On the basis of § 68 (1) sentence 1 of the Federal Police Act of 19. October 1994 (BGBl. 2978, 2979), the Federal Ministry of the Interior, in agreement with the Federal Ministry of Finance, is responsible for:

§ 1
Without prejudice to the tasks of the Federal Police, the customs administration shall carry out the tasks
-
1.
-
police surveillance of the borders (§ 2 para. 2 No. 1 of the Federal Police Act),
-
2.
-
police control of international traffic (Article 2 (2) (2) of the Federal Police Act) at the border crossing points listed in the Annex, as well as outside these border crossing points and
-
3.
-
the elimination of perturbals and the defence of hazards which affect the security of the borders (§ 2 para. 2 no. 3 of the Federal Police Act)
transfer to the exercise.

§ 2
Without prejudice to the tasks of the Federal Police, the customs administration shall carry out the tasks
-
1.

pursuant to section 71 (3) (1) to (1e), with the exception of the deportation and deportation at the border and the repatriation of foreigners from and to other states, in accordance with § 71 (3) no. 2 to 6 and in accordance with Section 71 (4) of the Residence Act in the respective the current version,
-
2.
-
in accordance with § § 10 and 19 (1) sentence 2 of the Passport Act of 19 April 1986 (BGBl. 537), as amended, and
-
3.
-
pursuant to Section 8 (1) (b) and (3) of the Free Movement of Movement (EU) of 30 July 2004 (BGBl. 1950, 1986), as amended.
transfer to the exercise, insofar as they are incurred in connection with the performance of the tasks pursuant to § 1.

§ 3
In accordance with § 12 of the Federal Police Act, the customs administration carries out the necessary inexorable measures for the prosecution of criminal offences and administrative offences, which they determine in the performance of the tasks in accordance with § § 1 and 2.

§ 4
The Federal Police and the Customs Administration shall inform each other of all non-personal information which is relevant for the performance of their duties and shall provide each other with the information necessary for this purpose. § § 32 and 33 of the Federal Police Act remain unaffected.

§ 5
(1) The same laws, regulations and administrative provisions governing the performance of the duties by the Federal Police shall apply to the performance of the duties in accordance with § § 1 to 3 by the Customs Administration. In particular, the customs administration has the powers of the Federal Police, which are derived from the Second Section (§ § 14 to 50) of the Federal Police Act and from the law on the direct coercion in the exercise of public authority by law enforcement officers of the Federal Government in the adjusted version published in the Federal Law Gazans Part III, outline number 201-5, as last amended by Article 23 of the Regulation of 29 June 2009. October 2001 (BGBl. 2785), as amended. (2) The customs administration shall observe the instructions given in connection with the task perception within the framework of the professional supervision (§ 68 sentence 2 in conjunction with Section 66 (2) sentence 3 of the Federal Police Act).

§ 6
The Federal Ministry of the Interior nominates the Federal Ministry of Finance to the federal police authorities, which has entrusted it with the exercise of professional supervision. The Federal Ministry of the Interior and the Federal Ministry of Finance regulate the supervision by the federal police authorities by mutual agreement.

This Regulation shall enter into force on 1 July 2005.
