehicle,

11.

Contrary to the second sentence of Article 8.14 (1), even in connection with the fourth sentence, it is not ensured that the vehicles, floating bodies or floating installations referred to therein are under the supervision of a person who is able to intervene if necessary,

12.

orders or permits the management of a vehicle or of an association which exceed the dimensions or groupings approved in sections 9.01 to 9.04 or 13.04 No 1,

13.

, or allows an attempt to obtain a fixed vehicle without permission in accordance with § 10.03,

14.

shall be ordered or allowed to:

a)

Contrary to § 10.05 No. 1, a pusher is engaged in a trawling activity, or

b)

Contrary to § 10.06 No. 1 or § 10.08 sentence 1 in an association, a vehicle is carried on or contrary to § 10.06 No. 2 sentence 2 a wheelbarn is moved, or

15.

Contrary to § 13.02, sentence 1, the use of one of the vehicles mentioned there, floating bodies or objects is arranged or allowed to be used.

§ 6 Administrative Offences in accordance with the Federal Waterway Act

(1) An administrative offence within the meaning of Section 50 (1) (2) of the Bundeswasserstraßengesetz (Bundeswasserstraßengesetz) acts as a ship's leader intentionally or negligently to a provision of Appendix A to this Regulation on

1.

the use of the ports in accordance with § 11.02 (1) sentence 1 or (2),

2.

the entrance to the protective harbour Deggendorf in accordance with § 11.02 no. 1 sentence 3,

3.

the registration or logout in accordance with § 11.04 no. 1,

4.

the catching-up pursuant to § 11.04 No. 2 sentence 2,

5.

the appointment of a supervisor according to § 11.05,

6.

the anchorage according to § 11.06 sentence 1,

7.

the conduct in the port entrance according to § 11.07,

8.

the display of incidents pursuant to § 11.08,

9.

The catching or handling of fire extinguishers according to § 11.09,

10.

the hatches according to § 11.10,

11.

Repair work according to § 11.11 or

12.

Measures in the case of ice according to § 11.12

(2) Act contrary to the provisions of Section 50 (1) (2) of the Bundeswasserstraßengesetz (Bundeswasserstraßengesetz) of the Bundeswasserstraßengesetz (Bundeswasserstraßengesetz), who intentionally or negligently arranges or admises as the owner or supplier, that a provision of Appendix A to this Regulation is

1.

the appointment of a supervisor according to § 11.05,

2.

the operation of fire extinguishers according to § 11.09 or

3.

Repair work according to § 11.11

Section 9 Entry into force

This Regulation shall enter into force on 1 July 1993.
