On the basis of § 57 (1) and (3) and § 58 (1) No. 3 of the Personal Promotion Act (PBefG) of 21 March 1961 (Bundesgesetzbl. 241), as last amended by the Act amending the Commercial Code and on the establishment of a Commercial Register of 13 June 1974 (Bundesgesetzbl. 1281), is ordered with the consent of the Federal Council:

Section 1
General provisions

§ 1 Scope

(1) The Regulation shall apply to undertakings which carry passengers with motor vehicles or trolleybuses as far as they are subject to the provisions of the Passenger Transport Act. (2) § § 2, 3, 6 to 9, § § 14 to 19, 20 para. 1 No. 1, § § 21, 22, 33 para. 4 and 1, 4, 5 (b) to (f), (4), (5) (a) and (c), (5) (a) and (c), (6), (1) (1) (1) to (3) shall apply in accordance with the provisions of Section 1 (4) (d), (g) and (i) of the exemption regulation of 30 June 2013. August 1962 (BGBl. 601), as last amended by Article 1 of the Second Regulation amending the rules on the promotion of passenger rights of 30 June 1989 (BGBl I). 1273), subject to the use of motor vehicles designed and equipped for the carriage of more than six persons (including vehicle drivers), in accordance with the design and equipment. For the purposes of these provisions, the approval authority shall be the authority which would have jurisdiction in the event of non-exemption from the provisions of the Passenger Transport Act. § 2 Basic Rule

The operation of the company, as well as the equipment and characteristics of the vehicles, must meet the specific requirements arising from the confidence in safe and orderly transport.

§ 3 Duties of the entrepre

(1) The contractor shall be responsible for ensuring compliance with the provisions of this Regulation and following the orders issued by the authorities. It shall ensure that the undertaking is properly managed and that the vehicles and operating facilities are in the correct state. It may not order or permit the operation of the undertaking if it is known or has to be aware that members of the driving or operating staff are not competent and suitable to carry out safe and proper transport (2) As far as the size of the enterprise or other operational circumstances so require, the contractor shall issue a general service instruction. The approval authority may require the issuing of a general service instruction. A service instruction must be issued when an operating manager is appointed. The service instruction shall be notified in an appropriate manner. (3) The service instruction shall contain provisions on the role, responsibility and conduct of the driving and operating staff during the service, in particular:
1.
the provisions of this Regulation governing the driving service and the rules otherwise applicable to the safe operation of the establishment;
2.
instructions on measures to be taken in the event of accidents at work and in the event of malfunction;
3.
Provisions in so far as they are conditioned by local conditions or by the nature of the operating facilities, the vehicles or the holding.

§ 4 Operating Director

(1) The contractor may appoint an operating manager for the performance of the tasks assigned to him in accordance with Section 3, without prejudice to his/her own responsibility. Where the undertaking has a number of branches or operations, a responsible operating manager may be appointed for each branch of operation or for each of the operations. The approval authority may order the appointment of a manager, if the size of the holding or other operational circumstances so require; the order shall be ordered, in particular, for undertakings where more than Ten vehicles are used. The approval authority may set a reasonable time limit for the operator to comply with the order. The contractor must comply with the order. (2) The contractor must ensure that the manager is able to carry out the tasks assigned to him in an orderly manner. He shall, in particular, contribute to:
1.
the identification of staffing needs;
2.
the selection, assessment and use of the driving and operating staff;
3.
the investigation of misconduct and the measures resulting therefrom,
4.
the planning and construction of operating facilities and the procurement of vehicles.
(3) The operating manager shall have a deputy. The provisions of the third and fourth sentences of paragraph 1 shall apply. (4) The appointment of the manager and his deputy shall require the approval of the approval authority. It shall be granted if the reliability is given, in particular where the knowledge and experience required for the technical management of the establishment and the administration are demonstrated. (5) The confirmation shall be withdrawn if: in the case of issue, the condition set out in the second sentence of paragraph 4 has not been provided. The approval authority may withdraw from the withdrawal if the defect no longer exists. (6) The confirmation shall be revoked if the condition set out in the second sentence of paragraph 4 has subsequently been omitted. Unofficial table of contents

