Based on § 58 (1) of the Federal Police Act of 19. October 1994 (BGBl. 2978), the last of which is Article 1 (11) (a) of the Law of 21. June 2005 (BGBl. 1818), the Federal Ministry of the Interior is ordering: Non-official table of contents

§ 1 Substantive Responsibilities

(1) Federal Police Presidium as the High Authority and the Federal Police Directorates as well as the Federal Police Academy as sub-authorities are factually responsible for the performance of the tasks of the Federal Police in accordance with § 1 para. 2 of the Federal Police Act.(2) The Federal Police Presidium controls and coordinates the Federal Police's nationwide task perception and carries out the supervision of the service and supervision of the federal police authorities after it has been assigned to it. The Federal Police Presidium can also carry out missions and investigations.(3) In order to carry out the following tasks, the competent authority shall be:
1.
the Federal Police Presidium for Centrally-performing tasks according to
a)
§ 3 paragraph 2 sentence 5, § 31a subsection 1 sentence 1 and § 69a para. 3 sentence 1 of the Federal Police Act,
b)
§ 63 (2) to (4) in conjunction with Section 71 (3) of the Residence Act and § 3 (2) and § 74a sentence 2 of the German Residence Act Residence Law,
c)
§ 12d Para. 3 of the Atomic Energy Act,
d)
§ 1 para. 1 of the Antiterrordateigesetz,
e)
§ 12 (1) No. 3 of the Security Inspection Act,
f)
§ 6 (1) (2) and (32) (1) (1) of the Foreigners Central Register Act (Ausländerzentralregistergesetz) and the Annex to the AZRG Implementing Regulation, where reference is made there to the federal police authority designated in this Regulation,
g)
§ 1 paragraph 1 of the right-wing extremism file-law;
1a.
the Federal Police Presidium for the Punishment of administrative offences in accordance with
a)
§ 13 para. 2 of the Federal Police Act,
b)
§ 26 No. 2 of the Passport Act,
c)
§ 10 paragraph 5 of the Freedom of Movement Act/EU,
d)
§ 64b paragraph 3 of the Railway-Building and Operating Regulations,
e)
§ 49 para. 3 of the Railway-Construction-and Operating rules for narrow gauge railways,
f)
§ 78 of the Residence Regulation;
2.
the Federal Police Department Frankfurt/Main Airport for the tasks according to § 4a of the Federal Police Act;
3.
the federal police directorate Bad Bramstedt for the tasks according to § 6 of the Federal Police Act;
4.
the The Federal Police Directorate responsible for the tasks according to
a)
§ 61 (2) of the Federal Police Act,
b)
§ 61 (3) of the Federal Police Act;
c)
§ 1 (1) of the Federal Police Act (Bundespolicgesetz). Right-wing extremism file-law;
5.
the Federal Police Directorate responsible for the prosecution of administrative offences in accordance with
a)
§ 13 para. 2 of the Federal Police Act,
b)
§ 26 No. 2 of the Passport Act,
c)
§ 10 paragraph 5 of the Freedom of Movement Act/EU,
d)
§ 64b paragraph 3 of the Railway-Building and Operating Regulations,
e)
§ 49 para. 3 of the Railway-Construction-and Operating rules for narrow-gauge railways,
f)
§ 78 of the Residence Regulation.
This excludes the responsibility for issuing warnings in the case of small-gauge railways. The
Police Presidium is only authorized to take measures pursuant to Section 31 (7) of the Federal Police Act.(5) On measures pursuant to Section 22a (1) sentence 2, § 28 (3) sentence 1, § 30 (4) and § 31 (3) sentence 1 of the Federal Police Act, the federal police directorates and the Federal Police Presidium are each locally responsible, as far as tasks are carried out in accordance with Section 1 (1) (1) (1) (1) of the Federal Police Act) 2, the second sentence shall be authorised in individual cases.(6) The Federal Police Academy is the central training and training centre of the Federal Police.(7) The Federal Police Office, which is referred to in the signature of Figure 9 of Annex II to Section 9 of the German Armed Forces Act, is the official office of the Federal Police Bureau located in Sankt Augustin. § 2 Local responsibilities

(1) Local police directorates are responsible as follows:
1.
the federal police department Bad Bramstedt
a)
in the countries of Schleswig-Holstein and Mecklenburg-Vorpommern and
b)
at sea, inside and outside the German coastal sea, and beyond, on the maritime routes on the Ems, to the Emden Seeschleuse and to the sea Jade, on the Weser to Bremerhaven and on the Elbe up to the entrance to the Kiel Canal;
2.
the Federal Police Directorate Hannover in the state of Lower Saxony, in the State of Bremen as well as in the Free and Hanseatic City of Hamburg, unless the Federal Police Directorate Bad Bramstedt is responsible;
3.
the Federal Police Directorate Sankt Augustin In the state of North Rhine-Westphalia;
4.
the Federal Police Directorate of Koblenz in the countries of Rhineland-Palatinate, Saarland and Hesse, unless the Federal Police Directorate Airport Frankfurt/Main is responsible;
5.
the Federal Police Directorate Stuttgart in the state of Baden-Württemberg;
6.
the Federal Police Directorate Munich in the Free State of Bavaria;
7.
the federal police directorate Pirna in the States of Saxony and Thuringia, as well as in the Land of Saxony-Anhalt;
8.
the Federal Police Directorate Berlin in the Länder of Berlin and Brandenburg;
9.
the Federal Police Directorate Airport Frankfurt/Main at Frankfurt/Main Airport, as well as nationwide for the performance of tasks pursuant to § 4a of the Federal Police Act;
10.
The Federal Police Office for the Coordination of Operations of Closed Associations and Units pursuant to § 59 (2) sentence 2 of the Federal Police Act (Bundespoliczei) Federal Police Law throughout the Federal Republic of Germany.
(2) By way of derogation from the responsibilities laid down in paragraph 1, the federal police authorities are in charge of the federal police
1.
for the performance of railway police tasks according to § 3 of the Federal Police Act, to the extent that it is appropriate for the use beyond the areas of responsibility laid down in paragraph 1.
2.
for the return on the border, deportations at the border, and the repatriation of foreigners from and to other states in accordance with § 71 (3) (1) to (1b) and 1d of the Residence Act,
3.
on the instructions of the Federal Ministry of the Interior or the federal police authority in each case, insofar as these are also provided for by the The application area is responsible,
4.
for the police backup of its own facilities according to § 1 paragraph 3 of the Federal Police Act.

§ 3 Entry into force, expiry date

This regulation will take place on 1 July. March 2008, in force.
