§ 1 Scope

(1) This Regulation lays down the rules governing intra-Community movement and imports, transit and exportation
1.
Paarhufer (Artiodactyla), Unpaired Hufer (Perissodactyla), Rüsseltiere (Proboscidae), Dogs, Hauskatzen, Hasen, Rabinchen, Affen (Simiae), Halbaffen (Prosimiae), ferrets, Füchse, Nerze, living Geflügels sowie lebender Papageien, Sittiche und other birds, fish, bees and bumblebees (animals),
2.
of products, raw materials and parts of animals of the species referred to in paragraph 1, animals of animal carcasses and parts of animals and land mammals (goods) which are wild and live wild;
3.
of objects that can be carriers of contagion (objects).
This Regulation also regulates the movement within the Community and the importation of animals not listed in the first sentence of the first sentence of paragraph 1, which are intended for zoos, wild parks or other establishments which, in accordance with the provisions of Article 13 of the Directive, are 92 /65/EEC of the Council of 13 July 1992 laying down animal health conditions governing trade in and imports into the Community of animals, semen, ova and embryos, provided that they do not specifically meet the specific requirements of the Community Community rules referred to in Annex A (I) to Directive 90 /425/EEC (OJ L 196, 27.7.1990 . EC No 64) as amended by the respective national provisions in force. (2) Unless otherwise provided for in this Regulation, the provisions of this Regulation shall not apply to goods or objects which may be subject to the provisions of the Scope of Regulation (EC) No 1774/2002 of the European Parliament and of the Council of 3. October 2002 laying down the health rules for animal by-products not intended for human consumption (OJ L 327, 30.12.2002, p. EC No (3) The provisions of this Regulation shall not apply to the extent that directly applicable provisions of the European Community or of the European Union within the scope of application of this Regulation shall apply. § 2 Definitions

For the purposes of this Regulation:
1.
Horseshoe: Paarhufer (Artiodactyla), Unpaired Hufer (Perissodactyla), except Einhufer (Equidae), and Rüsseltiere (Elephantidae);
2.
Pair huts: forked arches (antilocapridae), horn carrier (bovidae), camelids (camelidae), deer (cervidae), giraffe (giraffidae), hippopotamidae, musk ochsen (moschidae), pigs (Suidae), Pekaris (Tayassuidae) and deer piglets (tragulidae);
3.
Clutchews: ruminants, camelids and pigs;
4.
Bovine animals: animals kept as domestic animals of the genus, including bison, bison and water buffalo;
5.
Unpaired huts, except for single hues: rhinocerotidae (rhinocerotidae) and tapirs (Tapiridae);
6.
Equidae: horses, donkeys, mules, tolls, zebras and zebroids;
7.
Registered equidae: farmed and farmed equidae registered in or recorded in a farmed book or registered equidae within the meaning of Article 2 (c) of Council Directive 90 /426/EEC of 26 June 1990 laying down the animal health rules governing the movement and importation from third countries of equidae (OJ L 136, 30.4.2004, p. EC No L 224 p. 42);
8.
Trunk animals: elephants (Elephantidae);
9.
Poultry: ducks, pheasants, geese, chickens, ratites (fowl), guinea fowl, vines, pigeons, turkeys and quail, which are used for breeding, production of meat or eggs or to increase the amount of wild herds;
10.
One-day chicks: poultry with an age of less than 72 hours, which have not been fed since slippage, except in the case of air agents and their intersections;
11.
Bruteier: Gewing eggs intended for incubation;
12.
Meat of ungulates: meat of bovine animals, swine, sheep, goats and solipeds;
13.
Poultrymeat: meat of poultry, other than meat of ratioed birds;
14.
Meat of farmed game: meat of ratioe and land mammals of farmed plants, other than meat of ungulates;
15.
Bees: bee colonies and bee queens with their companion bees;
16.
Livestock and farmed animals: animals intended to be used in particular for breeding or for the production of animal products, with the exception of animals for slaughter;
17.
Animals for slaughter: animals intended for immediate slaughter at a slaughterhouse or for a collection point which they are authorised to leave only for slaughter;
18.
meat: parts of slaughtered or deed animals suitable for human consumption and the meat products produced therefrom;
19.
fresh meat: meat which has not been subjected to any treatment, other than a cold treatment, which has undergone its shelf life;
20.
' meat product ' means a product which has been produced from or with the addition of meat and which has undergone a treatment, other than a refrigeration treatment, acting on its shelf life;
21.
Feedingstuffs: feedingstuffs within the meaning of the provisions of the futures legislation, consisting of or containing products;
22.
Fishing operations: plant or equipment for breeding, keeping or chilling of fish;
23.
Collection point: establishments in which clutters or solipeds from different establishments of origin are brought together for trade;
24.
EEA State: Third country party to the Agreement on the European Economic Area;
25.
Transit: imports of consignments or dispatchings of consignments imported, followed by export;
26.
Examination of documents: official examination of the certificates accompanying the animals and the goods;
27.
Inspection: official verification of the conformity of animals and goods with the certificates accompanying them;
28.
physical examination: official examination of the health condition of animals and goods;
29.
Border inspection post: official inspection body responsible for carrying out the document verification, inspection and physical examination of animals and goods at the border to a third country or in a port or airport.

