This Regulation shall be used to implement the following Directives:
1.
Commission Directive 2003 /90/EC of 6. October 2003 laying down detailed rules for the application of Article 7 of Council Directive 2002/53/EC as regards the characteristics to which the tests have to be carried out and the minimum requirements for the examination of certain varieties agricultural plant species (OJ L 327, EU No L 254 (7));

Procedure

§ 1 Application

(1) The request for a variety right shall be made in two copies, the application for a variety authorisation in triplicate; the variety denomination shall be given in two copies. (2) For the applications and the indication of the variety denomination, the following shall be given: (3) Subject to the request for a variety of varieties, a variety of

§ 1a Admission of electronic form

Section 1b The manner in which applications are submitted in electronic form

(1) The electronic documents shall be submitted in the manner described in Annex 1. (2) The electronic documents may also be submitted in paper form without an electronic signature. § 2 Register examination

(1) The Federal Office of Germany shall begin the examination of the variety on distinctness, homogeneity and stability (register examination) in the period of vegetation following the date of application, if the application has been made up to the date announced for the particular type of application. has been fully received. § 3 Value examination

§ 6 Implementation of the exams

the examination for the performance of the conditions referred to therein, including the characteristics referred to in the respective Article 2 in each case, taking into account the requirements referred to therein in each of the respective Article 3. To the extent that the Annexes to these Directives are referred to in Articles 1 to 3 of Directives 2003 /90/EC and 2003 /91/EC, the Federal Office of the Union shall apply the annexes in the version in force in each case. If these annexes are amended, the Federal Office shall apply the Annexes in the amended and published in the Official Journal of the European Union at the beginning of the application date specified in the amending Directive. (2) Specifies the applicant in the application for a variety authorisation, different methods of cultivation or use not covered by the same scope of the test, the value test and, in the case of varieties of vine, shall be the examination of the physiological characteristics for each specified method of cultivation or Use direction performed separately. § 7 Examination reports

§ 8 Reexamination of the continued existence of the variety, monitoring of the plant variety

§ 9 Cultivation and market significance

Recognition of seed of non-approved varieties

§ 11

where documents are available, which enable the same information to be obtained for the recognition and verification, as in the case of approved varieties.
(2) The Office of the Federal Office shall, upon request, determine whether the conditions laid down in paragraph 1 are met and shall inform the applicant thereof.

Fees and expenses

§ 12 Basic provision

(1) The fee rates and rates are determined according to the respective fee list (Appendixes 2 and 3). § 13 Examination fees

§ 14 Annual fees, monitoring fees

(1) The fees for each year of protection (renewal fees) or for the supervision of a variety or further maintenance (monitoring fees) shall be during the period of the protection of the variety, the approval of the variety or the registration of the other type of protection. (2) In the cases of Section 41 (2) and (3) of the Plant Variety Protection Act (Sortenschutzgesetz), the following shall be paid in the case of the classification of the rights of the breeder. § 15 Transport with other bodies
