§ 1 Scope, definitions

(1) This regulation shall apply to animals of the species referred to in Annexes 1 and 4. For the purposes of the definition of animal species within the meaning of this Regulation, its scientific name shall be decisive. The species includes subspecies, even in so far as these do not occur in nature within the scope of the Federal Forest Act.(2) The term "animals" within the meaning of this Regulation shall include live and dead animals, their readily recognisable parts, products derived from them, and their eggs, other forms of development and nests. unofficial table of contents

§ 2 bans

(1) prohibited, animals of the species listed in Appendix 1
1.
to take possession, acquire, exercise, or process the actual violence over them or otherwise use,
2.
to deliver, offer, sell or otherwise place on the market, and
3.
to promote one of the activities mentioned in point 2.
The right of acquisition of the hunting rights of the owner as well as the regulations of the countries pursuant to § 36 para. 2 no. 2 of the Federal hunting law on the reception, care and rearing of injured or sick savages and their whereabes remain unaffected.(2) The prohibitions provided for in paragraph 1 shall not apply to animals which, after the entry into force of this Regulation, have been acquired in the course of the exercise of the right of hunting. However, these animals may not be delivered to third parties for remuneration or transported, held or offered for this purpose. Except for these limitations,
1.
Animals of the species listed in Appendix 2,
2.
Animals of the species listed in Appendix 3, unless the activities listed in sentence 2 are carried out for commercial purposes and
3.
in nature found dead animals as far as they are used for purposes of research or teaching.
(3) The prohibitions provided for in paragraph 1 are also not applicable to animals that are
1.
before the entry into force of this regulation, in accordance with the rules on the protection of the Type in the scope of the Bundeswaldgesetz (Bundeswaldgesetz),
2.
in accordance with the rules for the protection of the species in question within the scope of the Federal law on the law of the Federal Republic of Germany. The restrictions laid down in the second sentence of paragraph 2 shall apply to animals of the species listed in Appendix 1 which have been entered in the scope of the Bundeswaldgesetz (Bundeswaldgesetz) on the basis of an import permitted solely for personal use or as a household board.
() The prohibitions laid down in paragraph 1 shall also not apply to animals of the species Rebhuhn, Fasan, Wachtel and Stockente, which have been bred in captivity within the scope of the Federal Forest Act and have not become herreness.(5) The competent authority of the country may, on a case-by-case basis, grant exemptions from the prohibitions provided for in paragraph 1, in so far as this is necessary for the recovery of animals seized or taken into account. It may also, on a case-by-case basis, grant exemptions from the prohibitions provided for in paragraph 1 and from the prohibitions provided for in the second sentence of paragraph 2 and in the second sentence of paragraph 3, where this is
1.
for purposes of research or teaching,
2.
for the establishment of animals in the wild or in the related rearing or
3.
for another reasonable reason for the use of animals in small quantities
is required and concerns of the species- and biotope protection, as well as acts of the Council or of the Commission of the European Communities or obligations arising out of international conventions on species protection. Unofficial Table Of Contents

§ 3 Holding gripping and hawks

(1) The holding of gripping or hawks of the species listed in Appendix 4 is only after The conditions laid down in paragraphs 2 to 6 shall be allowed.(2) If you hold a grab or a hawk,
1.
must hold a valid name that is valid on its name. Falknerjagdscheins sein,
2.
may not hold more than two specimens of the species Habicht, Steinadler and Wanderfalke,
3.
immediately and unmistakably has the grip and hawks to be marked and unmistakable in accordance with paragraph 3, and
4.
has the country-law authority
a)
latest up to 1. June 1986, at a later start of the posture within four weeks after the establishment of the property, the stock of gripping and hawks and
b)
according to the inventory display in each case indicate the access and departure of gripping and falcon
in writing; the display must contain information on the number, type, age, gender, origin, whereabout, location, purpose and characteristics of the grabbers and falcons. The relocation of the regular location of the Greife and Falken is also to be reported immediately. The mark which has become vacant by the death of an animal shall be returned with the indication of the departure.
(3) The identification of the gripping and folding of the Appendix 4 held pursuant to paragraph 1 shall be determined in accordance with the provisions of § § 12 to 15 of the Federal species protection regulation to be implemented.(4) The competent authority of the country may, on a case-by-case basis, grant exemptions from the conditions set out in paragraph 2 (1) and (2), if
1.
the posture of scientific, teaching or research purposes, or the exception for rearing for one of the above purposes, for rearing in the pursuit of the pickling or for the purpose of Resettlement is required for the settlement in the free nature,
2.
the holder the required reliability and sufficient knowledge of the holding and the Maintenance of gripping and hawks has and
3.
a professional care as well as an attitude corresponding to the animal protection regulations is guaranteed
(5) Paragraph 2 (1) and (2) shall not apply to the seizets and hawks which, at the time of the entry into force of this Regulation, are held in accordance with the rules to be applied in respect of their protection. The application of paragraph 2 (1) and (2) to the extension of such stocks and to the replacement of such stocks shall remain unaffected.(6) Paragraphs 2 to 5 shall not apply to zoological institutions of legal persons governed by public law, as well as to collection and maintenance stations approved or recognised by the authorities. § 4 Recording and labelling requirements

(1) Anyone who is a commercial
1.
tote animals of the species or parts of these animals listed in Appendix 5 or
2.
live or dead animals of the species referred to in Appendix 5 or parts of these animals to be marketed or acquired,
has a recording and extradition book on these animals for daily registration in accordance with the model of Appendix 6. In the case of animals referred to in point 2 in the retail trade, the name and address of the consignee as well as the day of departure shall only be given in the case of animals whose selling price is more than 250 Deutsche Mark.(2) All entries in the book shall be made in permanent form; § 43 (2) to (4) sentence 1 and 2 of the Commercial Code shall apply mutatily.(3) The books containing the documents shall be handed over to the competent authority in accordance with the law of the country on request for examination.(4) The books with the evidence shall be kept for five years. The retention period shall begin with the end of the calendar year in which the last registration for a completed financial year has been made.(5) The animals and parts of animals referred to in paragraph 1 shall be marked as far as is possible with reasonable effort. § 5 Legal property, proof of proof

Any animals of the species listed in Appendix 5 or the actual violence , the competent authority may rely on an authorization to do so only if it proves, on request, that the conditions for an exception pursuant to section 2 (2) to (5) are fulfilled or that he or she is credited with the condition that he or she is a third party. the animals were in possession of the entry into force of this Regulation. This only applies to items for personal use or household goods if the facts justify the assumption that an entitlement under § 2 (2) to (5) does not exist. Non-official table of contents

§ 6 Administrative Offences

is an administrative offence within the meaning of § 39 paragraph 2 no. 5 of the Federal Hunting Act, who intentionally or negligent
1.
contrary to § 2 (1) sentence 1 of this Regulation, acquires, acquires, the (2)

contrary to § 2 (2) sentence 2 or (3) (2), actual use of force on the market, processing or otherwise using, or otherwise using, placing on the market

§ 7 Berlin-clause

This regulation applies in accordance with § 14 of the third transfer law in connection with § 45 of the Federal Hunting Act also in the Land of Berlin. unofficial table of contents

§ 8 Entry into force

§ 3 (2) (3) and (4) and (3), § 4, and § 6, in so far as it relates to the above-mentioned provisions, 1. This Regulation shall enter into force on the day following the date of delivery of the Regulation. At the same time, you are out of power:
