I.

In accordance with Article 17 (5) sentence 2 of the General Administrative Regulation on State aid in sickness, care, birth and death cases (State aid rules-BhV), the Federal Office of Finance will be responsible for processing the state aid affairs of the active Employees of the Federal Administrative Court as well as the assertion of claims for damages according to § 87a of the Federal Officials Act. In accordance with Section 126 (3) No. 2 sentence 2 of the Civil Service Law Framework Act in conjunction with Section 172 of the Federal Civil Service Act and with Section 46 of the German Judge Act, the Federal Office of Finance shall be empowered to rule over the opposition to a the administrative act on state aid matters to the extent that it was responsible for the adoption of the administrative act. III.

Pursuant to Section 174 (3) of the Federal Civil Service Act, in conjunction with Section 46 of the German Judiciary Act, the Federal Office of Finance shall be the representative of the Federal Ministry of Justice in administrative proceedings, provided the Federal Office of Finance has been authorized to take a decision on the appeal. IV.

This arrangement shall take effect on 1 May 2004, subject to the provisions of the second sentence. It shall not apply to contradictions or claims raised before 1 May 2004. Unofficial table of contents
