§ 1 Prohibition on chemicals in list 1

It is prohibited
1.
Chemicals of list 1 listed in Annex 1 to this Regulation
a)
to be imported from a non-contracting state,
b)
to a non-contracting state,
c)
to a third State Party if they have already been imported from another Contracting State,
d)
carry out them when the country of origin, origin, destination or other transit country is a non-contracting state, or
e)
to carry out such acts as a German abroad in accordance with points (a) to (d),
2.
to establish, domestily or as a German abroad, facilities intended for the production of list 1 chemicals and the production capacity of which is at least one tonne per year for these chemicals,
3.
as a German in a non-contracting state, to produce, process, trade with them, sell them, sell them, to consume, to acquire, to give to another, or otherwise to exercise the actual force of violence.

§ 1a Bans on chemicals in list 2

It is prohibited to apply chemicals to list 2 listed in Annex 1 to this Regulation
1.
to be imported from a non-contracting state,
2.
in a non-contracting state, or
3.
acts as a German act according to the number 1 or 2 abroad.

§ 2 Approval reservation

(1) An authorisation shall be required to:
1.
equipment intended for the production of chemicals in list 1,
a)
set up,
b)
, or
c)
change significantly,
2.
List 1 chemicals
a)
produced,
b)
shall be processed, traded with them, sold, consumed, acquired, transferred to another or otherwise exerts actual force on them; or
c)
they are in, out of, or carried out,
3.
the chemicals listed in Annex 1 to this Regulation shall be carried out in a non-contracting State;
in so far as the act is not already prohibited in accordance with § 1. (2) A permit referred to in paragraph 1 (1) and for the production, processing and consumption referred to in paragraph 1 (2) (a) and (b) shall not be required if the production, processing or processing of the product is not necessary. Whereas consumption in a facility is only for medical, pharmaceutical or research purposes and the total quantity is less than 100 grams per unit per year; in this case, the respective activities of the approval authority shall be up to 1. February of a calendar year for the previous calendar year. § 3 Granting of authorisation

(1) Without prejudice to other provisions of law, the authorisation pursuant to Article 2 (1) shall be granted if it is ensured that the undertakings of the Federal Republic of Germany from the Convention shall be fulfilled by taking the action subject to authorisation. (2) The granting of the authorisation may be subject to factual and personal conditions, in particular the reliability of the applicant. § 4 Reporting requirements for production, processing and consumption

(1) Who operates a work,
1.
which produces more than 200 tonnes of certain organic chemicals within the meaning of Part I (4) of Annex 2 to the Convention a year,
2.
in which at least one holding produces more than 30 tonnes of a PSF chemical within the meaning of Part IX (1) (b) of Annex 2 to the Convention in the year,
3.
in which at least one holding produces more than 30 tonnes of a chemical in the list 3 per year, or is expected to produce in the following calendar year,
4.
in which at least one holding produces, processes or consumes more than one kilogram of a chemical in list 2 No 3, 100 kilograms of a chemical in list 2 No.1 or 2, or one tonne of a chemical in list 2 Nos. 4 to 14 per year, or is likely to produce, process or consume in the following calendar year, or
5.
which produces more than 100 grams of chemicals in the list 1 per year or which is expected to produce in the following calendar year,
shall be obliged to report in accordance with § § 5, 7 and 8. (2) excluding the reporting obligation referred to in paragraph 1 (1) and (2), who operates a plant which, during the reference period, shall exclusively carry out the explosives listed in Annex 2 to this Regulation; or chemicals that only consist of carbon and hydrogen. § 5 Reporting types and information

