General

§ 1 Scope

This Regulation shall apply to civil servants of the Federal Government, unless otherwise provided by law. Unofficial table of contents

§ 2 Definitions

(1) An appointment is an appointment under the grounds of a civil service relationship. § 3 Performance principle

§ 4 Post-employment tendering

(1) The posts to be filled shall be written out except in the cases referred to in paragraph 2. The recruitment of applicants must be preceded by a public call for tenders. § 6 of the Federal Employment Equality Act must be taken into account. (2) The obligation to issue a vacancy in accordance with paragraph 1 shall not apply
1.
for positions of state secretaries, heads of department in the federal ministries and in the Bundestag, other political officials, lines of the other supreme federal authorities and heads of state Head of the authorities immediately following the Federal Ministries, as well as the federal bodies, institutions and foundations of public law,

for vacancies of the simple service, for which applicants can be mediated by the Federal Employment Agency.
(3) Apart from a vacancy notice,
1.
in general or in individual cases, when there are reasons for staff planning or personnel deployment and these are not attitudes,
2.
in particular individual cases, even in the case of recruitment for the reasons set out in point 1.

§ 5 severely disabled persons

(1) Only the minimum degree of physical fitness may be required of severely disabled persons. (2) In the examination procedure within the meaning of this Regulation, it is necessary to provide for the relief of persons with disabilities which are proportionate to their disability. (3) In assessing the performance of severely disabled persons, account should be taken of any restrictions on the ability to work and use because of the disability.

§ 6 Design of the runways

(1) The runways are assigned to the categories of the simple, medium, high and higher service. The affiliation of a career to a career group depends on the entrance office specified in the Federal Employment Law. (2) The following career paths can be set up in the career groups:

the non-technical administrative service,
2.
the technical administrative service,
3.
the ministry of language and cultural studies,
4.
the natural science service,
5.
the agricultural, forestry and nutrition service,
6.
the medical and health service,
7.
the sports science service,
8.
the art-scientific service and
9.
the veterinary service.

§ 7 Railroad qualification

Applicants obtain the career skills
1.
by successfully completing a specialized preparatory service or an ascent process of the federal government, or
2.
by recognition, if they
a)
the pre-education required for the relevant career; or
b)
The necessary skills through life and work experience
have acquired outside of a preparatory service or an ascent procedure of the federal government.

§ 8 Determination of runway skills

(1) If applicants have the pre-education required for the corresponding career, the competent top service authority shall recognise the runway qualification. § 9 Offices of the runways

Preparatory Services

Section 10 Setting up of preparatory services

(1) The authority referred to in Article 26 (2) of the Federal Civil Service Act shall be conferred on the competent preparatory services referred to in Annex 2 to the supreme service authorities referred to there. Section 11 Setting in the preparatory service

§ 14 Higher Service

Section 15 Extension of the preparatory services

(1) The preparatory service is to be extended on a case-by-case basis after hearing the speakers, refereners, candidates,

maternity leave,

4.

§ 16 Shortening of the preparatory services

(1) The preparatory service may be shortened if the achievement of the training target is not at risk and it is demonstrated that the skills, knowledge and skills required for career development are:
1.
a suitable vocational training completed with an examination, or
2.

§ 17 Career Examination

§ 18 Simple service

Section 19 Middle-class service

(1) The recognition of qualifications for a medium-service career in accordance with Article 7 (2) (a) requires, in addition to the educational requirements, a completed vocational training, which shall:

§ 20 Gehobener Dienst

Recognition of the qualifications of a higher-level service in accordance with Article 7 (2) (a) shall be preceded by a Bachelor's or equivalent degree awarded at a university, which shall:

§ 21 Higher Service

(1) The recognition of qualifications for a higher-service career in accordance with Article 7 (2) (a) shall be subject to a master's degree or equivalent degree and to a major professional activity of at least two Years and six months in advance, which is appropriate to provide the qualifications for the relevant career. § 19 (3) and (4) shall apply accordingly. § 22 Other applicants

Special arrangements

Section 23 Special qualifications and times

as teachers at Federal Armed Forces schools up to grade A 14 of the Bundesbesoldungsordnung A
(4) By way of derogation from § 17 of the Federal Civil Service Act (Bundesbeamtengesetz), in the case of persons who have provided professional military service, the content of the preparatory service may be replaced by the content of the the requirements of a preparatory service must be taken into account in the appropriate qualification. § 24 Admission to higher career in the possession of a university education

§ 25 Setting into a higher office than the incoming office

(1) Officials may be appointed to a higher office than the ReceivingOffice if the following conditions are met:
1.
The professional experience acquired in addition to the admission requirements laid down in § 17 of the Federal Civil Service Act must be equivalent to their nature and significance in accordance with the desired office of the relevant career path.
2.
If appropriate professional experience is not available, the special personal and professional competence for the desired office of the relevant career must be proven by means of additional qualifications.
3.
The transport office must be accessible after the individual fictitious career path.

