Section 1
General provisions

§ 1 Scope

This Regulation shall apply to the final examinations which may be filed at Bundeswehr schools. The following degrees can be obtained at Bundeswehr specialist schools:
1.
as a secondary level of secondary education
a)
the secondary school degree,
b)
professional school-leaving certificate in the field of social pedagogy,
c)
the technical school entrance qualification in the technical field,
d)
the professional school-leaving certificate in the field of business,
e)
professional school maturity in other fields of speciation, for which the nationwide recognition of the degree is guaranteed,
2.
as completion of upper secondary education
a)
the university of applied sciences in the field of social pedagogy,
b)
the technical college entrance qualification in the technical field,
c)
the university of applied sciences in the field of economics,
d)
the "Fachhochschulreife" ("Fachhochschulreife") in other disciplines, for which the nationwide recognition of the qualification is guaranteed.

§ 2 Conditions of access

(1) The admission requirements for the participation in the final examination will be ensured by the Bundeswehrfachschule. (2) The admission requirements are:
1.
for the courses in order to obtain the secondary school leaving certificate of the secondary school leaving certificate or an educational qualification recognised as equivalent,
2.
for the courses in order to obtain the professional school entrance qualification
a)
the main secondary school or an educational qualification recognised as equivalent; and
b)
the certificate of a corresponding completed vocational training or an equivalent recognised qualification of a vocational school or the proof of sufficient professional experience of at least three years ' relevant professional experience,
3.
for the courses to obtain the qualification for universities of applied sciences
a)
the secondary school leaving certificate or an educational qualification recognised as equivalent; and
b)
proof of a relevant completed vocational training or a sufficient professional experience.
(3) Participation in a final examination shall not be permitted if the desired degree has already been obtained. Unofficial table of contents

§ 3 Components, date and organisation of the examination

(1) The examination consists of a written and an oral part (§ § 11 and 14). (2) The examination takes place at the end of the last half-year of a course leading to a conclusion according to § 1 (examination half-year) at the Bundeswehrfachschule (Bundeswehrfachschule). (3) The head of the school is responsible for the organisation of the examination. Unofficial table of contents

§ 4 Examination Committee

(1) An examination committee shall be formed for the examination of the examination. (2) The examination committee shall include:
1.
a commissioner or a representative of the highest supervisory authority in the country where the school is located, as chairman or chairman,
2.
a representative or a representative of the Federal Armed Forces ' School Supervisory Authority,
3.
the head of the school or the principal or the permanent representative of the principal or principal,
4.
the specialist teachers who have taught in the respective examination class, as specialist examiners and specialist examiners, and

§ 5 Subcommittees

§ 6 Registration for examination

§ 11 Written final examination

(1) For a written final examination to obtain the real school degree:
1.
an 180-minute exam in German,
2.
an 180-minute exam in English,
3.
an 180-minute exam in mathematics,
4.
an 180-minute exam in the field of Community studies.
(2) The written final examination for the obtaining of the professional school maturity includes:
1.
an 180-minute exam in German,
2.
an 180-minute exam in English,
3.
an 180-minute exam in mathematics and
4.
a 120-minute exam, and
a)
in the field of social pedagogy in the subject of pedagogics,
b)
in the technical field of physics in physics,
c)
in the field of economics in the field of business administration with accounting.
(3) The written final examination for the qualification of a university of applied sciences includes:
1.
a two-40-minute exam in German,
2.
an 180-minute exam in English,
3.
an 180-minute exam in mathematics and
4.
an 180-minute exam, and
a)
in the field of social pedagogy in the subject of pedagogy and psychology,
b)
in the technical field of physics in physics,
c)
in the field of Economics in Business Administration and Economics.
(4) The subjects of the written final examination and the duration of the examination shall be determined by the school supervisory authorities of the Länder for financial statements in the further subject areas referred to in the second sentence of section 1 (1) (e) and (2) (d). § 12 Proposal for the tasks of the written final examination

(1) For each examination subject, the specialist teachers who have regularly taught in the subjects of the written final examination shall draw up a uniform proposal for the examination tasks per Bundeswehr school. The proposal must be in accordance with the curriculum for Bundeswehr schools in the version in force. The proposal is a list of approved tools, a specific description of the expected performance (expectation horizon) and an evaluation scheme. (2) The headmaster or principal shall ensure that the proposal is complete and corresponds to the syllabus for Bundeswehr schools in the version in force. § 13 Implementation of the written final examination

§ 14 Oral final examination

(1) An oral final examination may be carried out in each subject, which has been taught in the examination half-year. It is an independent examination performance. (2) In the subjects in which the grade of the written final examination corresponds to the preliminary note, no oral final examination is performed. If the grade of the written final examination deviates from the previous note, the examination board sets a preliminary final grade and carries out an oral examination at the request of the examinee. Section 15 Preparation of the oral examination

Section 17 Implementation of the oral examination

(1) The oral examination shall take place as an individual examination before the examination committee or a subcommittee. The examination as well as the subsequent advice of the Examination Committee or the Subcommittee are not public. (2) The oral examination usually lasts between 15 and 20 minutes. An appropriate preparation time shall be available for the test item. It is usually 20 minutes. (3) The grades of the oral final examination shall be determined by the examination committee or the subcommittee on a proposal by the professional teaching staff with a majority of votes. In the event of a tie, § 4 (4) applies. (4) The decisions of the Subcommittee shall be binding on the Audit Committee. Unofficial table of contents

§ 18 Audials and listeners of the oral examination

(1) With the approval of the examinee and the representative of the highest school supervisory authority in the country, the auditor may be invited to attend the oral examination:
1.
a member of the Landesschulvertretung (Landesschulvertretung) by the representative of the supreme school supervisory authority in the country,
2.
Teaching staff from other Bundeswehr schools and a representative of the top supervisory authority of the Federal Armed Forces Administration by the head of the school or the principal.
(2) § 4 (3) shall apply accordingly.

