This regulation is used to implement the following guidelines:
1.
Commission Directive 2003 /90/EC of 6. October 2003 laying down detailed rules for the application of Article 7 of Council Directive 2002/53/EC as regards the characteristics to be covered by the tests at least, and the minimum requirements for the examination of certain varieties of agricultural plant species (OJ L 327, EU No L 254 n ° 7);

Procedure

§ 1 Application

(1) The plant variety protection application shall be submitted in two copies, the application for a variety authorisation in triplicate; the variety denomination shall be given in two copies.(2) For the applications and the indication of the variety denomination, forms of the Bundessortenamtes are to be used.(3) Subject to the request for variety approval, a variety of

§ 1b Nature and way of the Submission of applications in electronic form

§ 2 Register Review

§ 3 Test of value

§ 4 Examination of physiologic characteristics in the case of rebe

examine the performance of the conditions referred to therein, taking into account the characteristics referred to in the respective Article 2 in each case, and shall take into account the conditions in each of them in each of the relevant provisions of Article 2 of the Treaty. Article 3. To the extent that the Annexes to these Directives are referred to in Articles 1 to 3 of Directives 2003 /90/EC and 2003 /91/EC, the Federal Office of the Union shall apply the Annexes in the version in force in each case. If these Annexes are amended, the Federal Office shall apply the Annexes in the amended version, as published in the Official Journal of the European Union, at the beginning of the application date set out in the amending Directive.(2) If, in the application for the authorisation of the plant variety, the applicant indicates different methods of cultivation or use not covered by the same scope of the test, the examination of the physiological characteristics for each of the following shall be carried out in the case of varieties of vine. shall be carried out separately or in a separate manner. § 7 Examination reports

§ 8 Reassessment of the continued existence of the variety, monitoring of plant variety maintenance

Recognition of non-approved seed varieties

§ 11

§ 12 Basic Regulation

(1) The fee levels and rates are determined by the respective fee list (Appendixes 2 and 3). § 13 examination fees
