§ 1 Scope

The Bundesamt für Seeschifffahrt und Hydrographie (Bundesamt für Seeschifffahrt und Hydrographie) is responsible for carrying out individual public services in the areas of flag law, training and qualifications, ship surveying, and licensing including inspection of nautical systems, installations, equipment and instruments, the defence of external hazards at sea according to Chapter XI-2 of the Annex to the International Convention for the Safety of Life at Sea, 1974, of 1 November 1974 (BGBl. 141, 142), the market surveillance of marine equipment, the ship-related environmental law, the supervision of notified bodies for marine equipment, the approval of maritime installations in the German exclusive economic zone and the Uphill right in the continental shelf and the right of spatial planning in the German exclusive economic zone Charges and outlays under this Regulation. § 2 Fees and Deposits

(1) The chargeable event and fee rates shall be the result of the applicable fee list. (2) Expenses shall be subject to the conditions laid down in § 10 (1) (2) to (6) and (8) of the Administrative Cost Act in the period up to 14 August 2013. § 3 Fee measurement

(1) Where charges are levied in accordance with the size of the ship, the gross tonnage (GT) or designated gross registered tonnage (GRT) shown in the official ship's certificate shall be used. (2) For the calculation of the fees according to the time spent in accordance with the Appendix to § 2 (1) the following hourly rate shall be applied:

Officials of the higher service or comparable wage workers

68 Euro,
Officials of the upper-level service or comparable employees

55 Euro,
officials or comparable workers, unless they have been referred to, 43 Euro.


A quarter of this hourly rate is to be calculated for each quarter of an hour captured. (3) Requges an individually attributable public service outside the general service period, the following surcharges shall be charged:

1. for work on public holidays
0.00 am to midnight,
on the 24th and 31 December
from 12.00 noon




100 percent,
2. for Sunday work
from Saturday 12.00
to Sunday 24.00



50 percent,
3. for night work,
to the extent that no surcharges for Sunday and holiday work are collected,
from 17.00 to 7.00 am

(4) In the case of individually attributable public services, which are calculated according to time expenditure, the duration of the individually attributable public service also includes the travel time, which was caused by the fee debtor. § 4 Transitional Regulation

On procedures which are subject to the transitional arrangements in accordance with Article 17 (1) to (4) of the Maritime Ordinance of 23 January 1997 (BGBl. 57), as last amended by Article 1 of the Regulation of 15 January 2012 (BGBl I). 112), is the charge number 6051 of the annex to § 1 (2) of the German Federal Office for Maritime and Hydrographic Officers ' Costing of 20 December 2001 (BGBl). 4081), as defined by Article 2 of the Regulation of 19 September 2005 (BGBl). 2787), to continue to apply in the version in force on 25 July 2012. In accordance with Article 1 (2) (1) (1) (1) (1) and (2) of the Maritime Labour Regulation, which have been adopted before the entry into force of this Regulation, the fee number 6041 of the Appendix to Article 2 (1) of this Regulation shall apply to the planning of planning decisions or planning authorisations of marine installations. in respect of the second part-fee, provided that it has been created after the entry into force of this Regulation. § 5 Entry into force, external force

This Regulation shall enter into force on the day following the date of delivery. Preliminary remarks
1. Tests according to EN 60945 (Environment and EMC) are to be commissioned separately by the applicant in suitable laboratories. They are not included in the respective cost rate.
