§ 1 Legal form of the Foundation

Under the name "Stiftung Bundespräsident-Theodor-Heuss-Haus" (Stiftung Bundespräsident-Theodor-Heuss-Haus), a legal foundation under public law is established in Stuttgart. The Foundation shall be established with the entry into force of this Act. Unofficial table of contents

§ 2 Purpose of the Foundation

(1) The purpose of the Foundation is to:
1.
To commemorate the work of the first Federal President of the Federal Republic of Germany, Theodor Heuss, for the freedom and unity of the German people, for Europe, for understanding and reconciliation among the peoples, and to contribute to the to provide an understanding of recent history and the emergence of the Federal Republic of Germany; and
2.
To collect, maintain, manage and evaluate Theodor Heuss's estate for the interests of the general public in science, education and politics.
(2) The fulfilment of this purpose shall in particular be the following:
1.
Establishment, entertainment and expansion of the public memorial site "Stiftung Bundespräsident-Theodor-Heuss-Haus" in Stuttgart;
2.
Establishment and maintenance of an archive in addition to the research and documentation centre in Stuttgart;
3.
Publication of archival holdings and scientific studies;
4.
Events in the sense of the purpose of the foundation.

§ 3 Foundation assets

(1) The Foundation's assets form those immovable and movable property acquired by the Federal Republic of Germany for the purpose of the Foundation. (2) The Foundation shall be entitled to accept grants from third parties. (3) To fulfil of the foundation's purpose (§ 2 para. 1), the foundation receives an annual grant from the federal government in accordance with the respective federal budget. (4) The foundation's assets and other income are to be used only in the sense of the purpose of the foundation. Unofficial table of contents

§ 4 Statute

The Foundation has a statute that is decided by the Board of Trustees by a majority of four fifths of its members and requires the approval of the Federal Government Commissioner for Affairs of Culture and the Media. The same shall apply to amendments to the Articles of Association. Unofficial table of contents

Section 5 Institutions of the Foundation

§ 6 Kuratorium

(1) The Board of Trustees consists of five members, who are appointed by the Federal President for a period of five years. Two members are proposed by the federal government, one member each is proposed by the heirs Theodor Heuss and by the city of Stuttgart; the fifth member elects the Federal President. A representative shall be ordered in the same way for each of the five members. Repeated order is permissible. (2) If a member of the board of trustees or his representative prematurely departs, an appointment of the successor may be effected only for the remainder of the time for which the member or the representative was appointed. (3) The right of the heirs Theodor Heuss is limited to the second generation in the direct lineage of Theodor Heuss. (4) The Board of Trustees elects a chairman and his deputy. (5) The Board of Trustees decides on all fundamental questions which are part of the remit of the Foundation. It monitors the activities of the Executive Board. § 7 Executive Board

(1) The Executive Board shall consist of three members. They are appointed by the Board of Trustees by a majority of four fifths of its members, including a board member on a proposal from the Federal Government Commissioner for Culture and the Media Affairs. The statutes may stipulate that the member proposed by the Federal Government Commissioner for Culture and the Media shall take over the chairmanship of the Board of Directors. (2) The Board of Management shall execute the decisions of the Board of Trustees and shall implement the Business of the Foundation. He represents the Foundation in court and out of court. § 8 Next and honorary activities

The members of the Board of Trustees and the Board of Management are acting on a voluntary basis, insofar as they are not acting on a side-by-side basis. Unofficial table of contents

§ 9 Supervision, budget, audit

(1) The Foundation is subject to the supervision of the Federal Government Commissioner for Cultural Affairs and the Media. In carrying out its tasks the Foundation is supported by the Federal Archives; the Federal Government Commissioner for Culture and the Media regulates the nature and scope in consultation with the Board of Trustees. (2) For the budget, cash-and-cash- and accounting as well as for the accounting of the Foundation, the provisions applicable to the Federal Administration shall be applicable in accordance with the provisions of the Foundation. § 10 Employees

(1) The activities of the Foundation are usually carried out by employees (employees and workers). (2) The employees of the Foundation are the collective agreements and other provisions applicable to employees of the Federal Government. (3) The Foundation may be granted the right to have officials by means of a statutes. Unofficial table of contents

§ 11 Fees

The Foundation may charge fees for the use of foundation facilities in order to cover the administrative burden following the detailed provision of the Articles of Association. Unofficial table of contents

§ 12 Service Seal

§ 13 Adoption of rights and obligations

The "Stiftung Bundespräsident-Theodor-Heuss-Haus" (Stiftung Bundespräsident-Theodor-Heuss-Haus) takes over the rights and obligations which have been established for the Federal Republic of Germany by the contract concluded with the heirs of Theodor Heuss on 29 and 30 June 1971. This is intended to make the remission available in the archives available as permanent loan. Unofficial table of contents

Section 14 Entry into force

This Act shall enter into force on the day after the announcement.