§ 3 Certificates

(1) Certificates under this Regulation must be submitted to the competent authority in the original or in the case of § 30 (1) sentence 1 in a certified copy and must be issued in German or with an officially certified German Translation shall be provided. Certificates for consignments destined for another Member State must also be issued in one of the official languages of that Member State. Where broadcasts are introduced via a border inspection post situated in another Member State, the certificates must be issued at least in one of the official languages of that Member State, by way of derogation from the first sentence. Certificates issued in accordance with sentences 1 to 3 must consist of a single sheet or a multi-page, inseparable document. (2) Certificates may be issued only if they all apply to the animals or goods concerned. requirements are met. Where certificates are required for certificates or forms, and where these alternatives provide for, the existence of at least one of the alternatives shall be certified. Any deletions in predetermined patterns or forms shall be admissible only if they are concerned.
1.
non-applicable alternatives,
2.
requirements which are not required for a given age group or a particular use, or
3.
the application of an exception which has been authorised by the competent authority on the basis of this Regulation.

§ 4 Display and registration

Who is a commercial
1.
Animals or goods referred to in Appendix 1 are to be spent or imported within the Community; or
2.
Transporting housekeeed animals in the context of intra-Community introduction or import
, it shall indicate this prior to the commencend of the activity of the competent authority This shall not apply to establishments which require an authorisation in accordance with Article 15 (1) or (3) or (14) of the Fish Diseases Regulation and to establishments which have been registered or registered in another Member State because of an activity in accordance with the first sentence. The competent authority shall record the establishments shown in a register by issuing a registration number. Unofficial table of contents

§ 5 Accounting

Those who carry out an activity in accordance with § 4 sentence 1 shall have
1.
for the animals and goods imported and imported by him within the meaning of the second and third sentences, provided that he is not obliged, in accordance with Article 20 of the Animal Transport Ordinance, to lead a livestock control book,
2.
Certificates issued in accordance with the provisions of this Regulation which designate him as the recipient of the animals or goods shall be kept in accordance with the provisions of the third sentence.
From the book, the following information must be given:
1.
the place and date of the adoption of the animals or goods and the name and address of the previous owner;
2.
the date of delivery of the animals or goods and the name and address of the acquirer,
3.

§ 6 Requirements for means of transport and transport

(1) Animals and goods of the species or uses referred to in Appendix 2, column 1, may be transported or imported only in transport means or containers which meet the requirements referred to in column 2 for them. § 8 Authorisation-free movement

(1) Animals and goods of the species or uses referred to in Appendix 3, column 1, may only be brought within the Community if accompanied by a certificate required for them in column 2 for them which, in the cases referred to in the first sentence of paragraph 4, must be supplemented by the declaration referred to therein. § 10 Ban on the movement of certain goods

