§ 1 Assignment of Staff

Officials, officials, employees and employees of the Federal Administration of Value Paper are from 1. August 2006 such at the Federal Office for Central Services and Open Property Issues. § 2 assignment of activities

§ 3 Decision-making and executive powers

The management and the designated employees of the Federal Republic of Germany-Finanzagentur GmbH shall exercise their prerox powers in this respect. The powers of service under § 3 (2) of the Federal Civil Service Act are the responsibility of the President or the President of the Federal Office for Central Services and Open Assets. Further details of the exercise of the powers of decision and authority shall be laid down in the contract between the Federal Office for Central Services and Open Property Issues and the Federal Republic of Germany-Finanzagentur GmbH. § 4 Applicability of the Federal Personalization Act

The employees referred to in § 2 para. 1 shall apply in the sense of the Federal personnel representation act as employees of the Federal Office for Central Services and Open Property Issues. Section 13 (2) sentence 4 of the Federal Personalization Act (Bundespersonalrepresentations) does not apply. Non-official table of contents

§ 5 Application of labour law provisions

(1) The employees referred to in § 2 paragraph 1 shall apply to the application of the Regulations concerning the representation of employees on the Supervisory Board, the application of the Works Constitution Act and the Speaker's Committee Act as employees of the Federal Republic of Germany- Finanzagentur GmbH and are active as such and are entitled to vote in a passively.(2) In the sense of Section 5 (3) of the German Works Constitution Act, the functionally comparable civil servants are also considered to be senior employees.(3) Insofar as the Federal Republic of Germany-Finanzagentur GmbH has obligations which it has in accordance with the rules on the representation of employees on the Supervisory Board, under the Works Constitution Act and the Speaker's Committee on the Spokesperson's Committee as well as the regulations concerning the representation of the severely disabled persons, therefore cannot be fulfilled, because it is not a dienstherrin and employer of the employees referred to in § 2 para. 1, these obligations shall meet the Federal Office for Central services and open asset issues. § 6 Personnel representation and business constitutional responsibilities

(1) The Staff Council of the Federal Office for Central services and open property issues are responsible for the personnel matters of the employees referred to in § 2 para. 1 according to the Federal Personnel Representation Act, on which the Federal Office for Central Services and Open Property Issues is responsible for decision.(2) In matters in which the Federal Republic of Germany-Finanzagentur GmbH decides, the rights of participation shall be exercised by the Works Council of the Federal Republic of Germany-Finanzagentur GmbH under the Act of the Works Constitution Act. § 7 severely disabled persons

(1) For the severely disabled persons who, according to § 2, paragraph 1, of the Federal Republic of Germany Germany-Finanzagentur GmbH, the Federal Office for Central Services and Open Assets Questions is an employer within the meaning of Part 2 of the Ninth Book Social Code.(2) Disabled persons shall apply to the Federal Government for the application of the provisions concerning the representation of the severely disabled in the Federal Republic of Germany-Finanzagentur GmbH as employees, irrespective of their employment relationship or employment relationship. § 6 shall apply accordingly. § 8 Transitional regulation

(1) The works council formed at the Federal Republic of Germany-Finanzagentur GmbH will become effective as of 1 January 2011. August 2006 for those members of the 31. § 9 Continuation of service agreements
