Pursuant to Section 26 (3) of the Bundesbesoldungsgesetz (Bundesbesoldungsgesetz), which was last amended by Article 2 of the Law of 5 February 2009 (BGBl). 160) has been amended, the Federal Government is ordering: Unofficial table of contents

§ 1 Transport Offices for certain runways and functions

(1) In the following tracks, the shares of the transport authorities may not exceed the following upper limits by way of derogation from Article 26 (1) of the Federal Law on Employment and Training:
1.
in the Federal Police
a)
in the career of the middle police officers in grade A 8 50 per cent, in grade A 9 50 per cent; these ceilings apply only to posts associated with functions in which police officers and officers of the police are responsible for the Police law enforcement officers in the Federal Police can be used until retirement;
b)
in the career of senior police officers in grade A 12, 20 per cent, in grade A 13 10 per cent;
2.
in the customs administration
a)
in the average grade of grade A 8 30 per cent, in grade A 9 40 per cent;
b)
in the career of the upper grade A 12 20 per cent, in grade A 13 10 per cent;
3.
in the career of the medium-sized technical administrative staff of grade A 8 35 per cent, in grade A 9 15 per cent;
4.
in the career of the upper technical administrative staff of grade A 11 40 per cent, in grade A 12 35 per cent, in grade A 13 15 per cent;
5.
in the career of the higher technical administrative staff in grades A 15, A 16 and B 2, together with 45 per cent, the percentages are based on the total number of posts in the higher technical service in the Cremation groups A 13 to A 16 and B 2.
(2) By way of derogation from Article 26 (1) of the Bundesbesoldungsgesetz (Bundesbesoldungsgesetz) and paragraph 1 of this Regulation, it is permissible for civil servants, who are mainly responsible for the preparation and supervision of proceedings in the Information and communication technology which does not exceed the limits of the shares of the transport offices:
1.
in the average grades of grade A 8 50 per cent, in grade A 9 20 per cent;
2.
in the running tracks of the upper grade A 11 50 per cent, in grade A 12 20 per cent, in grade A 13 10 per cent.
(3) The ceilings referred to in points 3 and 4 of paragraph 1 and in paragraph 2 shall not apply to civil servants in the customs administration. Unofficial table of contents

§ 2 Special arrangements for transport offices

(1) By way of derogation from Section 26 (1) of the Bundesbesoldungsgesetz (Bundesbesoldungsgesetz), the following job limits apply to the federal supervisors, institutions and comparable institutions of the Federal Government:
1.
in the average grades of grade A 8 40 per cent, in grade A 9 40 per cent;
2.
12 40 per cent of the upper grade A 12 career, 30% in grade A 13;
3.
a total of 50 per cent of grades A 15, A 16 and B 2 in grades A 15, A 16 and B 2, together 15 per cent in grades A 16 and B 2.
(2) The ceilings referred to in paragraph 1 shall not apply to officials of the federal government, in so far as § 1 of this Regulation contains more favourable provisions. Unofficial table of contents

§ 3 Inventory guarantee

In so far as the share of transport offices in the federal authorities, institutions or similar bodies of the Federal Government is in accordance with the legal situation in force until 1 July 2009 above the establishment ceilings referred to in § 2 of this Regulation, the following shall apply: this share remains unchanged. § 4 Flexibility

If the transport offices designated in the respective budget exceed the upper limits laid down in Article 26 (1) of the Bundesbesoldungsgesetz or in Sections 1 to 3 of this Regulation, they shall apply with the consent of the respective top Federal authority, the Federal Ministry of the Interior and the Federal Ministry of Finance as ceilings, insofar as this is necessary on account of the requirements of the Authority's tasks, in accordance with appropriate assessment, and a there is considerable public interest. § 5 Entry into force, external force

This Regulation shall enter into force on 2 July 2009.