(1) It shall be prohibited to spend goods intended for human consumption within the Community, in so far as the goods are
1.
have been obtained from animals coming from areas or establishments which, with regard to these animals or the products they produce, have been obtained by reason of an outbreak of foot-and-mouth disease, swine fever, avian influenza, vesicular disease swine fever, the plague of bovine animals or the plague of small ruminants, or the suspicion of an outbreak, are subject to a barrier;
2.
have been slaughtered in a slaughterhouse,
a)
in which, at the time of their production, animals were found to have been infected with an animal disease listed in point 1 or suspected of being infected with an epizootic disease,
b)
where, at the time of their production or production, carcases or parts of carcases obtained from animals referred to in point (a), were obtained,
3.
have been obtained from fish derived from holdings resulting from an outbreak of infectious salmonid anaemia, infectious haematopoietic necrosis of salmonids or the viral haemorrhagic septicaemia of salmonids or of the Suspicion of an outbreak of one of these fish diseases shall be subject to protective measures in accordance with § § 7 to 10 of the Fish Disease Regulation,

have been obtained from grazing or crustaceans originating from areas or establishments resulting from an outbreak of a species listed in Annex A, List II, to Council Directive 91 /67/EEC of 28 January 1991 on animal health conditions for the placing on the market of aquaculture animals and products (OJ C 139, 30.4.2004 EC No 1) or Annex D to Council Directive 95 /70/EC of 22 December 1995 laying down minimum Community measures for the control of certain diseases in the mussel (OJ 1995 L 46, p. 1). The prohibition referred to in paragraph 1 (1) and (2) shall not apply to goods which have been found to be unjustified in the case of goods which are not considered to be unfounded.

have been collected, transported, handled and stored separately from other goods,
2.
in accordance with the conditions laid down in Annex III to the Directive, in a holding approved pursuant to Article 6 (1) (21) in conjunction with point (3) (a), (11) (a) or (c), (12), (13) or (14) of the Animal Health Act Council Directive 2002 /99/EC of 16 December 2002 laying down the animal health rules governing the production, processing, distribution and import of foodstuffs of animal origin (OJ L 327, 31.12.2002, p. 3.
are identified in accordance with Annex II to Directive 2002/99/EC.

Section 10a Other movement prohibitions

(1) The intra-Community movement of goods not listed in Annex 3, Section II or Annex 4, Section II, point 6, to products derived from animals which are not infected or suspected of being infected, shall be prohibited if they have not been subjected to any treatment. , which ensures the destruction of animal disease. § 11 Special prohibition of movement of animals and goods

(1) The intra-Community movement of animals and goods shall also be prohibited if and to the extent that:
1.
Animals, embryos and semen of bovine animals, swine, sheep, goats and horses and hatching eggs of poultry pursuant to Article 10 of Council Directive 90 /425/EEC of 26 June 1990 on veterinary and zootechnical matters Checks in intra-Community trade in live animals and products with a view to the completion of the internal market (OJ L 327, 29), as amended, or

§ 12 Bringing in other Member States

(1) Klauentiere and solipeds may only be brought to another Member State directly from a whole or part of the breeding or use of these animals or of collection points made by the competent authority. Section 14 Special provisions for fish

(1) Fish-other than eggs and semen-may not be brought from other Member States if they are
1.
are to be killed as part of a disease eradication plan, or
2.
come from a holding subject to an animal health restriction.
(2) Fish killed for human consumption and parts thereof and eggs and semen of fish derived from fish may not be brought from other Member States if they originate from animals referred to in paragraph 1. Section 16 Announcement of authorisations

1.
the third country or part thereof is listed in a non-immediate legislative act adopted by the European Community or the European Union on the basis of a corresponding legal basis referred to in column 2 and the Federal Ministry in the Federal Gazette (Bundesanzeiger), and
2.
they are accompanied by a certificate which
a)
for the animals or goods concerned and for the purpose in question in a non-imminent act which the European Community or the European Union, by reason of a corresponding one in column 3 thereof, is required to: the legal basis for the third country concerned, or the relevant part, and the Federal Ministry in the Federal Gazette (Bundesanzeiger), or
b)

