In accordance with § 33 (5), § 34 (2) sentence 2, § 42 paragraph 1 sentence 2 and § 84 sentence 2 of the Federal disciplinary law of 9 July 2001 (BGBl. 1510) and § 126 (3) sentence 2 and § 127 (3) sentence 1 of the Federal Civil Service Act of 5 February 2009 (BGBl. 160), the Federal Ministry for Transport, Building and Urban Development is responsible for: Unofficial table of contents

§ 1 Transfer of responsibilities in the field of disciplinary law

(1) The Head of the German Meteorological Service shall be assigned to the Head of the German Meteorological Service for his or her business area:
1.
as opposed to officials of grades A 2 to A 16, C 2, C 3 and W 2:
a)
the power to fix reductions in remuneration to the maximum,
b)
the power to impose disciplinary proceedings; and
c)
the competence for the adoption of the appeal,
2.
Disciplinary powers over retirees of grades A 2 to A 16, C 2, C 3 and W 2.
(2) The heads and directors of the other subordinated authorities shall be transferred for the respective business unit:
1.
as opposed to officials of grades A 2 to A 16:
a)
the power to fix reductions in remuneration to the maximum,
b)
the power to impose disciplinary proceedings; and
c)
the competence for the adoption of the appeal,
2.
Disciplinary powers over retirees of grades A 2 to A 16.
Sentence 1 shall not apply to DFS Deutsche Flugsicherung GmbH. Unofficial table of contents

§ 2 Transfer of responsibilities in appeals proceedings in matters of civil service law

(1) DFS Deutsche Flugsicherung GmbH will delegate the responsibility for the decision on the contradictions of the civil servants of the Federal Aviation Federal Office who are active against it, against any official measures taken by them. (2) The rest of the Subordinated authorities will delegate responsibility for the respective business unit to the decision on inconsistencies in respect of civil servants ' actions taken by them. § 3 Representation in the case of claims arising from the civil service relationship

The representation of the servant in the case of claims from the civil service relationship shall be transferred to the authorities referred to in § 2 paragraph 2 insofar as they are responsible for the decision on contradictions in accordance with this order. Unofficial table of contents

§ 4 conditional clause

The Federal Ministry of Transport, Building and Urban Development reserves the right to exercise jurisdiction in accordance with § § 1 to 3 in special cases. Unofficial table of contents

§ 5 Transitional Regulation

In the case of inconsistencies and claims brought before the date of entry into force of this order, it remains with the previous competences. Unofficial table of contents

§ 6 Entry into force, expiry of the external force

This arrangement will enter into force on 15 August 2013. At the same time, the BMVBS delegation order of 25 May 2010 (BGBl. 781).