Section 19 Setting the final notes

(1) After the end of the oral examination, the examination board shall determine the final grades. Intermediate notes are not allowed. (2) In the subjects in which neither an oral nor a written final examination is carried out, the preliminary notes are to be set as end notes. In the other subjects, the final grade is the arithmetic mean, commercially available to a whole number, and in particular:
1.
in the subjects with written final examination
a)
the preliminary note and
b)
the grade reached in the written final examination, and
c)
the grade achieved in an oral final examination,
2.
in the subjects without written, but with oral final examination
a)
the preliminary note and
b)
the grade reached in the oral final examination.

Section 20 Total results and existence of the examination

(1) The overall result of the examination shall be 'passed' or 'not pass'. (2) The overall grade shall be the arithmetic mean of the grades of subjects taught in the examination half-year. The arithmetic mean shall be rounded in commercial terms to a whole number. (3) The examination has been passed if at least the final grade "sufficient" has been achieved in each subject which has been informed in the examination half-year. The test is also passed if the final grade "defective" in one subject is at least the final grade "satisfactory" in another subject. In this case, the final grade in a subject with written final examination can only be compensated by the final grade in another subject with written final examination. Insufficient performance in more than one subject or insufficient performance cannot be compensated. (4) The results achieved in the individual oral examinations as well as the overall result of the examination are immediately available to the examinees. to give advice to the Audit Committee by the Chairperson or the Chairman. Section 21 Final Certificate

(1) After passing the examination, the examinees shall receive a certificate containing the overall grade and the final notes of the subjects taught during the course. Section 22 Resignation or failure

§ 23 Täuschung, order violation

(1) Examiners who are deceiving in the examination, attempting to deceive, participate in it or otherwise violate the order shall be allowed to continue the examination subject to a different decision of the Audit Committee. Depending on the seriousness of the infringement, the examination board may order the repetition of the entire examination or of individual test parts, assess the examination performance with "insufficient" or explain the entire examination for non-existence. In the event of a significant infringement, the examinee may be excluded from further participation in the entire examination. If a test is excluded, the examination shall be deemed not to pass. (2) The school manager or the principal shall decide on the existence and immediate consequences of a breach of order during the written final examination. § 26 Audit Protocols

(1) The course of the written and the oral examination must be recorded. (2) The minutes of the written final examinations in the subjects according to § 11 are to be completed by the supervisory teachers and to sign. Each protocol must contain:
1.
the beginning and end of the written final examination in the respective subject,
2.
the seating arrangement as a plan with the names of the examinees;
3.
the names of the supervising teachers and the time of their presence,
4.
the names of the temporarily absent examinees and the time of their absence,
5.
the time of the submission of the exams,
6.
a note on the information provided to the examinees in accordance with § 24,
7.
special events, in particular disturbances of the examination or breaches of order.
(3) The minutes of the oral examination must be signed by the chairman of the examination board, the head of the school or the head of the school, or her or his representative, and the head of the protocol or the protocol guide. The protocol must contain:
1.
the name, the official name and the service of the members of the Audit Committee;
2.
all decisions of the Chairperson or Chairman and all decisions of the Audit Committee,
3.
Start and end of the oral examination,
4.
the names of the examinees;
5.
examination subjects,
6.
the marks achieved.
(4) The minutes of the oral examinations must be signed by the examining and logging teachers, the chairperson or the chairman, and shall be annexed to the minutes of the oral examination. They must be included in each case:
1.
the name of the test item, the examining teacher, the logging teacher and the chairman of the examination board or of the subcommittee,
2.
the examination subject,
3.
the beginning and end of the individual examination,
4.
the task,
5.
a verifiable performance assessment,
6.
the score reached.

Section 27 Legal remedies

Against the decision of the Audit Committee, the examinee is entitled to the right of objection or the appeal according to the Order of Military Appeal. The supervisory authority of the Bundeswehr administration shall decide on the objection or the appeal; the school supervisory authority of the country which has sent the chairperson or the chairman shall be involved. Section 28 Examination Act

(1) To be taken to the examination file:
1.
the exams of the written final examination,
2.
the audit protocols; and
3.
the examination list.
(2) Upon notification of the final certificate or of the decision on the final examination not passed, the examinee shall, upon request, be granted access to the components of the examination file relating to him. The examination shall be made in the file. (3) The examinations and the minutes shall be kept for at least five years and not more than ten years after the examination has been completed. The examination list shall be kept for 30 years and shall then be destroyed.

Section 29 Transitional regime

Section 30 Entry into force, expiry of the expiry date