Section 23 Special provisions for trade with certain third countries

Section 25 Special import bans

Imports of animals of the species listed in column 1 of Annex 9b from a third country shall be prohibited, subject to an import ban referred to in paragraph 2, for the period laid down in column 3 with respect to the disease in question, if:
1.
in the third country, the outbreak of a disease listed in column 2 for the species in question has been officially detected and
2.
the date of this finding by the Federal Ministry in the Federal Gazette
has been made. The period referred to in the first sentence shall begin with the date of publication. (2) The importation of animals, goods and objects of the species or uses referred to in Annex 10, column 1, shall be prohibited if and to the extent that:
1.
their importation by means of a measure adopted by the European Community or the European Union in respect of the third country or part of a third country on the basis of a legal basis referred to therein in column 2 shall be limited or excluded, and
2.
the Federal Ministry has made this measure known in the Federal Gazette; this also makes the repeal of the measure known in the Federal Gazette.

(1) The animals and the goods referred to in the first sentence of section 26 of the first sentence shall be subject to the import of the document examination, the inspection of the inspection and the physical examination at the border inspection post. the control and physical examination shall be carried out only if:
a)
a temporary storage as referred to in point 1 (b), and

The office of destination shall carry out a document verification, inspection and physical examination in so far as they have not already been carried out at the first border inspection post. (2) By way of derogation from paragraph 1 animals and goods from EEA States shall be subject to the inspection of the only random checks and physical examination in addition to the verification of the documents. (3) By way of derogation from paragraph 1, goods and articles imported pursuant to Section 23a , only a document examination and an examination of the situation. (4) The Paragraphs 1 and 2 shall apply to the importation of goods referred to in Annex 9a, with the proviso that only a document examination and a check-up shall be carried out. Section 30 Certificates

(1) If the person entitled to dispose of the document has a certificate in accordance with § 22 (1) (1) (2), a certificate of approval pursuant to § 24 or a certificate in accordance with Annex X to Regulation (EC) No 1774/2002, in each of the documents shall be subject to a certified copy thereof. In the case of the distribution of a consignment at the border inspection post, a number of copies of the certificate referred to in the first sentence shall be issued to the person entitled to dispose of the number of consignments produced by the division. The original of the certificate referred to in the first sentence shall be kept by the border inspection post for a period of at least three years. (2) By way of derogation from the first sentence of paragraph 1, the following shall be taken:

in the case of a consignment of registered solipeds, the document for identification according to Appendix 8 and

in the case of temporary importation of registered solipeds, the certificate referred to in Article 22 (1) sentence 1 no. 2

Section 31 Rejection

(1) If the investigations in accordance with § 27 lead to the conclusion that the animals, goods or objects do not comply with the import regulations, the consignment must be rejected by the import and the certificate accompanying the consignment shall be returned by the stamp "Rejected" to be invalid in red color. The competent authority may, in individual cases,
1.
the import
a)
the animals for immediate slaughter or killing and destruction or accommodation in a nearby approved quarantine station; and
b)
of the goods or objects for further processing in a holding approved in accordance with Articles 13 to 15, 17 or 18 of Regulation (EC) No 1774/2002, as amended, or for other non-harmful disposal
, if it is ensured that animal diseases are not disseminated;
2.
order that
a)
the animals are immediately slaughtered or killed and destroyed or placed in a nearby approved quarantine station; and
b)
the goods or objects are destroyed without delay,
if this is necessary in order to avoid any risk of disease spreading in the case of return or animals for animal welfare reasons.
The competent authority may also authorise, on a case-by-case basis, the import of feedingstuffs containing salmonella if it is ensured that these feedingstuffs are retreated following the detailed instructions of the official veterinarian. (2) The quarantine station may only be approved if the requirements set out in Annex B to Directive 91 /496/EEC, as amended, have been met.

