§ 1 Institution, competence

(1) In order to carry out the duties of a family fund within the meaning of Section 72 (1) sentence 2 of the Income Tax Act, a federal family fund shall be established at the Federal Office for Central Services and Open Property Issues. (2) The Bundesfamilienkasse shall be responsible for the exercise of the duties of the Federal Family Fund. the fixing and payment of child benefit to the members of the Federal Finance Administration designated in Section 72 (1) (1) (1) to (3) of the Income Tax Law. § 2 Task transfer

(1) For

federal corporations, institutions and foundations under public law, the Federal Family Fund has to perform the duties of a family insurance fund in accordance with § 1,

further federal authorities, the Bundesfamilienkasse (Bundesfamilienkasse) can carry out the duties of a family fund according to § 1,
(2) The tasks referred to in paragraph 1 shall be determined by written agreement between the Federal Office for Central Services and Open Property Issues and the administrative institution. of the transferring family fund. The administrative arrangement shall be subject to regulations for the purpose of carrying out costs. (3) The Federal Family Fund shall enter into the legal status of the respective family insurance fund with the transfer. The responsibilities for performance periods prior to 1996 remain unaffected by a transfer. (4) The Federal Office of Finance already concluded agreements with the Federal Office of Finance before 31 December 2005 on the transfer of tasks to the Bundesfamilienkasse at the Federal Office for Central Services and Open Property Issues. This Regulation shall enter into force on 1 January 2006.