(1) The notifications pursuant to § 4 shall be Neumeldungen for the current calendar year, annual reports for the past calendar year, annual reports for the following calendar year or change reports in the event of deviations from the new or new calendar year. in the case of Article 4 (1) (3), whether the plant has produced, or is likely to produce, more than 200 tonnes of a list 3 chemical referred to in paragraph 4 (3) of List 3,
5.
in the case of Article 4 (1) (4), whether at least one holding produces more than ten kilograms of a chemical in list 2 No 3, one tonne of a chemical in list 2, No. 1, or 2 or 10 tonnes of a chemical in list 2 Nos. 4 to 14, has been processed or consumed, or is likely to produce, process or consume,
6.
in the cases of § 4 (1) (3) and (4), the number of all establishments which trigger a reporting obligation, in the case of § 4 (1) (1), the approximate number of establishments, in the case of § 4 (1) No. 2, the exact number of establishments which each of the chemicals designated there have produced,
7.
in the cases referred to in § 4 (1) (1) and (2), the principal activities of the work,
8.
in the case of Section 4 (1) (5), the whole area which is significant for the production of a chemical in List 1;
a)
for the annual report, the anticipated changes to the technical description last submitted and the likely changes to the destination;
b)
for the annual report, the changes made to the final technical description and amendments to the final destination.
(3) The notification shall contain the following information on each of the establishments referred to in Article 4 (1) (3) and (4):
1.
Name and location within the work, including the building or building,
2.
the name of the operator,
3.
the principal activities of the holding,
4.
in the case of § 4 (1) no. 4, in addition
a)
details of the type of operation within the meaning of Part VII (7) (d) of Annex 2 to the Convention,
b)
the production capacity for each list 2 chemical, which exceeds or is likely to exceed the threshold value referred to in section 4 (1) (4).
(4) The notification shall contain the following information concerning the chemicals referred to in Article 4 (1):
1.
in the case of Article 4 (1) (1), the total quantity of organic chemicals produced by the plant in the orders of magnitude 200 to less than 1,000 tonnes, 1,000 to 10,000 tonnes and more than 10,000 tonnes,
2.
in the case of Article 4 (1) (2), the total quantity of PSF chemicals produced by each holding in the orders of magnitude 30 to less than 200 tonnes, 200 to less than 1,000 tonnes, 1,000 to 10,000 tonnes and more than 10,000 tonnes,
3.
in the case of Article 4 (1) (3), separately for each chemical in List 3, where the threshold referred to in that list is exceeded;
a)
the chemical name, the ordinary or commercial name used in the facility, the structural formula and, if associated, the CAS number,
b)
the uses to which the chemical has been or is to be produced,
c)
the quantity produced or expected to be produced by the plant in orders of magnitude 30 to less than 200 tonnes, 200 to less than 1,000 tonnes, 1,000 to less than 10,000 tonnes, 10,000 to 100,000 tonnes, and more than 100,000 tonnes,
4.
in the case of Article 4 (1) (4), separately for each chemical in List 2, where the threshold referred to in that list is exceeded,
a)
the chemical name, the ordinary or commercial name used in the facility, the structural formula and, if associated, the CAS number,
b)
the precise purposes within the meaning of Part VII (8) (e) of Annex 2 to the Convention to which the chemical has been produced, processed and consumed, with a precise indication of the product groups,
c)
for the annual report, the quantity produced, processed, consumed, used and exported by the plant,
d)
for the new, annual and amending report, the quantity likely to be produced, processed and consumed by the plant, as well as the periods likely to be required for production, processing and consumption,
5.
in the case of § 4 (1) no. 5, separately for each chemical in list 1
a)
the chemical name, structural formula and-if assigned-CAS number,
b)
for the annual report
aa)
the quantity produced and consumed and the purpose of consumption,
bb)
in any event, the transfer of the actual domestic violence, the purpose and the name and address of the recipient;
cc)
the highest in the course of a year, as well as the quantity stored on the last day of the year,
dd)
in the case of production for protection purposes, the procedure followed,
ee)
the quantity, chemical name and, if assigned, the CAS number of each of the preproducts of lists 1 to 3 used for the production;
c)
for the new, annual and change reports the quantity expected to be produced by the plant, the time periods that are expected to be produced and the purpose of production.