§ 5 Federal Foreign Minister

(1) Where an entrepre does not have his registered office (residence) at the place of residence, the approval authority may order that he appoint a representative established at the place of residence in order to carry out the duties assigned to him in accordance with Article 3. The approval authority may set a reasonable time limit for the contractor to comply with the order. (2) The appointment of the representative shall require confirmation by the approval authority. It may only be pronounced if the representative is reliable and technically suitable within the meaning of Section 13 (1) (2) and (3) of the Passenger Transport Act. (3) The confirmation shall be withdrawn if, in the course of its grant, one of the conditions of the second sentence of paragraph 2. Section 4 (5) sentence 2 shall apply accordingly. (4) The confirmation shall be revoked if the condition of reliability has subsequently been omitted. Unofficial table of contents

§ 6 Reporting obligation

The operator shall immediately inform the approval authority
1.
business events that arouse public attention,
2.
accidents in which a person has been killed or seriously injured,
3.
Malfunctions in trolleybus traffic and on scheduled services with motor vehicles, which are expected to last longer than 24 hours.

§ 7 Basic Rule

The operating staff employed in the service shall be subject to the particular care which results from the fact that persons are entrusted with the transport of persons. Unofficial table of contents

§ 8 Behavior in the driving service

(1) The operating staff employed in the driving service or for the service of passengers has to behave in a considerate and prudent manner. (2) In the trolleybus traffic as well as in the regular traffic with motor vehicles according to § 42 PBefG, the next stop is (2a) In the case of bus and coach transport, the driver shall ensure that the passengers are indicated by means of information (§ 21 para. 2) when safety belts are to be placed. The driver shall inform the passengers of the duty to apply safety belts prior to entering the vehicle, if such a requirement exists. (3) The trolleybus service and the regular service with motor vehicles shall be used for the carriage of the vehicle. Operating staff shall not be allowed to
1.
during the service and the readiness for service of alcoholic beverages or other means affecting the activity of the service to be taken or to take the journey, although it is under the effect of such beverages or means,
2.

3.
in the case of the steering of the vehicle, use television radio receivers,
4.
to use transmission equipment, sound radio receivers or sound reproduction equipment to other than in-company or public radio communications during the transport of passengers,
5.
to talk about the steering of the vehicle.
(4) The rules laid down in paragraph 3 (1), (3) and (5) shall apply to occasional transport by bus and coach. (5) The provisions of the rules of the , paragraph 3 (1) and (3). Unofficial table of contents

§ 9 Behavior in sickness

(1) Members of the operating staff employed in the service or for the service of passengers shall not exercise this activity as long as they or members of their domestic community are to be held in accordance with Article 34 (3) (2), (4), (4), (6), (8) and (11) of the Infection Protection Act of 20 July 2000 (BGBl. 1045), unless they show, by means of a medical certificate, that there is no risk of transmission of the disease. (2) If a driver has a disease which affects his or her suitability, a vehicle shall be safe in the (3) Diseases referred to in paragraphs 1 and 2 shall be notified without delay to the trader. § 10 Co-operation of regulations and timetables

The current rules on transport charges, transport conditions and timetables must be carried out. On request, passengers shall be granted access to the passengers. Unofficial table of contents

§ 11 Fundables

At the end of each journey, drivers or creators will have to determine whether objects have been left behind. The facts shall be delivered without delay to the establishment of the holding or to the body designated by the approval authority if it cannot be returned immediately. Section 978 of the Civil Code remains unaffected.

Section 13 Carriage of persons

The trader and the operating staff employed in the service shall be obliged to carry out the transport of persons in accordance with the provisions of the Act on the Promotion of Persons. Where there is no exclusion from the obligation to transport under other legislation, they may refuse carriage if there are facts which justify the assumption that the person to be transported poses a risk to safety and the order of the holding or for the passengers. § 14 Behavior of passengers

(1) The passengers shall behave in the same way as the safety and order of the holding and the consideration of other persons when using the operating facilities and vehicles. (2) In particular, passengers shall be prohibited from:
1.
in trolleybuses and bus and coach buses to entertain themselves with the driver during the journey,
2.
to open the doors in their own power during the journey,
3.
abusive controls of the security equipment,
4.
toss or leave objects out of the vehicle,
5.
to jump up or down during the journey,
6.
to enter a vehicle designated as occupied,
7.
enter or leave a vehicle if the imminent departure is announced or the doors are closed,
8.

