Based on the Article 26 (3) of the Bundesbesoldungsgesetz (Bundesbesoldungsgesetz), which was last amended by Article 2 of the Act of 5. February 2009 (BGBl. 160), the Federal Government decrees: Non-official table of contents

§ 1 Carriage Offices for certain runways and functions

(1) In the tracks listed below, the shares of the transport authorities may not exceed the following upper limits by way of derogation from § 26 (1) of the Federal Law on Wages:
1.
in the federal police
a)
in the career of the middle police enforcement service in grade A 8 50 percent, in the Grade A 9 50 per cent; these ceilings apply only to posts assigned to functions in which police officers and police officers in the Federal Police are used until retirement
b)
in grade A 12 20 per cent in grade A 13 10. Percent;
2.
in the customs administration
a)
in the runways of the middle grade A 8 30 percent, in grade A 9 40 percent;
b)
in grades A 12 20 percent, grade A 13 10 percent;
3.
in grade A 8 35 per cent, grade A 9 15 per cent;
4.
in grade A 11 40 per cent, grade A 12 35%, grade A 13 15 %;
5.
in the career of the higher technical administrative service in grades A 15, A 16 and B 2, according to individual assessment, together 45 per cent, the Percentages relate to the total number of posts in the higher technical service in grades A 13 to A 16 and B 2.
(2) By way of derogation from Article 26 (1) of the Bundesbesoldungsgesetz (Bundesbesoldungsgesetz) and of paragraph 1 of this Regulation , the shares of the transport offices may be used for civil servants, who are mainly used in the field of information and communication technology in the area of the preparation and supervision of procedures in the field of information and communication technology, in accordance with the conditions of the relevant Do not exceed the following upper limits:

§ 2 Special regulations for transport offices

(1) By way of derogation from Section 26 (1) of the Federal Law on Remuneration, the following applies to the Federal authorities, institutions and comparable institutions of the Federal Government the following job limits:
1.
in the runways of the middle grade A 8 40 per cent, in grade A 9 40 percent;
2.
in grades A 12 40 percent, in grade A 13 30 percent;
3.
in the upper grades of grades A 15, A 16 and B 2 in total, 50% in total; in grades A 16 and B 2 together 15 %.
(2) The upper limits referred to in paragraph 1 shall not apply to federal civil servants, in so far as § 1 of this Regulation contains more favourable provisions. Non-official table of contents

§ 3 Inventory guarantee

To the extent that the share of transport offices in the federal authorities, institutions or comparable Federal institutions in accordance with the provisions of 1. This proportion shall continue to apply unchanged on the basis of the legal position in force on the establishment ceilings referred to in Article 2 of this Regulation in July 2009. § 4 flexibilization

Exceeding the transport offices shown in the budget in question in section 26, paragraph 1 of the Bundesbesoldungsgesetz (Bundesbesoldungsgesetz) or in § § 1 to 3 of this Regulation, these are valid with the consent of the respective highest federal authority, the Federal Ministry of the Interior, and the Federal Ministry of Finance as ceilings, insofar as this is necessary on account of the requirements of the Authority's tasks, in accordance with appropriate assessment, and where there is a significant public interest. § 5 Entry into force, override

This regulation occurs on the 2. July 2009, in force.