§ 6 Reporting requirements for import and export

(1) Who
1.
more than one tonne of a list of 3, 100 kilograms of a chemical in list 2 No. 4 to 14, 10 kilograms of a chemical in list 2 No. 1 or 2 or 100 grams of a chemical in list 2 No. 3 per year, or
2.
List 1 chemicals
(2) The notification must be made for each chemical separately. (2) The notification must be submitted separately for each chemical.
1.
the chemical name, the ordinary or commercial name, the structural formula and, if associated, the CAS number,
2.
the name of the single or exporter;
3.
information on the quantity exported or exported in each country of origin or destination in the previous calendar year, indicating the countries involved;
4.
for each case of import or export of chemicals in list 1, the date, quantity, purpose and name and address of the supplier or consignee

Section 7 Additional reporting requirements

(1) The annual financial statements and the notifications pursuant to § 6 shall be reimbursed up to 1 February of a new calendar year. (2) The annual reports are in the case of § 4 (1) No. 5 up to 1 September, in the cases of § 4 (1) no. 3 and 4 bis (3) The following units of measurement shall be used in the case of reports pursuant to § § 5 and 6 of the following year's reports:
1.
for chemicals in the list 1 gram,
2.
for chemicals in lists 2 and 3 tonnes.
In this case, the third position is to be rounded. Sentences 1 and 2 shall not apply to the notifications to be issued in orders of magnitude in accordance with Section 5 (4) (3). Unofficial table of contents

§ 8 Forming provisions

(1) The applications for approval pursuant to § 2 and the notifications pursuant to § § 4 and 6 shall be submitted by written declaration to the Federal Office for Economic Affairs and Export Control (BAFA). (2) The Federal Office for Economic Affairs and Export control (BAFA) may prescribe the use of certain forms by means of a notice in the Federal Gazette. It may allow applications and notifications to be submitted in a different way, in particular through electronic data exchange. Unofficial table of contents

§ 9 Exceptions for low concentrations

(1) § § 1, 2, 4 and 6 shall not apply if list 1 chemicals form a proportion of less than 1% of a mixture. (2) § 1a does not apply if chemicals are used in the chemical industry.
1.
the list 2 No 1 to 3 shall be 1 of the hundred or less, or
2.
the list 2 Nos. 4 to 14 shall be 10 per hundred or less
of a mixture. (3) § § 2, 4 and 6 shall not apply if chemicals
1.
the number 1 to 3 of list 2 shall be 1 of the hundred or less, or
2.
List 2 (4) to (14) or 3 (3) a proportion of 30 of the hundred or less
a mixture. (4) § § 1a, 2 and 6 shall not apply where lists 2 or 3 of chemicals are contained in goods intended for consumer goods, which are:
1.
are packaged for sale in the retail sector and intended for personal use, or
2.
are packaged for single use.