9.
to use radio or television broadcast radio receivers and sound reproduction equipment.
(3) In the case of trolleybus services and on scheduled services with motor vehicles, passengers shall also be obliged to:
1.
to enter and leave the vehicles only at the stops; exceptions shall be subject to the consent of the operating staff,
2.
to get in and out quickly, using the specially marked doors,
3.
To keep the entrants and entrants open,
4.
always have a firm hold in the vehicle,
5.
to carefully supervise accompanying children and to ensure that children do not kneel or stand on the seats.
(4) In spite of a reminder, a passenger may be excluded from the carriage, despite the admonition of the duties assigned to him under paragraphs 1 to 3. Unofficial table of contents

Section 15 Carriage of goods

(1) The passenger has to accommodate and supervise things (hand luggage, luggage, pushchairs) in such a way that the safety and order of the operation cannot be endangered by them and that other passengers cannot be harassed. The first sentence shall also apply to animals; they shall not be placed on seats. Passes and entrants and exits shall be kept free. (2) Dangerous substances and dangerous goods shall be excluded from transport, in particular:
1.
explosive, easily flammable, radioactive, irritant or corrosive substances,
2.
unpacked or unprotected things that passengers can infringe,
3.
Objects that project beyond the boundaries of the wagon.
(3) § 14 (1) sentence 2 and (4) shall apply.

Equipment and characteristics of the vehicles

Section 16 Applicable Provisions

In addition to the regulations adopted pursuant to the Road Traffic Act, the provisions of this Regulation shall apply to the construction, equipment and quality of the vehicles. By way of derogation from the first sentence, for vehicles in international traffic and transit traffic (sections 52 and 53 of the Passenger Transport Act) with states outside the European Union, it may be possible to improve road safety and to improve traffic safety. Environmental compatibility shall be subject to special requirements which comply with the rules in force in the European Union. Unofficial table of contents

Section 17 Permissible Vehicles

The vehicles used for the carriage of passengers shall have at least two axles and four wheels. Unofficial table of contents

Section 18 Equipment

When using the vehicles, the equipment must be adapted to the respective road and weather conditions. When the circumstances appear, winter tyres, snow chains, spades and hackers, as well as towing ropes or rods, are to be carried along. Unofficial table of contents

Section 19 Nature and affixing of signs and equipment

Signs and equipment on or in the vehicle must be designed and fitted in such a way as to ensure that no one is threatened or disabled.

§ 20 Labeling

(1) On the outsides of the trolleybuses and buses shall be affixed
1.
on the longitudinal sides of the operator ' s name and place of business; the approval authority may, in place of its trade mark or coat of arms, allow:
2.
the name of the doors when bus and coach services are used in the trolleybus and regular services
a)
on these doors only one or only one of them,
b)
the doors are only intended for certain passenger groups;
the term can also be given by a symbol.
(2) The labels or symbols must be clearly, clearly visible and clearly legible. Their effect shall not be impaired by other inscriptions or pictorial signs. Unofficial table of contents

Section 21 Understanding with the driver

(1) trolleybuses and coaches of regular services must have clearly auditable or visible means of communication
1.
for the issuing of driving or holding orders by the operating staff,
2.
in the case of a one-man operation, to inform the driver of the passenger's wish for a holding.
In buses, which are mainly used for occasional services, these facilities shall be redundant if it is ensured that the vehicle driver ' s understanding can be carried out in a different manner. (2) Buses for which buses and coaches are used. Safety belts shall have appropriate information facilities to indicate to the passengers when safety belts are to be placed. § 22 Stehings

(1) Stehings shall be permitted only if the vehicle is used in trolleybus services or on scheduled services by bus or coach. (2) In the case of a regular bus service with bus or coach services which is not local or neighbouring local services, the approval authority may: rule out the admissibility of standing places in whole or in part. § 25 Doors, alarm system and dividing wall