Rules on imported animals and goods

Section 32 General provision

(1) Animated animals may only be transported directly to their place of destination. The carrier must carry the copies of the certificates according to § 30 (1) sentence 1 and 2 and the certificates according to § 30 paragraph 2. Section 33 Slaughtered Animals

Imported slaughterhouse animals may only be brought directly into the non-public place of slaughter designated by the competent authority in accordance with the first sentence of Article 13 (2), first sentence of paragraph 2. The consignee shall have the animals slaughtered or slaughtered at the latest five working days after their arrival, unless a shorter period is determined, unless a shorter time limit is set. (2) Slaughtered animals of the slaughterhouse may only be used directly or through a in accordance with Article 13 (1), first sentence, point 1, they shall be brought into the non-public place of slaughter designated by the competent authority, whether public or pursuant to section 13 (2), first sentence, No. 2. (3) Poultry imported from hatching eggs in consignments of more than 19 pieces of hatched poultry shall be subject to operation; for at least three weeks of observation by the competent authority. Section 36a Sing of imported goods in warehouses in free zones, free warehouses and customs warehouses

Imported goods may be stored in a warehouse in a free zone, a free warehouse or a customs warehouse only if the person entitled to dispose of goods has previously declared whether the goods are to be released for free circulation or whether they have been released for free circulation. Transit

Section 36b-Ban on the transit of certain goods

Section 37 Requirements for transit

(1) The transit of animals and goods of the species or uses referred to in Annex 9, column 1, which do not meet the requirements for importation, shall be subject to authorization, but in the case of goods only if they are directly applicable to the domestic market. be introduced. 1.
goods intended for human consumption, which
a)

(2) For the transit of animals, goods and objects, § § 25 to 29, 30 (2) and § 31-except for the physical examination in the case of goods in accordance with § 27, if the document verification has already shown that the goods are subject to the requirements of the goods and goods. (3) The transit of animals and goods of the species or uses referred to in Appendix 9, column 1, shall be carried out under customs supervision, in the case of goods in the form of the customs closure. takes place in a port only on the unloading quay and does not last longer than six days, or
2.
takes place on the premises of an airport only on the apron and does not last longer than eleven hours.
(6) In the case of the species or uses referred to in Annex 9, column 1, which do not meet the requirements for importation, the goods may only be carried in a warehouse in a free zone, a free warehouse or a customs warehouse in accordance with § 36a are intermediately stored. They are only allowed to
1.
stored physically separate from goods intended for import; and
2.
shall be treated in so far as it is necessary for their storage or for the distribution of a consignment in subconsignments; their packaging shall not be altered in this case.
Goods may be exported from an intermediate storage facility only for direct export, for destruction after being denatured, or, where the goods are intended for human consumption, on the supply of sea transport in the case of transport.

Section 4a
Export

§ 37a prohibitions and restrictions

The export of animals, goods and objects shall be prohibited or restricted if and to the extent that:
1.
their export is prohibited or restricted by a non-direct act of the European Community or of the European Union in the field of animal health law, and
2.
the Federal Ministry has announced the act in the Federal Gazette, which also makes known the repeal of the act in the Federal Gazette.

§ 38 Animals

if, in the case of travel or residence, no more than three animals of the following species are not brought to third parties for the purpose of surrendering:
a)
Domestic rabbits,
b)

on horses crossing the border for less than 24 hours in the event of a trip or a carriage ride,
5.
on pigeons which, for the purpose of abandonation in special transport means, are brought into or imported within the Community.

§ 39 Goods

(1) § § 8, 9, 10a, 19 para. 2, § § 20 to 22, § 23 sentence 1, § § 24 to 27, 30, 31 and 37 are not to be applied to
1.
meat, milk and milk products which, in the case of cross-border commercial travel, are or will be carried on board the staff or passengers in the means of transport;
2.
Meat, milk and milk products from Member States, with the exception of meat from the Italian autonomous region of Sardinia, and from Andorra, Norway, San Marino or the Faroe Islands, the
a)
in the carriage of persons or as a gift in the form of mail or freight or for nationals of diplomatic or consular representations, imported, imported or carried out, provided that the meat, milk and milk products are Own consumption of the feeder or of the consignee is or are intended; or

-subject to an import ban pursuant to section 25 (1), (2) or (3)-not finally prepared hunting trophies from European countries, provided that the hunting trophies are carried on for personal use or as a consignment to private persons for personal use for non-commercial purposes, are introduced or imported within the Community;
5.
feed, which
a)
in the case of travel or in the case of the transfer of residence to the animals carried along, or
b)
for the animals of a transport
shall be spent or imported in an appropriate quantity within the Community.
(2) § § 8, 9, 10a, 19 para. 2, § § 20 and 21 are not applicable to
1.
Animal carcasses of clutches, solipeds, rabbits, wild rabbits or wild boar or meat of the said animals in a quantity of up to 30 kilograms,
2.
a single animal body of cladded animal or a single animal body of land not referred to in paragraph 1.