Section 26 Adoption of judges and judges

§ 27 Exceptions to particularly high-performing civil servants

(1) By way of derogation from Article 17 (3) to (5) of the Federal Civil Service Act, appropriate posts of the middle, higher and higher service may be filled with officials and civil servants after the appropriate invitation to tender.

Trial Time

§ 28 Duration of the probation period and determination of probation

(1) The regular probative period lasts three years. Section 29 Invoice of main professional activities

§ 30 Extension of the trial period

(1) The trial period is extended by the time of a leave of absence without remuneration. This shall not apply if the probative period has been interrupted on the basis of a leave of absence of service or public interest and the existence of this condition has been established by the supreme service authority when the holiday is granted. part-time employment,

a leave of absence according to § 24 (2) of the Act on the External Action Service up to three years.

§ 31 Minimum probetime

(1) Regardless of § § 29 and 30, any civil servant or civil servant must pay the minimum probative period of one year. (2) The probative period, including the minimum period of trial, may be omitted in whole or in part if the activity which is attributable pursuant to § 29

Section 33 Selection decisions

(1) Fixed positions on suitability, competence and professional performance are usually to be made on the basis of current official assessments. In the cases referred to in the first paragraph of sentence 1, the fictitious continuation shall also be used for the evaluation of the receiving body. (4) The preparation service and the probationary period have been extended for periods during which a service pursuant to Article 15 (1), first sentence, No 4 has been completed, the time delays resulting from it shall be adequately compensated. § 34 Time of probation

(1) The probation period shall be at least six months and shall not exceed one year. Section 19 (4) shall apply mutas. § 36 Selection procedure

(1) Prior to the implementation of a selection procedure, the top service authorities shall announce in a call for tenders which subject-specific preparatory services, courses of study or other qualifications are offered for advancement. (2) The prerequisite for admission to the selection procedure is that, after the trial period has expired, applicants have proved their worth in a service period of at least four years and that: Expiry of the tendering period of the 58. Section 37 Participation in preparatory services

§ 38 Technical Qualifications

Section 40 Transfer of an office of the new career

Section 41 Repayment of the cost of training

Section 47 Service qualification

(1) The service qualification shall be promoted. Qualification measures shall, in particular:
1.
the maintenance and further development of technical, methodological and social skills for the tasks of the transferred service post and
2.
the acquisition of complementary qualifications for higher-rated posts and for the performance of management tasks.
The official qualification is regulated by centrally organised training measures of the Federal Government, insofar as they do not have the responsibility of special training facilities of individual top service authorities. The Federal Academy of Public Administration supports the authorities in the development of human resources development concepts and in the implementation of qualification measures. (2) The civil servants are obliged to provide services. (3) The officials shall be given the opportunity to take part in the professional qualifications referred to in paragraph 1 (2), provided that the interest of the service is provided by the official is given. The officials can be proposed by the supervisor or the competent supervisor, or apply for themselves. Section 48 Rule assessment, admission assessment

(1) The suitability, competence and professional performance of the civil servant or of the official shall be regularly assessed at the latest every three years or when it is necessary for the service or personal circumstances to be assessed. (2) Exceptions to the regular assessment may be approved if a service assessment is not appropriate. Section 50 Assessment procedure and assessment scale

Section 52 Preparatory services

(1) The supreme service authorities listed in Appendix 2 shall adopt, in accordance with § 10, the legal regulations governing the respective subject-specific preparatory service until 31 December 2015. § 54 Rise

Appendix 3 (to § 10 (2))

The following examination notes shall be provided in the legal regulations in accordance with Article 10 (1):
very good (1) a performance which meets the requirements to a particular extent;
good (2) a performance that is fully compliant with the requirements;
Satisfactory (3) a performance which generally meets the requirements;
sufficient (4) a performance that has shortcomings but is still in line with the requirements;
deficient (5) a performance that does not meet the requirements, but makes it clear that the necessary basic knowledge is available and that the deficiencies could be remedied in the foreseeable future;
insufficient (6) A performance that does not meet the requirements and in which even the basic knowledge is so patchy that the deficiencies could not be remedied in the foreseeable future.
In order to form the examination notes, the individual services and the overall performance of the examination can be evaluated according to a system of scores. In addition to the grade, preparatory services that complete with a Bachelor degree are also Credit points according to the European Credit Transfer System (ECTS-European credit transfer system).