Section 10 Special reporting requirements

(1) The reporting obligation shall also be subject to the person who operates a work,
1.
in which at least one holding is a chemical in list 3,
2.
in which at least one operation is a chemical in list 2 or
3.
which is a chemical in list 1
produced after 1 January 1946 for use for purposes other than those permitted under Section 1 (2) of the Implementing Act to the Chemical Weapons Convention. For the calendar years from 1946 onwards, notifications shall be submitted within six months of the date specified in § 15 sentence 2. (2) The notification shall contain the following information:
1.
about the work
a)
Information pursuant to section 5 (2) (1) and (2),
b)
in the case referred to in paragraph 1, first sentence, point 3, for the whole area which has been significant for the production of a chemical in List 1 for the purpose specified therein, comprehensive and accurate information within the meaning of Part V (1) of Annex 2 to the Convention the location, construction equipment, technical equipment and procedures, production capacity, activities, as well as structural and plant-based measures,
2.
on the holding
a)
in the cases referred to in the first sentence of paragraph 1 (1) and (2), the information referred to in Article 5 (3) no.1 to 3
b)
in the case of the first sentence of paragraph 1, point 2, additional information pursuant to Article 5 (3) (4),
3.
, separately for each chemical referred to in the first sentence of paragraph 1
a)
in the cases referred to in the first sentence of paragraph 1 (1) and (2), information on the chemical name, the ordinary or commercial name used in the facility, the structural formula and, if associated, the CAS number, the beginning and the end of the relevant the production period for the purpose referred to in the first sentence of paragraph 1, the quantity of production per production period, the place to which the chemical has been delivered and, if known, the final product produced there,
b)
in the case referred to in the first sentence of paragraph 1, point 3, comprehensive and accurate information, as well as information on production periods and quantities within the meaning of Part V (1) of Annex 2 to the Convention.
In other respects, Section 7 (3) and § 8 shall apply accordingly. Unofficial table of contents

§ 11 Bundeswehr and other institutions

The Bundeswehr, the police officers of the Federal Government and the customs authorities, as well as the other authorities and departments responsible for the maintenance of public safety, do not require any authorisation pursuant to § 2. The reporting requirements of this Regulation shall not apply to the Bundeswehr. Unofficial table of contents

§ 12 Administrative Offences

Contrary to the provisions of Section 15 (1) (1) of the Implementing Act to the Chemical Weapons Convention, those who intentionally or negligently act
1.
Contrary to § 2 para. 2 sentence 1, an activity is not displayed, not correct, not complete or not correct in time,
2.
Contrary to § 4 (1) and § 6 (1), a notification is not, not correct, not complete or not timely, or
3.
, contrary to § 2 para. 3, chemicals are not or are not properly reported or not reported correctly.

§ 13 Crime

(1) In accordance with Section 16 (1) No. 2 of the Implementing Act to the Chemical Weapons Convention, it shall be punished who
1.
, contrary to a ban pursuant to § 1 No. 1 of the Chemical List 1, chemicals listed in List 1 shall be carried out, be carried out or carried out abroad or as a German act abroad,
2.
, contrary to a prohibition in accordance with § 1 No. 2 in Germany or as a German abroad, a facility is established,
2a.
According to § 1a no. 1 or 2, a chemical introduces or carries out a chemical or acts as a German act abroad.
3.
without the authorization required in accordance with Article 2 (1) (1) (a) of this Regulation, a body or
4.
Contrary to a prohibition in accordance with § 1 no. 3 as a German in a non-contracting state, chemicals in list 1 are produced, processed, traded with them, sold, consumed, acquired, left to another, or otherwise the actual violence against them is .
(2) In accordance with Section 16 (1) No. 3 of the Implementing Act to the Chemical Weapons Convention, it shall be punished who
1.
without the authorization required in accordance with Article 2 (1) (1) (b) of this Regulation, or
2.
without the authorisation of list 1 chemicals required in accordance with Article 2 (1) (2) (a).
(3) In accordance with Section 16 (2) of the Implementing Act to the Chemical Weapons Convention, it shall be punished who
1.
without the authorization required in accordance with Article 2 (1) (1) (c), substantially changes a facility,
2.
, without the authorization required pursuant to Article 2 (1) (2) (b) and (c), processes, trade with them, sells, consumes, acquires, leaves on another, otherwise exercises the actual use of force on them, or otherwise in-, out-of-or-out or
3.
without the authorization required under section 2 (1) (3) of the list, to carry out List 3 chemicals to a non-contracting state.

Section 15 Entry into force

§ § 1, 2 para. 1 no. 2 and 3, § 12 No. 3 and § 13 shall enter into force on the day on which the Convention enters into force in accordance with its Article XXI and which, according to § 21 paragraph 2 of the Implementing Act to the Chemical Weapons Convention, in the Federal Law Gazans is announced.
