§ 1 Fees and Deposits
The Federal Environment Agency (Umweltbundesamt) charges for the examination and evaluation of applications for the grant of an exemption pursuant to Article 5 (3), including in conjunction with paragraph 5 of Regulation (EC) No 648/2004 of the European Parliament and of the Council of 31 March 2004. 2004 on detergents (OJ 2004 L 327, p. EU No 1) Fee charges according to the list of fees in the installation and expenses pursuant to § 23 (6) of the Federal Law on Fees. The fees may not exceed the cost of processing the application.

§ 2 Invalidity and withdrawal of applications
In the cases of invalidity of an application pursuant to Article 5 (3), second sentence, sentence 3 of Regulation (EC) No 648/2004, or the withdrawal of an application for an exemption, the fees shall be subject to the conditions laid down in Article 23 (5), first sentence, and 2 of the Federal Fees Act.

§ 3 Entry into force
This Regulation shall enter into force on the day following the date of delivery.