(1) At least on the right side of the vehicle, taxis and rental cars must have two doors. (2) Taxis and rental cars must be provided with an alarm system which can be put into service from the driver's seat. The alarm system must bring the horn to the sound at intervals and the headlights as well as the rear direction indicator lamps. In addition, the taxis sign can be brought to the blink according to § 26 (1) no. 2-also by means of built-in red light-emitting diodes. (3) Taxes and rental cars can be equipped with a partition, which is sufficient to protect the driver is bulletproof. § 26 Information

(1) Taxation must be marked
1.
by a bright ivory coloured paint; the colour shade is to be chosen RAL 1015 of the colour register RAL 840 HR of the Committee on Delivery Conditions and Quality Control (RAL) at the German Standard Committee,
2.
by means of a sign (taxicild) provided on the roof of the taxis transverse to the direction of travel and illuminated from the inside, and on the rear side with the inscription 'Taxi', according to Appendix 1.
Subject to the provisions of paragraph 2, any other than the information or inscription prescribed by this Regulation shall be prohibited. (2) Outside advertising of taxis and rental cars shall be permitted only on the side of the vehicle doors. Political and religious advertising of taxis is inadmissible. Unofficial table of contents

Section 27 Order number, Entrepreneurship

(1) In the case of taxis, the right bottom corner of the rear window shall be fitted with an outwardly and inwardly acting shield according to Appendix 3 with the serial number issued by the approval authority. (2) In the case of taxis, in the interior of the wagon, one shall be at one for the passenger. A sign with the name and registered office of the entrepre shall be placed in a visible position. § 28 Travel price indicator

(1) Taxen must be equipped with an illuminable driving price indicator. The rules of the calibration law shall apply. (2) The travel price indicator must be displayed

§ 29 Luggage

§ 30 Distance Counter

(1) A easy-to-read route counter shall be placed in a rental car. The provisions of the calibration law shall apply. Section 31 Vehicles with a permit for the taxi and rental car traffic

(1) § § 25 to 30 shall apply to vehicles which are approved for the carriage of vehicles and rental cars. If car rental is carried out, the taxicild may not be shown in accordance with § 26 (1) no. 2 and the order number pursuant to § 27 (1). (2) If a vehicle is used only to a small extent for the car rental, the approval authority may permit the vehicle to be fitted with only one driving price indicator; in such a case, when carrying out a car rental, the driver shall have the passenger on the absence of a particular distance counter and the manner in which the vehicle is calculated to point out transport charges.

§ 32 stops

(1) In the determination of the affixing of the holding marks in accordance with Article 45 (3) of the StVO, the approved timetable must be taken into account in accordance with the requirements of the operation and the traffic. at the stop, the line number and the name of the operator; instead of the name of the operator, the name may be used in the case of transport associations and transport communities,

to attach containers for the discharge of used tickets at traffic-rich stops of the local regular traffic.

Section 33 Labelling and signage

(1) Each vehicle shall be marked on the front side with a target plate and on the right side of the vehicle with a line sign. In the case of vehicles with 9 to 35 passenger seats, the identification is sufficient with a target plate at the front of the vehicle. At the rear of each vehicle, the line number must be passed. (2) At least the end point of the line (destination, destination stop) and the line number must be specified in the target sign. The route sign shall contain the line number, the starting point and the end point of the line, as well as important information on the route. If there are different routes between the starting point and the end point of the line, then the route in the destination and the route sign must be marked in a suitable manner. § 34 seats for disabled persons and persons in need of seats

The entrepre shall have seats for severely disabled persons, in the capacity of impaired persons, elderly or frail persons, expectant mothers, and for passengers with young children. These seats shall be marked by the symbol of Appendix 5 in a clearly visible position. Unofficial table of contents

Section 35 Overview of line history and stops

In vehicles which are used in local or neighbouring local traffic, an overview of the route and of the stops should be installed in a clearly visible position. Unofficial table of contents

Section 36 Exceptions to special forms of regular services

§ § 32, 33 (1) to (3) and § 35 do not apply to the special forms of liner transport (§ 43 PBefG).

