§ 1 Transfer of tasks to Deutsche Bahn Aktiengesellschaft

Deutsche Bahn Aktiengesellschaft shall be empowered to have the following tasks performed by its staff:

1.

Removal of goods under simplified Community or common transit operations which Deutsche Bahn Aktiengesellschaft holds or holds in possession of (Part II, Title II, Chapter 7, Section 3 of Regulation (EEC) Commission Regulation (EEC) No 2454/93 of 2 July 1993 laying down provisions for the implementation of Council Regulation (EEC) No 2913/92 establishing the Community Customs Code: OJ L 327, 31.12.1993; Bull. EC No 1-or Annex II, Title IV, Chapter I of the Convention on a Common Transit Procedure, adopted by the Council of the EEC of 15 July 1987: OJ L 327, 31.12.1987, p. EC No L 226 p. 1-as amended);

for the competent railway customs office at the frontier or at a German railway station in the third country, to accept the re-registration of goods under the simplified Community or common transit procedure (Part II, Title II Chapter 7, Section 3, of Commission Regulation (EEC) No 2454/93 of 2 July 1993 laying down detailed rules for the application of Regulation (EEC) No 2913/92 establishing the Community Customs Code: OJ L 327, 31.12.1993; Bull. EC No 1-or Annex II, Title IV, Chapter I of the Convention on a Common Transit Procedure, adopted by the Council of the EEC of 15 July 1987: OJ L 327, 31.12.1987, p. EC No 1-as amended in each case) and the movement into the free zone or export, in so far as the prohibitions and restrictions on trade in goods across the border are not contrary to the rules;

accept, for the competent railway customs office, the re-establishment of goods under normal Community or common transit procedures (Part II, Title II, Chapter 7, Section 3 of Commission Regulation (EEC) No 2454/93) of 2 July 1993 laying down provisions for the implementation of Council Regulation (EEC) No 2913/92 establishing the Community Customs Code: OJ L 376, 31.12.1992, p. EC No 1-or Annex II, Title IV, Chapter I of the Convention on a Common Transit Procedure, adopted by the Council of the EEC of 15 July 1987: OJ L 327, 31.12.1987, p. EC No 1-as amended) and to monitor exports, in so far as the prohibitions and restrictions on trade in goods across the border are not contrary to the rules. The competent staff of the main railway station shall record the re-registration and export by affixing the day stamp in the copy of the convoy provided for the office of destination and shall pass all the copies of the Consignment note of the competent customs office. Where the effect of an anemic is impaired, or if there are doubts as to whether the goods are, for example, prohibitions or restrictions, he shall immediately activate the competent customs office;
