Species 1

(1) The State of Baden-Württemberg may repeal, amend or replace federal legislation in the field of land law which previously only applies in one part of the country, or replace it with the relevant content, insofar as this is the case. Legal unit within the country is wholly or partially manufactured or obtained. To the extent that Article 8 (3) of the Regulation amending the procedure in land register matters of 5 August 1935 (Reichsgesetzbl. 1065), it has been determined that the provisions of the Land Law remain in force, the Land of Baden-Württemberg may repeal, amend or replace these provisions with provisions corresponding to those provisions. (2) The State of Baden-Württemberg may also apply for the special official safekeeping of wills and inheritance contracts, instead of the local courts, determine the notariats as competent bodies. If it makes use of this authorization, the notaries are also responsible for the opening of dispositions of death pursuant to § 344 (6) and § 350 of the Law on the Procedure in Family Matters and in the affairs of the voluntary Jurisdiction. (3) The Land of Baden-Württemberg may extend to other areas of the Higher Regional Court in the territory of the Notarrechts, which apply at the seat of a Higher Regional Court. With the entry into force of such a provision, in the territory to which the legal extension relates, the federal legal provisions of the notary's right shall apply insofar as they are in force at the seat of the Oberlandesgericht.