§ 37 Transport charges

(2) In the event of a failure of the fare indicator, the transport charge shall be calculated on the journey through the journey; the driver shall have the passenger: shall be immediately pointed out. § 38 Travel route

Unless the passenger decides otherwise, the driver shall choose the shortest route to the destination, unless another route is more expensive or less expensive and is agreed with the passenger. Unofficial table of contents

§ 39 Use of the taxicaline

In the scope of the fixed transport charges, the taxicild (section 26 para. 1 no. 2) must be illuminated if no travel orders are carried out; this does not apply in the case of the provision of taxis on taxis. When carrying out a travel order, the lighting must be switched off.

Section 40 Transport charges

Special provisions concerning the investigations of vehicles

Section 41 Principal Investigations

(1) The main tests of the vehicles according to § 29 StVZO shall also determine whether the vehicles comply with the requirements of this Regulation. (2) According to the main investigations, the contractor has a copy of the investigation report, in the case of: bus or coach shall submit the test book immediately to the approval authority or to the authority designated by the Land government. Section 42 Extraordinary main investigations

(1) Before the first entry into service in a company, the trader shall have to carry out an extraordinary principal investigation of the vehicle at its cost and shall immediately inform the approval authority of the investigation report; (2) If a new vehicle has a general type-approval, the main examination referred to in paragraph 1 may be limited to the determination of whether the provisions of this Regulation are fulfilled. If, for a bus or coach, conformity with this Regulation has been established in the case of the granting of a general type-approval, and the holder of that Regulation certifies it by endorsement in the test book, the extraordinary principal investigation may be maintained.

Closure and transitional provisions

Section 43 Exceptions

(1) The competent supreme state authorities, or the bodies designated by them or competent by national law, may, in certain individual cases or in general for certain applicants, authorise derogations from all the provisions of this Regulation. § 45 Administrative Offences

(1) In the sense of Section 61 (1) No. 4 of the PBefG, the person who intentionally or negligently acts as an entreprenter is acting in an order to ensure that the
1.
the maintenance obligation is infringed in accordance with § 3 (1) sentence 2;
2.
orders or allows the company to operate contrary to section 3 (1) sentence 3,
3.
a fully-enforceable written order of the approval authority for the appointment of an operating manager pursuant to § 4 (1) sentence 3 to 5 or a representative pursuant to § 5 para. 1 is not followed or not complied with within the time limit set by the approval authority,
4.
the reporting obligation referred to in Article 6 (2) or (3) shall not be complied with without delay,
5.
a motor vehicle, in breach of one of the following provisions:
a)
§ 10, first sentence, on the carrying out of regulations or timetables;
b)
Section 18 on the carrying out of the prescribed equipment,
c)
Section 19 on the nature and affixing of signs and equipment;
d)
Section 20 on the labelling,
e)
Section 21 on information facilities and information facilities on the use of safety belts,
f)
Section 22 on standing places,
g)
Section 25 (2) on Alarmanlagen,
h)
Section 26 (1) (1) on the colour of the colour,
i)
Section 26 (1) (2) on the taxicild,
j)
Section 26 (1) sentence 2 or 2 sentence 2 on advertising, identification or labelling of taxis or rental cars,
k)
Section 27 (1) on the conduct of the serial number,
l)
Section 28 on travel price indicators;
m)
Section 30 on distance-counting counters,
n)
Section 31 on the use of vehicles with a permit for the transport of taxes and rental cars,
o)
Section 33 (1), (2) sentence 1 and 3, (3) or (4) on labelling and signage,
p)
Section 34 on the identification of seats for the severely disabled,
q)
Section 37 (2), second sentence, on the correction of a disturbance of the fare indicator;
r)
Section 41 (2) on the submission of a copy of the report or of the audit report,
s)
Section 42 (1) on the submission of proof.
(2) In the sense of Section 61 (1) No. 4 of the PBefG (PBefG), administrative offences are also acting intentionally or negligently.