Section 39a Application of Union law

By way of derogation from Article 1 (1), Articles 8, 22 and 24 to 27 (1) and (2) and Articles 30 to 35, intra-Community movement and importation shall also be permitted under the conditions laid down in a legislative act of the European Community or of the European Community. (1) establishments which require approval pursuant to Article 15 (1) or (3) and which were not authorised under this provision on 31 December 2004 shall be deemed to have been provisionally admitted. The provisional authorisation shall be issued,

in the case of a timely application, the decision on the application shall be indisputable.

Conditions for the authorisation of non-public slaughterhouses

I.
Requirements for the slaughterhouse
1.
There must be a place in the slaughterhouse:
1.1
Accommodation spaces for the delivered animals; they must be provided with liquid-impermeable floors and smooth walls and must be adequately illuminated; binding devices, ramps, bays and hurdles must be made of easy-to-clean and to be the disinfecting material shall be produced;
1.2
a liquid-impermeable court fortification, as well as a place for washing and disinfecting vehicles with attached, liquid-impermeable soil;
1.3
a ditch with liquid-impermeable bottom and liquid-impermeable walls for packing the dunges and the stomach and intestines, in a place from which the dunggrub can be loaded and emptied and which can be emptied in a single room A width of three metres is provided with a bottom attached to the liquid.
2.
Where the holding has a railway connection, the discharge lamp shall be provided with a soil which is impermeable to liquid and shall be equipped with bays for the temporary accommodation of the animals and with adequate lighting.
3.
The holding shall be sufficiently frozen and shall have facilities for monitoring the inputs and outputs, with which the operation of the holding shall be excluded by unauthorised persons.
II.
Provisions relating to the operation of the slaughterhouse
1.
The person responsible for the holding shall be obliged to indicate the presence, the supply and the discharge of animals to the competent authority.
2.
Slaughtered animals in the slaughterhouse from other Member States shall be slaughtered there no later than 5 days after their arrival.
3.
Sick and suspicious animals must be killed and destroyed or eliminated.
4.
Milk from cows which have been found in the slaughterhouse may only be cooked or used in other ways.

Performance of the inspection and physical examination of goods

I.
Nemity Control
1.
In the case of each consignment, the marking of the goods shall be compared with the particulars of the certificate accompanying the goods.
2.
By way of derogation from point 1, in the case of transit, the control shall be limited to the control of the identification,
a)
in the case of goods in containers or in hermetically sealed containers, the integrity of the container,
b)
in the case of officially sealed containers, the integrity of the Plombe
shall be examined.
II.
Physical investigation
1.
For each consignment, it is necessary to check whether the conditions of transport have left the goods in the correct state and there are no indications that there are grounds for animal health claims.
2.
1% of packages or packages, but at least two and at most ten packages or packages, shall be examined.
3.
In the case of loose products, at least five samples shall be examined.
4.
In the case of suspicion, further investigations should be carried out.

1. Egg cells, embryos and semen of claws and horses The transport container must be clean, disinfected and closable.
2. Bruteier 1. The transport container must:
a) used and clean for the first time, or
b) consisting of plastic material, metal or other material that can be disinfected, as well as being clean and disinfected.
2. The means of transport and transport must be such that parts of damaged hatching eggs cannot fall out during the transport operation.
3. Eggs and sperm of fish The means of transport or container shall be clean and shall be such as to ensure that water does not escape during transport.
4. Leftised fats intended for human consumption The transport container must be clean and liquid-tight.
