According to article 126 par. 3 No. 2 set 2 of the civil service law framework law in conjunction with article 172 of the federal civil servants act is the Federal Office of administration power conferred, oppositions and appeals against administrative acts, as well as the denial of a claim in matters of remuneration, to decide if it was responsible for the adoption of the administrative act or the denial of the claim of collective pay and benefit.

II. According to section 174, paragraph 3, of the federal civil servants Act the representative of the Federal Ministry of health in the administrative procedure in matters of personnel care is transferred the Federal Office of administration. The same applies to proceedings before the financial jurisdiction in child support matters. The Federal Ministry for health reserves the right to exercise legal representation even in individual cases.

III. This arrangement shall apply with effect from 1 August 2005.