in the case of bus and coach transport as a driver, contrary to the first sentence of Article 8 (2a), not ensuring that the passengers are indicated by means of information facilities (Article 21 (2)) when safety belts are to be set up,
2.
in the case of trolleybus traffic as well as in regular services with motor vehicles as a member of the operating staff employed in the driving service, contrary to § 8 para. 3
a)
in the course of the service and the readiness for service, alcoholic beverages or other means affecting the activity of the service shall take up or take the journey, although it is under the effect of such beverages or means,
b)

c)
in the case of the steering of the vehicle, use of television and radio receivers,
d)
use of transmission equipment, sound radio receivers or sound reproduction equipment for other than in-company or public radio communications during the transport of passengers, or
e)
maintains the steering of the vehicle,

In occasional traffic with buses and coaches as a member of the operating staff employed in the driving service, contrary to § 8 (4) in conjunction with § 8 (3)
a)
in the course of the service and the readiness for service, alcoholic beverages or other means affecting the activity of the service shall take up or take the journey, although it is under the effect of such beverages or means,
b)

c)
in the case of the steering of the vehicle, use of television and radio receivers, or
d)
maintains the steering of the vehicle,
4.
in the taxi and rental car transport as well as in other occasional traffic with passenger cars as a member of the operating staff employed in the service in breach of § 8 paragraph 5 in conjunction with § 8 para. 3
a)
in the course of the service and the readiness for service, alcoholic beverages or other means affecting the activity of the service shall take up or take the journey, although it is under the effect of such beverages or means, or
b)

c)
in the case of the steering of the vehicle, use of television and radio receivers,

, as a member of the operating staff employed in the driving service or for the service of passengers, in spite of a disease in accordance with § 9 para. 1, participating in journeys or contrary to paragraph 3 does not display a disease without delay,

as the driver of the vehicle
a)
§ 9 (2), although it is adversely affected by illness in its suitability to carry a vehicle safely in traffic,
b)
§ 10, second sentence, to a passenger who, at his request, does not grant access to the rules and timetables to be included in the relevant provisions;
c)
Section 31 (2) of the above-mentioned reference shall be made subject to:
d)
§ 33 (1), (2) sentence 1 and 3, (3) or (4) a vehicle which is not properly marked or signposted,
e)
Section 37 (1) or (2) in the carriage of taxes, calls for or computes the transport charge,
f)
Section 37 (2), second sentence, a disturbance of the driving price indicator not immediately after the end of the journey indicates to the trader,
g)
§ 37 (2) sentence 1, first sentence, 2 or 3, sentence 1, substitutes for the information required there,
h)
§ 38 does not choose the shortest route to the destination,
i)
§ 39 does not illuminate the taxicild or does not turn off the lighting when carrying out a driving order,
j)
§ 40 in the rental car transport charge calculated,
7.
as a passenger, do not comply with the obligations set out in section 14 (1) to (3) or section 15 (1).

Section 46 Berlin-clause

This Regulation shall apply in accordance with Section 14 of the Third Transfer Act of 4 January 1952 (Bundesgesetzblatt I p. 1) in conjunction with § 66 PBefG, also in the Land of Berlin. Unofficial table of contents

Section 47 Entry into force, repeal of legislation

(1) The Regulation shall enter into force two months after the date of delivery, but

Section 21, first sentence, No. 2, 1 September 1980,
2.
Section 22 (1) and section 45 (1) (5) (e) of 1 September 1985 for vehicles for the first time in circulation,
3.
§ 23 and § 45 (1) (5) (f) on 1 September 1979 for vehicles with which, until now, carriage by professional transport (§ 43 No. 1 of the PBefG) without any change of passenger or carriage pursuant to § 1 (4) (d) of the exemption regulation have been carried out,
4.
Section 26 (1) (1) and (45) (1) (5) (h) of 1 September 1980 for vehicles with a different colour paint used in the traffic of the taxis or in the taxi and rental car transport (§ 46 para. 3 PBefG),
5.
Section 26 (1) (2) and (45) (1) (5) (i) of 1 September 1978,
6.
Section 32 (2) (1) and (2) of 1 September 1979,
7.
Section 33 (1) and (2) sentences 1 and 3, as well as § 45 (1) (5) (o) and (2) (5) (c), insofar as these provisions of § 45 refer to § 33 (1) and (2) sentence 1 and 3, on 1 September 1981.
(2) The entry into force of the provisions of this Regulation shall be repealing the relevant provisions.
